1. Approve:

1) Rules of leave of wood on root in the woods of the Kyrgyz Republic according to appendix 1;

2) dachshunds on the wood of forest breeds released on root according to appendix 2.

2. Recognize to invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of Rules of leave of wood on root in the woods of the Kyrgyz Republic, dachshunds on the wood of forest breeds released on root and standard rates for assessment of Ploshchad Kyrgyzskaya Respubliki covered with the wood" of February 10, 2009 No. 97;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of Rules of leave of wood on root in the woods of the Kyrgyz Republic, dachshunds on the wood of forest breeds released on root and standard rates for assessment of Ploshchad Kyrgyzskaya Respubliki covered with the wood" of February 10, 2009 No. 97" of December 31, 2018 No. 653;

3) Item 2 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic and the Cabinet of Ministers of the Kyrgyz Republic in the field of forestry" of May 15, 2024 No. 248.

3. This resolution becomes effective after fifteen days from the date of official publication.

Rules of leave of wood on root in the woods of the Kyrgyz Republic

Chapter 1. General provisions

1. Rules of leave of wood on root in the woods of the Kyrgyz Republic (further - Rules) are developed according to the Forest code of the Kyrgyz Republic and establish procedure for withdrawal of cutting areas, procurements and leaves of wood, transfer of cutting areas to forest users when carrying out cabins of leaving (cabins of improvement, thinning, renewal) sanitary, reforestation, other cabins, the cabins connected with reconstruction of invaluable plantings (further - cabins) in the territory of the Kyrgyz Republic.

2. For the forest plantings which are on lands of other categories of land fund, these rules are applied taking into account purpose of these plantings to accomplishment of protective functions by them.

3. In the woods of national parks, the state natural national parks and other especially protected natural territories of the Rule are applied in the part which is not contradicting the mode of these territories, the procedure for forest management and use of the woods established by the Law of the Kyrgyz Republic "About especially protected natural territories".

4. These rules are obligatory for:

1) the companies, organizations and the organizations to which planning and control of forest management is assigned;

2) the forest users occupied with accomplishment of the actions connected with forest management and implementation of forest uses on procurement and removal of wood and minor forest materials;

3) the companies and the organizations making the cabin of the wood when clearing the forest areas withdrawn from structure of lands of the state forest fund for the state and social needs in case of transfer of the forest areas in not forest, for construction of production facilities, and also in case of production in the woods of other works, both connected, and not connected with forest management and implementation of forest uses.

5. In these rules the following main terms and concepts are used:

1) the upper warehouse - the loading platform for wood switches and assortments with the subsequent removal on the lower warehouse or to the consumer;

2) wood on root - the growing trees which are taken away to the cabin;

3) wood assortments and switches - the raw (round) and processed (sawn) forest products of the established appointment conforming to requirements of standards and specifications;

4) cutting area - the site of the wood intended to the cabin;

5) the lower warehouse - base or Item of storage of wood assortments;

6) the job specification on leave of the wood - the document of the strict reporting for carrying out cabins, the issued Lesnoy service under the Ministry of emergency situations of the Kyrgyz Republic;

7) the order - the document which grants the right to small leave of wood in case of unplanned cleaning of the wood of clutter;

8) survey of places of cabins - detection of completeness and correctness of development of cutting areas, procurements of minor forest materials, and also the left nedorub, not exported wood and other violations when implementing forest utilization;

9) plus (seed) tree - the best tree which is selected in forest plantings for the purposes of seed farming and further selection on one or complex of economic and valuable signs;

10) the process chart - the accepted technology and terms of carrying out felling works, methods of the cabin and cleaning of felling remaining balance, the scheme of placement of volok, roads, loading platforms, haulings and removals of wood, the area of preserving undergrowth and young growth and percent of their safety, methods of carrying out reforestation and action for prevention of erosive processes.

Chapter 2. Procedure for leave of wood on root

6. The procedure for leave of wood on root when carrying out cabins (except other cabins) in the territory of the state forest fund is performed according to these rules.

