Article 1. Scope of this Federal Law

1. This Federal Law governs the relations arising between federal executive bodies, executive bodies of subjects of the Russian Federation, legal entities and individual entrepreneurs in connection with implementation of licensing of separate types of activity according to the list, stipulated in Item 1 article 17 of this Federal Law.

2. Operation of this Federal Law does not extend to the following types of activity:

activities of credit institutions;

the activities connected with protection of the state secret;

activities in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

activities in the field of communication;

exchange activities;

activities in the field of customs affairs;

notarial activities;

insurance activity;

activities of professional participants of the security market;

implementation of the external economic transactions;

acquisition of weapon and cartridges to it;

use of results of intellectual activities by persons having rights to such use owing to the Federal Law or the agreement;

use of orbital and frequency resources and radio frequencies for implementation of television broadcasting and broadcasting (including broadcastings of the additional information);

use of natural resources, including subsoil, woods, objects of plant and animal life;

activities, works and services in the field of use of atomic energy;

activities of investment fund;

activities for management of investment funds, mutual investment funds and non-state pension funds;

activities of specialized depositary of investment funds, mutual investment funds and non-state pension funds;

the medical activities performed by the non-state medical organizations and other organizations entering private health care system in the territory of the innovative center "Skolkovo".

3. Features of licensing of educational activities are established by the Federal Laws governing the relations in the specified field of activity.

Article 2. Basic concepts

1. For the purpose of this Federal Law the following basic concepts are applied:

the license - special permission to the implementation of specific type of activity in case of obligatory observance of licensed requirements and conditions issued by the licensing body to the legal entity or the individual entrepreneur on paper. If in the statement for provision of the license it was indicated the need of provision of the document confirming license availability for electronic form, such document is issued by the licensing body in electronic form;

the licensed type of activity - type of activity on which implementation receipt of the license according to this Federal Law in the territory of the Russian Federation is required;

licensing - the actions connected with provision of licenses, renewal of the documents confirming availability of licenses, suspension of action of licenses in case of administrative suspension of operations of licensees for violation of licensed requirements and conditions, with renewal or cancellation of licenses, cancellation of licenses, control of licensing authorities of observance by licensees when implementing of the licensed types of activity of the relevant licensed requirements and conditions, maintaining registers of licenses and also with provision in accordance with the established procedure to interested persons of data from registers of licenses and other information on licensing;

licensed requirements and conditions - set of the specific types of activity of requirements and conditions established by regulations on licensing, which accomplishment by the licensee surely when implementing of the licensed type of activity;

licensing authorities - the federal executive bodies, executive bodies of subjects of the Russian Federation performing licensing according to this Federal Law;

the licensee - the legal entity or the individual entrepreneur having the license for implementation of specific type of activity;

the license applicant - the legal entity or the individual entrepreneur who filed in the licensing body petition for provision of the license for implementation of specific type of activity;

the register of licenses - data set about provision of licenses, renewal of the documents confirming availability of licenses, suspension and renewal of action of licenses and about cancellation of licenses.

2. For the purposes of this Federal Law the direction of statements, notifications, messages and other documents electronically is understood as the direction in the licensing body or the direction by the licensing body of the relevant electronic document (set of electronic documents) with use of information and telecommunication networks public, including the Internet, including the single portal of the state and municipal services, according to the procedure, established by the Government of the Russian Federation.

Article 3. Basic principles of implementation of licensing

The basic principles of implementation of licensing are:

ensuring unity of economic space in the territory of the Russian Federation;

establishment of the single list of the licensed types of activity;

establishment of single procedure for licensing in the territory of the Russian Federation;

establishment of licensed requirements and conditions regulations on licensing of specific types of activity taking into account the features provided by this Federal Law for specific types of activity;

publicity and openness of licensing;

respecting the rule of law when implementing licensing.
