About procedure for sale of property in cases of forced seizure of land

Based on Item 1 of Article 240 of the Civil code of the Republic of Belarus and paragraph two of part two of article 8 of the Law of the Republic of Belarus of November 13, 2023 "About change of codes" the Council of Ministers of the Republic of Belarus DECIDES: No. 312-Z

1. Approve Regulations on procedure for sale of capital structures (buildings, constructions), other real estate, the incomplete not preserved capital structures located on the parcels of land which are compulsorily withdrawn on the bases stipulated by the legislation about protection and use of lands it (is applied).

2. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix.

3. This resolution becomes effective after its official publication.

1. In the resolution of Council of Ministers of the Republic of Belarus of July 12, 2013 No. 608 "About carrying out the electronic biddings":

state preamble in the following edition:

"Based on subitem 1.6 of Item 1 of the Presidential decree of the Republic of Belarus of May 5, 2009 No. 232 "About some questions of holding auctions (tenders)", the paragraph of the eleventh subitem 1.2 of Item 1 of article 10 of the Law of the Republic of Belarus of July 12, 2013 "About investments" and Item 1 of Article 240 of the Civil code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES: No. 53-Z";

in Regulations on the procedure for carrying out the electronic biddings approved by this resolution:

to add part one of subitem 6.4 of Item 6 after the paragraph of the seventh with the paragraph of the following content:

"the property located on compulsorily withdrawn parcel of land;";

in part one of Item 10 of the word "62-13 and" shall be replaced with words "62-3, 62-8, 62-13, parts two of Item 62-22 and";

selling price of subject of the electronic biddings, including selling price of the property located on compulsorily withdrawn parcel of land and also selling price of the parcel of land or the right of lease of the parcel of land;

lease term of the parcel of land (in case of sale of the right of lease of the parcel of land);

the obligation of the winner of the electronic biddings or the applicant for purchase and terms of agreement signature of lease of the parcel of land (in case of sale of the right of lease of the parcel of land);

the term and details of the current (settlement) bank account for transfer by the winner of the electronic biddings or the applicant for purchase of payment for the property located on compulsorily withdrawn parcel of land, payments for the parcel of land or for the right of lease of the parcel of land, cost amount on the organization and carrying out the electronic biddings;

the obligation of the winner of the electronic biddings or the applicant for purchase on introduction of payment for the parcel of land or for the right of lease of the parcel of land;
