About introduction of amendments to some Laws of Ukraine concerning assistance to ensuring steady functioning of electronic communication networks and provision of electronic communication services, and also prohibition of dismantle of electronic communication networks in the conditions of emergency and warlike situation

The Verkhovna Rada of Ukraine decides:

I. Make changes to such Laws of Ukraine:

1. In the Law of Ukraine "About access to construction objects, transport, power industry for the purpose of development of electronic communication networks" (Sheets of the Verkhovna Rada of Ukraine, 2017, No. 11, Art. 101 with the following changes):

Item 6 parts one of Article 14 to state 1) in the following edition:

"6) to dismantle (to dismantle partially) the technical means of electronic communications placed on elements of infrastructure of access object without the conclusion of the agreement on access according to the legislation except the cases provided by part one of article 19 of this Law";

The Section V to add 2) with article 19 of the following content:

"Article 19. Features of access to infrastructure of access object in the conditions of emergency and warlike situation

1. In the conditions of warlike situation placement of technical means of electronic communications on elements of infrastructure of access object to the conclusion of the agreement on access for the purpose of provision of electronic communication services for ensuring requirements of the military forming created according to the legislation of Ukraine, on condition of the obligatory notification of the owner of infrastructure of access object about carrying out such works and addresses to him for the conclusion of the agreement on access to infrastructure of the relevant access object no more than in one month from the date of placement of the specified technical means and the conclusion of the agreement on access to infrastructure of the relevant access object no more than in four months from the date of placement of the specified technical means is allowed to the customer.
