About establishment of the detailed regulations concerning the minimum requirements to Items of control and posts of border control

Based on Article 49, Articles 50, parts (1) Articles 51, Item b) Articles 56, parts (4) Articles 57, parts (2), (3) and (4) article 58 of the Law No. 82/2024 on official control in the agrofood sphere (The official monitor of the Republic of Moldova, 2024, Art. No. 199-201, 265) DECIDES: the Government

1. Approve:

1.1. Regulations on regulations for cases and conditions in which identity and physical control of certain goods in Items of control can be performed and in which documents on removal from posts of border control, according to appendix No. 1 can be performed;

1.2. Regulations on the special regulations concerning purpose of Items of control, the minimum requirements to posts of border control and the prior notice of loads of certain categories of the animals and goods imported into the country according to appendix No. 2;

1.3. Regulations on establishment of the detailed regulations concerning the minimum requirements to posts of border control including the inspection centers, and also format, categories and reducings which shall be used in lists of posts of border control and Items of control, according to appendix No. 3.

2. This resolution becomes effective on May 8, 2026.

3. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

4. Consider this resolution invalid from the date of accession of the Republic of Moldova to the European Union.

Regulations on regulations for cases and conditions in which identity and physical control of certain goods in Items of control can be performed and in which documents on removal from posts of border control can be performed

Chapter I General provisions

1. This Provision establishes regulations for cases and conditions in which the competent authority performs:

1.1. check of identity and physical control in the control Item other than post of border control, in the relation:

1.1.1. loads of the plants, vegetable products and other objects provided in part (1) Article 72 and part (2) article 74 of the Law No. 422/2023 on protective measures against organisms, harmful to plants (further – the Law No. 422/2023), and loads of plants, vegetable products and other objects to which the urgent measures provided in the acts approved according to part (1) Articles 28, of part (1) Articles 30, of part (3) Articles 40, of part (3) Articles 41, of part (1) Articles 49, of parts (3) and (4) Article 53 and parts (3) and (4) article 54 of the Law No. 422/2023 are applied;

1.1.2. loads of the plants, vegetable products and other objects provided in subitem 1.1. Concerning which 1, official control on posts of border control according to part is carried out (3) article 34 of the Law No. 237/2023 on ecological production and labeling of ecological products (further – the Law No. 237/2023);
