About approval of the Regulations on procedure of payments by banks of Ukraine and banking groups value of coefficient of leverage

According to Articles 7, of 15, of 55, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 9, of 35, 66 Laws of Ukraine "About banks and banking activity", for the purpose of implementation of provisions of Regulations of the European Parliament and Council (EU) and about modification of Regulations (EU) No. 648/2012 (with changes) concerning calculation of coefficient of leverage of Board of the National Bank of Ukraine decides No. 575/2013 of June 26, 2013 about prudential requirements to credit institutes:

1. Approve Regulations on procedure of payments by banks of Ukraine and banking groups value of coefficient of leverage (further - the Provision) which is applied.

2. To banks of Ukraine:

1) to develop intra bank provision concerning procedure of payments of value of coefficient of leverage till March 31, 2025 (inclusive);

2) to make calculation in the test mode of value of coefficient of leverage according to requirements of the Provision as of April 01, on May 01, on June 01, on July 01, 2025 and to provide information on results of such calculation in the National Bank of Ukraine in the form established by it no later than April 15, on May 15, on June 16, on July 15, 2025 respectively;

3) to approve and enter intra bank provision concerning procedure of payments of value of coefficient of leverage till July 31, 2025 (inclusive);

4) to perfrom calculation of value of coefficient of leverage according to requirements of the Provision since reporting date as of August 01, 2025.

3. To responsible persons of banking groups:

1) to develop intra group documents concerning procedure of payments of value of coefficient of leverage till June 30, 2025 (inclusive);

2) to make calculation in the test mode of value of coefficient of leverage according to requirements of the Provision as of July 01, on October 01, 2025, on January 01, 2026 and to provide information on results of such calculation in the National Bank of Ukraine in the form established by it no later than September 10, on December 10, 2025, on March 10, 2026 respectively;

3) to approve and enter intra group documents concerning procedure of payments of value of coefficient of leverage till March 31, 2026 (inclusive);

4) to perfrom calculation of value of coefficient of leverage according to requirements of the Provision since reporting date as of April 01, 2026.

4. To department of methodology of regulation of activities of banks (Oksana Prisyazhenko) after official publication to inform banks of Ukraine information on adoption of this resolution.

5. The resolution becomes effective since August 5, 2024.

I. General provisions

1. This Provision is developed according to the Laws of Ukraine "About banks and banking activity", "About the National Bank of Ukraine".

The approaches determined by this Provision are based on regulations of Regulations of the European parliament and Council (EU) No. 575/2013 of June 26, 2013 about prudential requirements to credit institutes and about modification of Regulations (EU) No. 648/2012 (with changes), and also consider the principles and recommendations of Basel Committee on Banking Supervision concerning leverage coefficient determined in the document "Basel by III: Final post-crisis reforms [Basel III: Finalising post-crisis reform (December, 2017)]".

2. Terms and reducings in this Provision are used in the following value:

1) the asset asset considered according to the active balance sheet account of the Chart of accounts of the financial accounting of banks of Ukraine approved by the resolution of Board of the National Bank of Ukraine of September 11, 2017 No. 89 (with changes) (further - the Chart of accounts);

2) the underlying asset of the derivative contract (further - underlying asset) - gets on in the value determined in part one of article 32 of the Law of Ukraine "About the capital markets and the organized goods markets" (further - the Law on the capital markets);

3) the basic indicator of the derivative contract (further - basic indicator) - is used in the value determined in part two of article 32 of the Law on the capital markets;
