About approval of Rules of conducting investigations in the field of sanitary and epidemiologic wellbeing of the population

According to subitem 5-3) of article 9 of the Code of the Republic of Kazakhstan "About health of the people and health care system", I ORDER:

1. Approve Rules of conducting investigations in the field of sanitary and epidemiologic wellbeing of the population according to appendix to this order.

2. To provide to committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of conducting investigations in the field of sanitary and epidemiologic wellbeing of the population

Chapter 1. General provisions

1. These rules of conducting investigations in the field of sanitary and epidemiologic wellbeing of the population (further – Rules) are developed according to subitem 5-3) of article 9 of the Code of the Republic of Kazakhstan "About health of the people and health care system" (further – the Code) and determine procedure for the organization and conducting investigations in the field of sanitary and epidemiologic wellbeing of the population.

2. The basic concepts used in these rules:

1) acute occupational disease (poisoning) – disease (condition) which arose after single (during no more than one change) impacts of harmful professional factors;

2) adverse manifestations after immunization (further – NPPI) – any adverse medical manifestations which follow immunization and not necessarily has cause and effect relationship using vaccines;

3) chronic occupational disease (poisoning) – disease (condition) which arose after repeated and long impact of harmful production factors;

4) investigation subject – the facts, circumstances, conditions as a result of which it is put (can be done) harm to life and (or) health of the person and (or) the circle of its dwelling which are subject to investigation;

5) poisoning – disease (condition) arising in case of sharp (single-step) or chronic (long) impact per capita of chemical, biological and other factors of the habitat;

6) the wide (unrestricted) group of people in the field of sanitary and epidemiologic wellbeing of the population – the group of people which cannot be in advance determined including its quantitative structure which affected or can affect sanitary and epidemiologic wellbeing of the population;

7) investigation in the field of sanitary and epidemiologic wellbeing of the population (further – investigation) – the complex of actions of the state bodies performing activities in the field of sanitary and epidemiologic wellbeing of the population (further – control facility and supervision), directed to identification of source of infection and localization of the center, obtaining or confirmation of data on circumstances owing to which came (can come) deterioration in the state of health of the person and (or) the circle in its dwelling, violation of requirements of regulatory legal acts in the field of sanitary and epidemiologic wellbeing of the population, determination of subjects (objects) of control and supervision, identification of the reasons and conditions promoting making of offense, establishment of event and structure of offense and also persons guilty of its making, taking measures to further non-admission of harming of life and (or) health of the person and (or) the circle of its dwelling.

3. The purpose of conducting investigation is establishment:

1) circumstances, the reasons and conditions owing to which there came violation of requirements of regulatory legal acts in the field of sanitary and epidemiologic wellbeing of the population;

2) circle of injured and contact persons;

3) subjects (objects) of control and supervision which allowed violations;

4) events and structure of violation, and also persons guilty of its making;

5) measures for further non-admission of causing damage of life and (or) health of the person and (or) circle of its dwelling.

4. During the investigation of cases of infectious, parasitic diseases and (or) poisonings based on epidemiological indications the source of infection is established and laboratory inspection of the contact persons and persons perhaps involved in spread of infection will be organized.

5. During the investigation NPPI is established immediate cause of their origin and development according to the instruction of vaccines and other immunobiological medicines (further - vaccines).

6. During the investigation, carried out by results of research of products (goods) following the results of control purchase:

1) the implementor, the supplier, the importer and the producer of products (goods) according to the submitted documents of traceability and (or) documents on assessment of conformity are established;
