According to subitem 10-1) of article 5 of the Law of the Republic of Kazakhstan "About power industry" and the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" I ORDER:

1. Approve the enclosed Rules of crediting of construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property.

2. To provide to development department of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of crediting of construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property

Chapter 1. General provisions

1. These rules of crediting of construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property (further – Rules) are developed according to subitem 10-1) of article 5 of the Law of the Republic of Kazakhstan "About power industry", and determine procedure for crediting of construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property;

2. In these rules the following concepts are used:

1) information system on monitoring of target use and assessment of results of budget credit – the organizational arranged set of the information and communication technologies, service personnel and technical documentation realizing certain technological actions by means of information exchange and intended for the solution of specific functional objectives on monitoring of target use and assessment of results of budget credit;

2) the potential final borrower – the subject of natural monopoly, the regional electric grid company who is in utility property, applying for receipt of budget credit from the borrower;

3) the administrator of the budget program – authorized body in the field of power industry;

4) budget credit – the money provided by creditors from the relevant budgets on the terms of urgency, the paid nature, recoverability and security;

5) working group – advisory advisory body on development of recommendations about provision of budget credit for construction projects, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property based on the conclusion of the confided (agent);

6) the investment project – set of the actions directed to construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property;

7) the credit request – set of the documents directed to crediting of construction, reconstruction and upgrade of power networks of the regional electric grid companies which are in utility property;

8) the credit agreement – the agreement signed between the creditor, the administrator of the budget program and the borrower, establishing legal relationship of the parties by provision, use, servicing and repayments of budget credit;

9) the creditor – the central authorized body on budget implementation;

10) the borrower – local executive bodies of areas, cities of republican value and the capital;

11) social policy of the state in power industry industry – set of the measures and actions directed to life support of the population and improvement of level and quality of life for the realization account of construction projects, reconstruction and upgrades of power networks;

12) the regional electric grid company – the power transferring organization having direct technological connection with the power making organization and (or) national power grid owning cable or air-lines of electricity transmission at least four classes of tension (220, 110, 35, 20, 10 (6), 0,4 of kilovolts), operating power networks of the regional level and having at least 10 000 attached consumers;

13) the confided (agent) – the physical and (or) legal entity determined on competitive basis and who signed the contract of the order with the administrator or the structural division authorized by it;

14) the final borrower – the subject of natural monopoly, the regional electric grid company which is in utility property the obtaining budget credit from the borrower;

15) power networks – set of substations, distributing devices and the power lines connecting them intended for transfer of electrical energy;

16) transfer of electrical energy – technologically connected actions directed to transfer and (or) distribution of electrical energy on power networks;

3. For selection of credit requests the administrator of the budget program creates the working group of representatives of the structural divisions of the administrator of the budget program interested state bodies and other organizations including representatives of public council of the administrator of the budget program, accredited associations of subjects of private entrepreneurship as a part of at least 7 (seven) people.

The chairman of working group is the head of the administrator of the budget program.

The secretary of working group is determined from number of persons employed of the administrator of the budget program. The secretary of working group is not her member.
