About modification and amendments in some orders of the Minister of Energy of the Republic of Kazakhstan concerning renewable energy resources

1. Approve the enclosed list of some orders of the Minister of Energy of the Republic of Kazakhstan concerning renewable energy resources to which changes and additions are made.

2. To provide to department on renewable energy resources of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of Energy of the Republic of Kazakhstan concerning renewable energy resources to which changes and additions are made

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of February 20, 2015 No. 118 "About approval of Rules of determination of rate for support of renewable energy resources" (it is registered in the Register of state registration of regulatory legal acts at No. 10622) the following changes and amendments:

Bring in the order of the Minister of Energy of the Republic of Kazakhstan of March 2, 2015 No. 164 "About approval of Rules of centralized purchase and sale of electrical energy by the single purchaser of the electrical energy made by objects for use of renewable energy resources, objects for energy waste recycling" (it is registered in the Register of state registration of regulatory legal acts at No. 10662) the following changes and amendment:

in Rules of centralized purchase and sale of electrical energy by the single purchaser of the electrical energy made by objects for use of the renewable energy resources, objects for energy waste recycling approved by the specified order:

be reworded as follows Item 2:

"2. In these rules the following basic concepts and determinations are applied:

1) the auction price – the price of purchase of the electrical energy made by object for use of renewable energy resources, object for energy waste recycling, determined following the results of biddings and which is not exceeding the level of the corresponding marginal auction price the single purchaser of electrical energy;

2) biddings – the process organized and which is carried out by the organizer of biddings in electronic system on the basis of auction and directed to selection of projects on construction of new objects for use of the renewable energy resources including equipped with systems of accumulating of electrical energy taking into account the plan of placement of these objects, objects for energy waste recycling and determination of the auction prices of the electrical energy made by objects for use of renewable energy resources, objects for energy waste recycling;

3) skilled consumers – person or group of persons, which part the direct consumers and (or) industrial complexes which are power making the organizations which are using fossil fuel for production of electrical energy, and (or) power making the organizations owning on the property right or on other legal cause acting (put into operation after January 1, 2018 and not included by authorized body in the list of the power making organizations using renewable energy resources) objects for use of renewable energy resources and (or) acting are (put into operation after January 1, 2021, including after reconstruction disposed electric powers, not considered in the approved balance estimation of electrical energy and capacity for the forthcoming seven-year period), objects for use of secondary energy resources, which developed electrical energy in full is consumed by this person or group of persons or is implemented to the single purchaser of electrical energy at the centralized biddings;

4) hybrid group – group of subjects of the wholesale market of electrical energy with cumulative share of use of renewable energy resources (further – RES) in case of production of electrical energy at least twenty five percent which are in one power node and included in the list of hybrid groups according to the procedure approved by authorized body;

5) the administrator of hybrid group – the legal entity entering into hybrid group, performing acquisition (purchase) of electrical energy from the power making organizations entering into hybrid group, for the purpose of its subsequent realization (sale) to consumers in this hybrid group and (or) in the balancing market of electrical energy, and also being provider of balance for the power making organizations and the consumers of electrical energy entering into hybrid group;

6) the consumer of hybrid group – the consumer who is the subject of the wholesale market of electrical energy and included in the list of hybrid groups;

7) settlement period – the calendar month which is beginning from 00:00 o'clock the first day of the corresponding month and coming to an end at 24:00 o'clock the last day of the corresponding month by results of which calculations of purchase and sale of amounts of electrical energy are made;

8) settlement financial center on support of renewable energy resources (further – settlement financial center) – the legal entity determined by authorized body, being the party of purchase and sale agreements of the electrical energy made by objects for use of renewable energy resources and objects for energy waste recycling according to the legislation of the Republic of Kazakhstan existing before Date of Introduction in operation of the Law of the Republic of Kazakhstan "About support of use of renewable energy resources" (further – the Law);

9) the power making organization using RES (further – the Subject) – the legal entity performing production of electrical and (or) heat energy with use of RES, except for net - consumers;
