About approval of Rules of forming of rates

1. Approve the enclosed Rules of forming of rates.

2. To provide to management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

3) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of subitems 1) and 2) this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on the deputy defense secretary - the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan.

4. Bring this order to the interested officials and structural divisions.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming of rates

Chapter 1. General provisions

1. These rules of forming of rates (further – Rules) are developed according to the subitem 5) of article 8 of the Law of the Republic of Kazakhstan "About natural monopolies" (further – the Law) and determine procedure for forming of rates by the public institution of Armed Forces of the Republic of Kazakhstan specializing in area of airport activities (further – the Rate).

2. The main terms and determinations used in these rules:

1) depreciation – systematic distribution of depreciable cost of asset throughout the term of its useful use;

2) direct costs on services in the field of airport activities – costs which have direct causes and effect relationships with certain service and therefore directly and unambiguously treat certain service;

3) direct costs on elements of group of production processes (further – GPP) – costs which have direct causes and effect relationships with the GPP certain element and therefore can be directly and are unambiguously carried to the GPP certain element;

4) the request – the appeal of public institution of Armed Forces of the Republic of Kazakhstan specializing in the field of airport activities (further – Organization) in department of authorized body about approval of rate;

5) the involved assets – the fixed assets and intangible assets of Organization used for provision of services in the field of airport activities (further – Services);

6) the tariff estimate – the list of the income, expenses and amounts of the provided regulated service in the form approved by authorized body;

7) the temporary compensating rate – the rate approved by authorized body for certain term for the purpose of return of means to consumers;

8) temporary decreasing coefficient – the size approved by authorized body and applied to rate for the purpose of protection of consumer interests and the subject of natural monopoly;

9) authorized body – the state body performing management in the respective spheres of natural monopolies and being authorized body in the field of the state aircraft;

10) department of authorized body – the governing body determined by authorized body.

Chapter 2. Mechanism of calculation of rates of Organization

Paragraph 1. The mechanism of calculation of rate taking into account costly method of tariff regulation

The rate affirms authorized body by determination of economically reasonable costs and profit for a period of five and more years, except for the rate approved in the simplified procedure for the Organization created for the first time, rendering new regulated service (new regulated services) or acquiring (building) new objects and (or) sites if the applicable fare is approved separately on objects and (or) sites for which the rate affirms for the term of no more than one year.

4. For approval of rate the Organization provides the request in department of authorized body.

5. In case of approval of rate department of authorized body considers the request no more than 90 (ninety) working days from the date of its representation and no more than 30 (thirty) calendar days, in case of approval of rate according to Item 5 of article 20 of the Law in time.

6. The refusal bases in adoption of the request are:

1) non-presentation of documents, stipulated in Item the 7th article 15 of the Law;

2) discrepancy of the submitted documents to Item 10 of article 15 of the Law:
