About the basic principles of the state climatic policy

This Law determines legal and organizational basis of the state climatic policy aimed at providing low-carbon and sustainable development of Ukraine, its ecological, food and energy security, achievement of climatic neutrality, ensuring mitigation of the consequences of climate change and adaptation to it, accomplishment of the international obligations of Ukraine in the field of climate change, enhancement of national system of inventory count of anthropogenic emissions of greenhouse gases from sources and absorption by absorbers of greenhouse gases, ensuring functioning of national monitoring system and assessment of goal achievement of the state climatic policy and forecasting in the field of climate change.

Section I. General provisions

Article 1. Determination of terms

1. In this Law the stated below terms are used in the following value:

1) adaptation to climate change - the process directed to reduction of vulnerability or ensuring stability of sotsio-ecological systems and infrastructure to impact of climate change for the purpose of adaptation to new climatic conditions, prevention (reduction) of negative effects of climate change;

2) anthropogenous activities - any activities of the person influencing climate change, including change of components of the atmosphere, amounts of emissions of greenhouse gases, change of landscapes, use of natural resources;

3) anthropogenic emissions - receipt in atmospheric air of greenhouse gases, pollutants or mix of such substances owing to implementation of anthropogenous activities;

4) removal of greenhouse gases - the process or type of activity directed to decrease in concentration of greenhouse gases in atmospheric air for the purpose of mitigation of the consequences of climate change;

5) emissions of greenhouse gases - receipt in atmospheric air of greenhouse gases;

6) sources of emissions of greenhouse gases - the objects, processes or types of activity causing emissions of greenhouse gases in atmospheric air;

7) measures for mitigation of the consequences of climate change - system of the specific actions, strategy and programs directed to reduction of vulnerability of ecosystems, the populations and economies to negative effects of climate change, in particular on reduction of amounts of anthropogenic emissions of greenhouse gases and/or growth in volumes of their removal;

8) change climate change of condition of climatic system over the natural variability of climate directly or indirectly connected with anthropogenous activities and observed during the comparable periods of time;

9) climatic neutrality - condition in case of which the total amount of anthropogenic emissions of greenhouse gases is equal or is compensated by the total amount of remote greenhouse gases;

10) the Intergovernmental Panel on Climate Change - the international scientific body created by the United Nations Environment Programme and the World Meteorological Organization for the purpose of systematic assessment of scientific, technical and socioeconomic aspects of climate change, and also development of scientific recommendations about reduction of risks and adaptation to climate change;

11) national system of inventory count of anthropogenic emissions from sources of emissions of greenhouse gases and removal of greenhouse gases by absorbers - the system of institutional interaction, legal and procedural mechanisms created for assessment of anthropogenic emissions of greenhouse gases and removal of greenhouse gases by absorbers and also for preparation of the reporting and archive data storage of inventory count;

12) the national inventory report of anthropogenic emissions from sources of emissions of greenhouse gases and removal of greenhouse gases by absorbers - the annual report containing quantitative and high-quality information on inventory count of anthropogenic emissions of greenhouse gases and removal of greenhouse gases absorbers for efficiency evaluation the politician and measures for mitigation of the consequences of climate change is also result of functioning of national system of inventory count of anthropogenic emissions from sources of emissions of greenhouse gases and removal of greenhouse gases by absorbers;

13) national certain contribution of Ukraine to the Parisian agreement - the obligations of Ukraine on global response to climate change consisting in implementation of actions for goal achievement, certain Framework convention of the United Nations on climate change and the Parisian agreement;

14) low-carbon development - the social and economic development of the state aimed at providing stability, preserving natural resources, mitigation of the consequences of climate change, fair access for each member of society to resources in the conditions of ecological and economic integrity and increase in level of living of the population and also is characterized by gradual reduction of amounts of anthropogenic emissions of greenhouse gases and growth in volumes of removal of greenhouse gases absorbers for the purpose of achievement of climatic neutrality;

15) greenhouse gas - the gaseous component of the atmosphere of both natural, and anthropogenous origin absorbing and reradiating infrared radiation;

16) absorption - process of removal of greenhouse gas, aerosol or precursor of greenhouse gas of atmospheric air absorber;

17) absorber - the process, type of activity or the mechanism providing removal of greenhouse gas, aerosol or precursor of greenhouse gas from atmospheric air;

18) mitigation of the consequences of climate change - the process directed to reducing anthropogenic emissions of greenhouse gases, growth in volumes of removal of greenhouse gases by absorbers and minimization of other factors causing global warming for the purpose of reduction of impact by climate change;

19) the nature oriented decisions - the actions directed to protection, preserving, recovery and ensuring steady use of ecosystems and management by them for the purpose of adaptation to climate change, preserving biological diversity, including providing steady means with the specified purpose;

20) market mechanisms and tools - set of the economic policies and measures directed to stimulation of reducing anthropogenic emissions of greenhouse gases, mitigation of the consequences of climate change and/or adaptation to it by use of market-based approaches which can include introduction of system of trade in quotas for emissions of greenhouse gases, the carbon dioxide taxes, clean development mechanisms and other financial and economic instruments which create economic incentives for reducing anthropogenic emissions of greenhouse gases and increase in investments into low-carbon technologies;

21) the sphere of climate change - the sphere of the public relations arising during the forming and realization of the state climatic policy, and also when implementing the activities directed to achievement of climatic neutrality, mitigation of the consequences of climate change and adaptation to it, ensuring low-carbon and sustainable development, ecological, food and energy security of Ukraine;

22) circular economy - the approach to management of economic resources directed to reduction of amounts of formation of waste, prolongation of useful life of products and increase in efficiency of use of resources for ensuring functioning of fair, climatic neutral, resursoeffektivny and competitive economy.

2. Other terms in this Law are used in the values given in the Framework convention of the United Nations on climate change, the laws of Ukraine "About protection of the surrounding environment", "About bases of monitoring, the reporting and verification of emissions of greenhouse gases", "On regulation of economic activity with ozone-depleting substances and the fluorinated greenhouse gases", "About energy efficiency", "About protection of atmospheric air", "About environmental impact assessment", "About the natural gas market", "On regulation of town-planning activities", "About technical rules and assessment of conformity".

Article 2. Subject and coverage of the Law

1. This Law governs the relations arising during the forming and realization of the state climatic policy and the achievements of climatic neutrality, mitigation of the consequences of climate change and adaptation to it, ensuring low-carbon and sustainable development, ecological, food and energy security of Ukraine aimed at providing.
