About modification and amendments in the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 26, 2013 No. 750 "About approval of Rules of issue and prolongation of effective period of certificates of aviation personnel"

1. Bring in the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 26, 2013 No. 750 "About approval of Rules of issue and prolongation of effective period of certificates of aviation personnel" (registered in the Register of state registration of regulatory legal acts for No. 8782) the following changes and amendments:
in Rules of issue and prolongation of effective period of the certificates of aviation personnel approved by the specified order:
10, of 11, of 12, of 13, 14 and 15 to state Items in the following edition:
"10. The applicant for receipt of the certificate of aviation personnel (or prolongation of effective period of the certificate), directs replacements of the certificate and (or) appendix to it of introduction or prolongation of effective period of qualification and special marks to authorized organization through non-commercial joint-stock company "The Government for Citizens state corporation (further – the state corporation) or the web portal of "the electronic government": www.egov.kz (further – the portal) the list of documents of the stipulated in Item main requirements of the 8th list to rendering the state service of the state service "Issue of Certificates to Aviation Personnel", according to appendix 4 to these rules (further – the list of the main requirements to rendering the state service).
The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in the list of the main requirements to rendering the state service.
11. In case of delivery of documents through the state corporation the employee of the state corporation checks completeness and compliance of the submitted documents to the list of documents, the stipulated in Item main requirements of the 8th list to rendering the state service.
The employee of the state corporation receives the written consent of the applicant to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.
Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur turn out from the corresponding state information systems through lock of "the electronic government".
In case of the appeal to the state corporation day of acceptance and delivery date of documents are not included into authorized organization of rendering the state service in time.
In case of documents acceptance through the state corporation to the applicant the SMS notification on subscriber number, the web portal of "the electronic government" connected to accounting record arrives with reference to the receipt on acceptance of the relevant documents. If necessary the receipt on acceptance of the relevant documents according to appendix 4-1 to these rules is issued.
Issue of results of the state service through the state corporation is performed in case of presentation of the document of the proving the identity or electronic document from service of digital documents (for identification) the applicant or his representative under the notarized power of attorney.
Results which were not issued to applicants are kept in the state corporation within 1 (one) month then are transferred to authorized organization for further storage.
In case of the address of the applicant after 1 (one) month, at the request of the state corporation the authorized organization sends documents to the state corporation for issue to the applicant by means of postal service.
The authorized organization provides delivery of result of the state service in the state corporation, delivery date is not included into the state corporation of rendering the state service in time.
12. In case of delivery of documents through the portal, the status about acceptance of request for rendering the state service goes to "personal account" of the applicant.
The authorized organization performs document registration and the data in day of their receipt.
In case of receipt of documents and data through the portal and the state corporation after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, registration/issue of the request on rendering the state service is performed the next working afternoon.
Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur turn out from the corresponding state information systems through lock of "the electronic government".
The authorized organization receives digital documents from service of digital documents through the realized integration on condition of the consent of the owner of the document provided by means of the "electronic government" of subscriber number of cellular communication of the user registered on the web portal by transfer of the one-time password or departure siding of the short text message as the answer to the notification of the web portal "the electronic government.
13. In case of representation by the applicant of incomplete document package according to the list, stipulated in Item the 8th list of the main requirements to rendering the state service and (or) documents with the expired effective period, the state corporation refuses reception of an application and issues the receipt on refusal in documents acceptance according to appendix of 5 these rules.
In case of the direction of document package through the portal, the aviation licensing inspector within 2 (two) working days checks completeness of the submitted documents and in case of factual determination of incompleteness of the submitted documents or lack of the data necessary for rendering the state service, directs refusal in further review of the statement in any form (further – motivated refusal), through the portal in electronic form signed by the digital signature (further – the EDS) the head of authorized organization or replacement his face, to personal account of the applicant.
14. By provision by the applicant of complete document package, the main requirements to rendering the state service specified in Item 8 of the list, the aviation licensing inspector carries out the analysis of the provided data and for the purpose of comprehensive consideration sends documents to the aviation medicine and aviation inspector aviation training centers inspector.
The aviation medicine inspector carries out expertize of the medical certificate on compliance to the report of the aviation medical expert, except for documents of aviation personnel which do not require performing medical examination.
