The government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Concept of industrial safety in the Republic of Kazakhstan for 2024 - 2030 (further – the Concept).

2. To the central state and local executive bodies responsible for implementation of the Concept to take necessary measures
on its realization.

3. To impose control of execution of this resolution on the Ministry of Emergency Situations of the Republic of Kazakhstan.

4. This resolution becomes effective from the date of its signing.

Section 2. Analysis of the current situation

High rates of injury rate and accident rate, inefficiency of the operating management system industrial safety on hazardous production facilities are essential barrier to ensuring stability of development of economy, competitiveness of domestic enterprises. It is reflected in the President's letter of the Republic of Kazakhstan of Tokayev K. K. "The economic course of Fair Kazakhstan" in which extremely burning issue of high level of industrial injuries is noted is specified to the people of Kazakhstan the considerable wear of infrastructure leading to series of accidents, deterioration in ecology and damage to health around large-scale dangerous productions. The president of the country speaks about need of acceptance of drastic measures for improvement of technological and ecological condition of system of health protection at the companies. The industry is one of the leading industries of economy of Kazakhstan to which share falls procedure for 29,7 of % of gross domestic product of the country, in regional section reaching 50 and more percent.

In the industry and its influence on national economy non-ferrous and ferrous metallurgy, the chemical and petrochemical industry, the mining sector have special value. Importance of industrial safety in these industries is caused by its influence on forming of strong industrial framework of the country. Focus of state policy is concentrated on the accelerated development of such directions as deep conversion of metals, oil, gazo-and coal chemistry, heavy engineering, conversion and uranium enrichment, production of autocomponents and fertilizers, each of which is characterized by availability of dangerous production factors. Therefore the question of industrial safety and ensuring necessary level of protection on hazardous production facilities as obligatory factor of development of the industry requires close attention from state bodies.

Shortcomings of regulatory mechanisms in the field of industrial safety

Industrial safety according to the Law of the Republic of Kazakhstan "About civil protection" is directed to observance of the requirements of industrial safety established in technical regulations, rules of ensuring industrial safety, instructions and other regulatory legal acts of the Republic of Kazakhstan. It pledges fundamental value of regulatory policy, legal and technical regulations in the field of industrial safety. The framework regulations of regulation extend to the activities performed on hazardous production facilities which the companies, production divisions and other data objects of the companies having the signs established in legislative procedure treat.

The current situation in the field of industrial safety can be characterized by means of the quantitative parameters analyzed at the national, industry or regional levels. One of basic indicators is the total quantity of persons under surveillance of subjects and hazardous production facilities in their structure.

So, following the results of 2023 in Kazakhstan in the field of industrial safety 10974 persons under surveillance of subjects are fixed. Due to the needs of nature of the country in continuous development of economy, upgrade of productions, industrial industrialization increase in number of persons under surveillance of subjects over the last 10 years constituted +70%, average rate of surplus for the last three years made +20%, their total quantity constituted in 2021 7157 units, in 2022 10345 units. At the moment among persons under surveillance of subjects there are 2592 companies which operate heavy lift gears; 1224 companies of petrochemical and oil processing industry; 858 companies of gas economy; 844 companies of mining industry; 511th companies of boiler economy; 393 companies for storage and conversion of vegetable raw materials; 383 companies of chemical industry; 222 companies of gas and oil producing industry; 138 companies of use of atomic energy; 107 companies conducting explosive works; 105 companies of metal industry; 56 companies in the field of transportation of hydrocarbonic raw material through bulk distribution lines; 32 companies of coal industry; 3509 legal entities who are carrying out works in the field of industrial safety.

More than 99% of persons under surveillance of subjects belong to private sector, more than a half of which belongs to high risk, from them 22% – large enterprises, 26% – medium business and 52% – small enterprises. Let's note that for the state persons under surveillance of subjects 78%, from them large enterprises of 88%, medium and small enterprises on 6% treat high risk. Thereby, there are distinctions caused by participation of the state.

The analysis of arrangement of persons under surveillance of subjects in the field of industrial safety in territorial section showed that in the most part they treat the city of Astana (9%), Akmola (9%) and Almaty (8%) to areas, least of all is persons under surveillance of subjects in the field of Ulytau (1%), the city of Shymkent (2%), Kostanay (3%), Kyzylorda (3%) areas. At the same time on arrangement of persons under surveillance of subjects with high risk such regions as Almaty (10%), Akmola (8%), Aktyubinsk (8%), Pavlodar (7%) areas, the smallest quantity is noted in the field of Ulytau (2%), the city of Shymkent (2%), the Turkestan region (2%), the East Kazakhstan region (2%) are in the lead. The analysis of arrangement of persons under surveillance of subjects in the field of industrial safety taking into account their dimension showed that small subjects most of all they are concentrated in Almaty (16%), Akmola (10%) and Pavlodar (7%) areas.

At the same time following the results of 2023 as a part of persons under surveillance of subjects there are 217311 hazardous production facilities. Increase tendencies are here too noted, so over the last 10 years rate of surplus made +3%, for the last three years of +1%, their total quantity constituted in 2021 – 212747 units, in 2022 – 214218 units. Structural analysis of hazardous production facilities on signs of identification showed the greatest specific weight (60%) of the production facilities having signs, the stipulated in Clause 70 Laws of the Republic of Kazakhstan "About civil protection":

the objects connected with production, use, conversion, education, storage, transportation (pipeline) and destruction at least of one of the following dangerous substances having nature of source of ionizing radiation: flammable, explosive, the fuel oxidizing and toxic substance;

the objects connected with production of fusions of ferrous, non-ferrous, precious metals and alloys on the basis of these metals;
