1. 2. To provide to committee of civil aviation of the Ministry of transport of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days from the date of its first official publication.

Rules of the admission of the operator to aviation works

Chapter 1. General provisions

1. These rules of the admission of the operator to aviation works (further – Rules) are developed according to subitem 41-32) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for the admission of the operator to aviation works and rendering the state service "Issue of the Certificate on the Right of Accomplishment of Aviation Works".

2. In these rules the following main terms and determinations are used:

1) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

2) the certificate on the right of accomplishment of aviation works – the document of the established form issued by authorized organization in the field of civil aviation, certifying the admission of the operator to aviation works;

3) the operator – the physical person or legal entity which is engaged in operation of civil aircrafts or offering the services in this area.

3. The admission of physical persons or legal entities of the Republic of Kazakhstan to aviation works is performed by authorized organization on condition of their compliance to certified requirements to the operators of civil aircrafts (further – certified requirements) approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 153 "About approval of certified requirements to operators of civil aircrafts" (it is registered in the Register of state registration of regulatory legal acts for No. 11459).

At the choice of the applicant changes are made:

in the certificate and/or the related operational specifications;

in operational specifications of parts A and/or B.

4. Aggregate term of consideration of the request for receipt of the admission of the operator to aviation works constitutes 38 (thirty eight) working days from the date of its registration.

This term is prolonged for term necessary for elimination the revealed discrepancy of level 2, but no more than three months according to Item 16 of these rules.

The term of modification constitutes:

in the certificate and/or the related operational specifications in case of changes of the name of the operator, form of business of the legal entity, legal address, departmental accessory – 10 working days;

entering into operational specifications of parts A and B of aircrafts of one type with operated – 15 working days;

entering into operational specifications of parts A and B of aircrafts of other types which were not operated earlier – 20 working days;

entering into operational specifications of part B of types of aviation works – 20 working days;

exceptions of operational parts A and/or B of aircrafts of the specification and/or types of aviation works – 3 working days.

5. The certificate is granted for a period of three years, except for operators of easy and extralight aircraft for whom the certificate is termless.

The certificate is not subject to transfer to other person.