7. Leave of wood on root in the border territory is performed according to these rules, Articles 13, 26 Laws of the Kyrgyz Republic "About Frontier of the Kyrgyz Republic".

8. Leave of wood on root to forestries for needs of forestry is performed according to Article 50 of the Forest code of the Kyrgyz Republic.

9. Leave of wood on root in case of other cabins is performed during the carrying out forest management works, cabins of single trees in the scientific purposes, clearing of the forest areas connected with construction of water-engineering systems and power stations with use of renewable energy resources, pipelines, roads and also during the laying of glades and fire-proof gaps, development of minerals (subsurface use), conducting exploration works, in case of construction for needs of forestry, objects of the tourist industry and infrastructure of road transport, except for restrictions of the cabins provided by the Forest code of the Kyrgyz Republic is performed according to these rules. In case of other cabins selective and continuous cabins are allowed.

10. The annual amount of leave of wood on root in the territory of the state forest fund includes the annual amounts of cabins (felling fund) determined according to Article 84 of the Forest code of the Kyrgyz Republic and sanitary and improving actions.

11. The procedure for establishment of the annual amount of leave of wood on root on sites of the state forest fund, carrying out preparatory work for development of cutting areas, survey of places of cabins and the prepared wood is determined by forestry with the subsequent approval of management by authorized state body forestry. 12. Forestries create summary materials on annual leave of wood on root based on requests of the forest users having the right to forest utilization with inclusion in them of own requests for cabins.

13. Forestries according to regulatory legal acts in the field of forest management and forest management materials make branch and material money value of cutting areas on carrying out cabins with the subsequent representation of materials for receipt of the job specification on leave of the wood in Forest service under the Ministry of emergency situations of the Kyrgyz Republic.

14. The cabin of the plantings which are not entering into the state forest fund is performed according to the procedure, determined by local government bodies or local public administrations in coordination with territorial authorities of environmental protection.

15. Procurement of wood on the site of the state forest fund is performed under logging tickets and small issue orders of wood, and procurement of minor forest resources - under the contract with forestry.

16. The logging ticket is annually issued by forestries on specific cutting area and is the document granting to the forest user the right to implementation of procurement and export of wood.

17. Development of cutting areas in case of all types of cabins of the wood is made according to the process charts developed by the forest user which are approved with forestry and without which logging tickets are not issued.

The small issue order of wood is issued by forestry when cleaning the wood from clutter (cleaning of the wood of windbreak or windfall) based on the logging ticket.

18. Before issue of the logging ticket (orders) the cabin, according to the procedure of exception, within a month from the date of the beginning of the cabin is allowed:

1) the trees creating emergency (the communication lines menacing with fall on wires, electricity transmission, highway, the building and construction, apartment houses or in case of accident elimination);

2) the trees which are cut down in case of withdrawal of cutting areas, carrying out forest management, the pro-cabin of viewfinders for carrying out prospecting works and accomplishment of research works, suppression of wildfires, repair and cleaning of lesoosushitelny network, carrying out wrecking.

19. The cutting area is provided to forest users by results of the held competition by forestry with the subsequent execution of the development agreement of cutting areas, with indication of responsibility, the rights and obligations of the Parties.

The procedure for carrying out tender on right to use by felling fund is established Lesnoy by service under the Ministry of emergency situations of the Kyrgyz Republic.

20. Forest users in case of procurement of wood shall observe the requirements provided by Articles 16, of 27, 28 and 39 Forests codes of the Kyrgyz Republic and also:

1) to observe all measures for providing requirements of environmental protection;

2) not to allow use of beds of the rivers as trelevochny volok and forest roads;

3) to make cleaning of cutting areas before fire-dangerous season in the wood;

4) not to allow littering of sites of the state forest fund in case of the cabin of the wood and clearing of roads, the device of forest warehouses and construction of constructions;

5) to ensure safety plus (seed) and others, the trees which are not subject to the cabin, undergrowth, forest cultures, and also forest management and forestry and landscape signs, brands on trees and stubs;

6) not to allow destruction of roads, bridges, glades, and also road hydromeliorative and other constructions, water currents.

21. Illegally the prepared wood including prepared by forest users after the termination of the right of forest utilization and action of the logging ticket is subject to withdrawal for further realization according to regulatory legal acts of the Kyrgyz Republic.

Chapter 3. Terms and procedure for procurement, export of wood and provision of delays

22. The term of procurement of wood is established from January 1 to December 31 the current year to which the cutting area is appointed to the cabin, and export term - till May 1 of the next year. Terms of procurement and export of wood are specified in the logging ticket.

23. Forest users quarterly, no later than the 10th day of the next month, represent to forestry of the data on the area and amount of the prepared wood, including business, and also no later than January 15 of the next year - data on the area and the passing wood remaining balance on cutting area.

24. In case of leave of wood on root taking into account the prepared wood appointed to the cabin, export of wood is allowed by forestry along with its procurement.

In case of leave of wood taking into account amount of the prepared wood in the plantings damaged by the fires and also due to development of windbreak and windfall its export, on condition of the organization of accounting of this wood is allowed.

Wood is considered exported from places of cabins if it is brought to intermediate storages (the upper warehouse) at the forest roads arranged in the places specified in logging tickets (orders).

25. Leave of wood on the squares which are subject to clearing when carrying out other cabins is made in the terms established for carrying out these works in the project documentation. Logging tickets at the same time are written out within year on amount of the wood provided to development in the current year.

26. Terms of export of the wood going into the disposal of forestry (ownerless, not exported by lumberers at the scheduled time and illegally cut down), are established by forestry depending on amount of such wood, season of export, ways of transportation and other conditions.

27. In the presence of the cutting areas begun and not finished with the cabin to fixed term, the forest user can receive delay on carrying out these works for the term of no more than 5 months. Delay is granted Lesnoy by service under the Ministry of emergency situations of the Kyrgyz Republic of the written application of the forest user which shall be given no later than fixed term of the end of procurement.

28. When leaving in the wood of the wood prepared, but not exported in time, the forest user can receive delay on carrying out these works for the term of no more than 6 months. Delay is granted by forestry according to the written application of the forest user which shall be submitted no later than fixed term of the end of export of wood.

30. Forestries carry out control inspections of correctness of development of cutting areas and survey of places of cabins (compliance of the left nedorub and not exported wood by the quantity specified in the logging ticket).

Chapter 4. Responsibility for violation of these rules

31. Responsibility of forest users for violation of requirements of these rules in the territory of the state forest fund, and also in the woods which are not entering into the state forest fund is considered according to the order of the Government of the Kyrgyz Republic "About approval of dachshunds for calculation of the amount of penalties for the damage caused to objects of animal and flora, mumiyesoderzhashchy mineral raw materials and mushrooms by legal entities and physical persons" of May 3, 2013 No. 224.

32. The disputes provided by these rules in the field of use, protection, protection and reproduction of the woods including on the right to use termination, are permitted judicially.

Chapter 5. Implementation of the state control of observance of Rules

33. The state control of observance of these rules is imposed on Forest service under the Ministry of emergency situations of the Kyrgyz Republic.

- large - coefficient 2, in case of exit of timber of 80-85 percent;

- average - coefficient 1, in case of exit of timber of 65-70 percent;

- small - 1,2 coefficient in case of exit of timber of 45-55 percent.

2. In case of leave of the wood damaged by the fires, insects, mushroom diseases, windbreak, windfall and the dead standing wood of dachshund decrease in case of decrease in exit of business wood:

- from 10 to 30 percent - to 25 percent;

- from 31 to 50 percent - to 50 percent;

- from 51 to 75 percent - to 75 percent;

- more than 75 percent - to 100 percent.
