About modification of some regulations (about public agreements)

The Parliament adopts this organic law.

Art. I. – In the Law on international treaties of the Republic of Moldova No. 595/1999 (Official monitor of the Republic of Moldova, 2000, Art. No. 24-26, 137), with subsequent changes, to make the following changes:

1. In Article 1:

in part (2) words "provisions of agreements." shall be replaced with words "provisions of international treaties which party is the Republic of Moldova.";

add Article with parts (3) and (4) the following content:

"(3) the Public agreements and other agreements which are not regulated by regulations of the international public law are not international treaties.

(4) In case of the conclusion of public agreements, except the agreements regulated by special regulations, the responsible body applies rules and requirements imposed to international treaties according to the special procedure established by the Government. The public agreements having financial effects except the agreements regulated by special laws without fail receive the decision of the Commission of Parliament on foreign policy and the European integration, affirm the Government and are submitted Parliament according to the procedure, established by the Government.".

2. In Article 2:

in the concept "international treaty" of the word "rules of international law" shall be replaced with words "regulations of the international public law";

add Article with concept of the following content:

"the public agreement – the agreement signed by responsible body on behalf of the state, the Government, the ministries, other central administrative authorities or other authorized public institutions according to other state, the government, the international organization, with the foreign financial institutions created by them which do not have the status of the subject of international law, in economic, trade, financial and other areas, not regulated by regulations of the international public law.".

3. Add Article 4 with part (3) the following content:
