About modification and amendments in some regulatory legal acts of the Republic of Kazakhstan concerning enhancement of insurance activity
Board of the Agency of the Republic of Kazakhstan on regulation and development of the DECIDES: financial market
1. Approve the List of regulatory legal acts of the Republic of Kazakhstan concerning enhancement of insurance activity to which changes and additions, according to appendix to this resolution are made.
2. To provide to department of the insurance market and actuarial calculations in the procedure established by the legislation of the Republic of Kazakhstan:
1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;
3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.
3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.
4. This resolution becomes effective after three months after day of its official publication.

1. Bring in the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and supervision of the financial market and the financial organizations of September 25, 2004 No. 274 "About approval of Rules of issue by the insurance company performing activities for accumulative insurance, loans to the insurers and calculation of the redemption amount, and also procedure and conditions of provision of services by the branch of the insurance (reinsurance) nonresident organization of the Republic of Kazakhstan performing activities for accumulative insurance, for issue by the insurance nonresident organization of the Republic of Kazakhstan of loans to the insurers" (it is registered in the Register of state registration of regulatory legal acts at No. 3190) the following changes:
in Rules of issue by the insurance company performing activities for accumulative insurance, loans to the insurers and calculation of the redemption amount and also procedure and conditions of provision of services by the branch of the insurance (reinsurance) nonresident organization of the Republic of Kazakhstan performing activities for accumulative insurance, for issue by the insurance nonresident organization of the Republic of Kazakhstan of the loans to the insurers approved by the specified resolution:

"These rules of issue by the insurance company performing activities for accumulative insurance, loans to the insurers and calculation of the redemption amount and also procedure and conditions of provision of services by the branch of the insurance (reinsurance) nonresident organization of the Republic of Kazakhstan performing activities for accumulative insurance, for issue by the insurance nonresident organization of the Republic of Kazakhstan of loans to the insurers also 20-1) articles 43 of the Law of the Republic of Kazakhstan "About insurance activity", the subitem 7) of article 11 of the Law of the Republic of Kazakhstan "About state regulation, control and supervision of the financial market and the financial organizations are drafted according to subitems 20)" and establish procedure and conditions of issue by the insurance company performing activities for accumulative insurance, except for Islamic insurance company, loans to the insurers within the redemption amount to provision by the branch of the insurance nonresident organization of the Republic of Kazakhstan performing activities for accumulative insurance, except for branch of the Islamic insurance nonresident organization of the Republic of Kazakhstan, service in provision by the insurance nonresident organization of the Republic of Kazakhstan (further – the insurer) loans to the insurers within the redemption amount, and also procedure of payments of the redemption amount.";

In case of early agreement cancelation of retirement annuity transfer of the redemption amount is made according to the subitem 3) of Item 16 of the Standard agreement of the retirement annuity approved by the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market of June 7, 2023 No. 45 "About approval of the standard agreement of retirement annuity, establishment of the Method of calculation of insurance premium and insurance payment from insurance company under the contract of retirement annuity, admissible expense level of insurance company for conducting case on the signed agreements of retirement annuity, and also rate of indexation of insurance payment" registered in the Register of state registration of regulatory legal acts at No. 32831.".
