About modification and amendments in the order of the Minister of investments and development of the Republic of Kazakhstan of June 5, 2017 No. 324 "About approval of Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of June 5, 2017 No. 324 "About approval of Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 15325) the following changes and amendments:

"According to Item 1 of article 54-1 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" I ORDER:";

in the Rules of medical examination and survey in civil aviation of the Republic of Kazakhstan approved by the specified order:

state Item 1 in the following edition:

"1. These rules of medical examination and survey in civil aviation of the Republic of Kazakhstan (further – Rules) also Appendices of 1 International Civil Aviation Organization are developed according to Item 1 of article 54-1 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – ICAO).";

be reworded as follows Item 5:

"5. In these rules the following terms and determinations are used:

1) the aviation doctor – the medical specialist having the higher medical education and preparation in the field of aviation medicine, providing professional health of persons on whom safety of flights, and also health of air passengers depends in case of their address;

2) aviation medicine – the field of medicine devoted to studying of questions of medical support of aviation flights;

3) the aviation medical inspector – the aviation inspector of authorized organization in the field of civil aviation having qualification and work experience in the field of aviation medicine and the representative on implementation of certification, control and supervision in the field of civil and experimental aviation;

4) the aviation medical center (further – AMTs) - the legal entity performing medical examination in the field of civil aviation;

5) the aviation medical expert (further – the expert) – the doctor having the certificate of the aviation medical expert which had training and having practical skills and the working life in the field of aviation medicine appointed by authorized organization in the field of civil aviation for carrying out medical surveys of the faces which are directly tied with accomplishment and ensuring flights of aircrafts and their maintenance, servicing of air traffic to receipt of certificates or qualification marks;

6) aviation personnel – the physical persons having special and (or) professional training, performing activities for accomplishment and ensuring flights of aircrafts, airborne transportations and aviation works, maintenance of aircrafts, the organization and servicing of air traffic, air traffic control;

7) the certificate of aviation personnel – the document confirming qualification and powers of aviation personnel;

8) authorized body in the field of civil aviation (further – authorized body) – the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

9) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

10) extralight aircraft (further – SLA) – the civil aviation using aircrafts with the maximum certified take-off weight less than seven hundred fifty kilograms, other aircraft and auxiliary devices;

11) the profile specialist – the health worker with the higher medical education having the certificate in the field of health care;

12) easy aircraft (further – LA) – the civil aviation using aircrafts with the maximum certified take-off weight less than five thousand seven hundred kilograms including helicopters with the maximum certified take-off weight less than three thousand hundred eighty kilograms;

13) expanded medical examination – medical examination which is carried out by the expert with execution of the general report, reports of the ophthalmologist, otorhinolaryngologist (further – the ENT SPECIALIST) and recommendations of other specialists;

14) remote medical services – the provision of medical services for the purpose of diagnostics, treatments, medical rehabilitation and prevention of diseases and injuries, carrying out researches and estimates by means of digital technologies providing remote interaction of health workers among themselves, with physical persons and (or) their legal representatives, identification of specified persons, and also documentation of the actions made by them;

15) medical examination – inspection of physical person for the purpose of establishment or confirmation of the fact of availability or absence at it of disease, determination of the state of health, and also temporary disability, professional and other suitability;

16) medical examination – establishment or confirmation of availability or absence at aviation personnel of disease, determination of the state of health, and also temporary disability, professional suitability to work in the taken-up change;

17) the medical certificate – the document of the established sample issued by positive results of medical examination, confirming the applicant's compliance to requirements imposed to the validity for health reasons and the providing admission to professional activity;

18) the owner of the medical certificate – the physical person having the existing medical certificate;

19) the applicant – the physical person who submitted the application for obtaining or prolongation of the medical certificate;

20) the external pilot – person having the certificate of the external pilot, it is entrusted to them to carry out the operator necessary obligations on accomplishment of flight of remotely piloted aircraft and which manipulates relevant organs of flight control during flight time;

state Items 15 and 16 in the following edition:

"15. Issue of the medical certificate 1, of 2, 3 class and class LA and SLA are performed in AMTs.

Performing medical examination in AMTs is performed based on its certificate and certificates of the expert.

16. Prolongation and renewal of action of medical certificates is performed:

1) for the medical certificate 1, 2 and 3 classes experts of AMTs;

2) for the medical certificate of class LA and SLA experts of AMTs or experts of the medical organizations.";

22, of 23, 24 and 25 to state Items in the following edition:

"22. In case of medical examination the expert in indications determines amount of physical examination in case of medical examination according to appendix 8 to these rules and appoints survey of profile specialists.

The psychological techniques applied for the purpose of professional psychological selection of the candidate for training in specialties of civil aviation to receipt of the medical certificate and the owner of the medical certificate are carried out according to appendix 8-1 to these rules.

23. Profile specialists write down data of physical examination, the diagnosis in medical documentation, certify recommendations about the profile the signature and personal seal and fill in the report on neurologic survey on form according to appendix 9, the report of surgical survey on form according to appendix 10, the report on ophthalmologic survey on form according to appendix 11 and the report on otorinolaringologichesky inspection on form according to appendix 12 to these rules.

24. The expert writes down in medical documentation data of physical examination, the diagnosis, recommendations of profile specialists and fills in the report on medical examination (further - the Report) in form according to appendix 13 to these rules. Accuracy of the data of physical examination is certified by the signature and personal seal of the expert.

Reports of experts are stored within 10 years.

Coding of diagnoses is carried out according to the International classification of diseases in the current version. In case of report layout corrections are not allowed.

The original of the report is stored in archive of the expert, the copy of the report (certified by the expert's seal) is provided to the applicant. The electronic copy of the report is provided in authorized organization within 3 working days from the date of issue of the certificate for evaluating. The medical certificate is issued to the applicant in day of report layout and pronouncement of the medical certificate.

The aviation medical inspector of authorized organization carries out assessment of the report of medical examination on compliance to requirements, 6 and 7 these rules provided in appendices 4, of 5,.

25. By results of medical examination the medical certificate in the following formulations is taken out:

1) it is suitable for work;

2) it is suitable for work with restrictions, according to Item 26 of these rules;

3) needs treatment (improvement) with the subsequent medical examination;

4) it is unusable to work.

If working conditions of persons worsen the clinical course and the forecast of disease, the conclusion of the medical and advisory commission (further – VKK) about temporary transfer for easier work from two to six months is issued. Term is established by VKK depending on profession (specialty), weight of current and complications of disease.";

"29. In case of identification at the applicant of the diseases interfering further work (training) according to Requirements, the expert takes out the medical certificate about worthlessness.

In case of disagreement with the expert opinion the applicant within 5 working days addresses to authorized organization. In case of disagreement with the decision of authorized organization it appeals it judicially.

The procedure for appeal, submission of the claim, consideration of the claim, the decision according to the claim of the applicant are made according to the procedure, established by the Administrative procedural Procedure Code of the Republic of Kazakhstan.";

"33. Results of medical researches, consultations of profile specialists, reports of medical surveys and all records are stored in the personal record of the applicant in the expert's office.";

"52. The main objective of medical examination is establishment or confirmation of availability or absence at aviation personnel, and also at category of persons which are subject to medical examination of disease, determination of the state of health, and also temporary disability, professional suitability to work in the taken-up change including intoxication signs psychoactive agents.

Postreplaceable medical examinations are performed upon termination of the working day (change, flight) for the purpose of identification of signs of impact of harmful and (or) dangerous production factors of working environment and labor process on the state of health of workers, acute occupational disease or poisoning, intoxication signs with psychoactive agents.

Employers provide at the expense of own means timely passing of pre-flight (prereplaceable), postreplaceable obligatory medical examinations by the workers occupied on hard work, works with harmful and (or) dangerous working conditions, machines and mechanisms according to the legislation of the Republic of Kazakhstan in the field of health care.";

"55. Medical examination in the organizations of civil aviation is performed:

1) health duty worker (doctor, average health worker) of first-aid post of the organization of civil aviation or medical organization for the contract with the organization of civil aviation;

2) by means of the certified wearable medical devices.";

add with Item 55-1 of the following content:

"55-1. Health workers have professional development course on medical examination for factual determination of the use of psychoactive agents and state of intoxication.

Medical examination is performed in individual procedure without outerwear and headdress.

Presence of strangers during performing medical examination is not allowed.";

"57. Before performing medical examination the health worker checks:

1) at the crew member of the aircraft – the medical certificate; the identity document in the original or in the form of the digital document and task for flight;

2) at the air traffic controller – the medical certificate; the identity document in the original or in the form of the digital document;

3) at the worker – the omission or the identity document in the original or in the form of the digital document;

4) at the driver – the omission or the identity document in the original or in the form of the digital document and the route (route) sheet or task for accomplishment of the job specification.";

"59-1. Medical examination by means of the certified wearable medical devices is performed in the following procedure:

1) biometric and (or) visual identification of inspected;

2) poll on availability of claims;

3) test for change of reaction of pupil for light irritant;

4) the test for factual determination of the use of psychoactive agent and state of intoxication;

5) measurement of body temperature;

6) measurement of arterial pressure and pulse.

The certified wearable medical devices perform photo and (or) video fixing of process of medical examination, for the purpose of exception of falsification of results.";

"60. In case of poll claims to the state of health, duration and quality of dream, condition of prereplaceable rest, diet come to light, the behavior, the speech, mimicry, emotional condition, readiness for performance of work are estimated.

In the absence of claims, objective signs of diseases and violations of functional condition of organism, inspected it is allowed to work.";

"61-1. In case of identification of signs of intoxication psychoactive agents at inspected (alcohol smell from mouth, instability of pose, violation of the speech, the expressed trembling of fingers of hands, change of coloring of integuments, the positive indication of test of alkotest) the health worker sends it to the medical organization on medical examination taking into account need of performing repeated medical examination no later than two hours after primary medical examination.";

"70. Results of performing medical examination are registered in the Magazine of pre-flight medical examination according to appendix 16 and in the Magazine of prereplaceable (postreplaceable) medical examination according to appendix 16-1 to these rules.

In case of maintaining the Magazine in electronic form the data entered in them are certified by the digital signature, requirements of the legislation on personal data with obligatory possibility of printout of the page are considered.

In case of medical examination by means of the certified wearable medical devices results of passing by the worker of medical examination are fixed and the decision on the admission to work is made. Results of medical examination, including photo and (or) video fixing remain in the register of the certified wearable medical devices and are not subject to adjustment.

The conclusion about suitability to work is created electronically by means of the certified wearable medical devices within one minute and issued to the worker on demand.";

"70-1. The employer discharges of accomplishment of service duties of the owner of the medical certificate, the worker who did not have medical examination.";

2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.
