1. Approve the enclosed Rules of issue and prolongation of effective period of certificates of aviation personnel.

2. Declare invalid:

1) the order of the Minister of Transport and Communications of the Republic of Kazakhstan of March 14, 2011 No. 138 "About approval of Rules of issue of certificates of aviation personnel" (registered in the Register of state registration of regulatory legal acts at No. 6860, published in the Kazakhstanskaya Pravda newspaper of August 20, 2011, No. 265-266 (26686-26687));

2) the subitem 1) the List of regulatory legal acts of the Republic of Kazakhstan to which changes and additions are made, the acting minister of transport and communications of the Republic of Kazakhstan approved by the order of December 2, 2011 No. 711 "About modification and amendments in some orders of the Minister of Transport and Communications of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts at No. 7366, published in the Kazakhstanskaya Pravda newspaper of April 19, 2012, No. 108-109 (26927-26928)).

3. To committee of civil aviation of the Ministry of Transport and Communications of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) after its state registration in the Ministry of Justice of the Republic of Kazakhstan, official publication in mass media, including Internet resource of the Ministry of Transport and Communications of the Republic of Kazakhstan and placement it on the intranet portal of state bodies.

4. To impose control of execution of this order on the vice-minister of the Ministry of Transport and Communications of the Republic of Kazakhstan Bekturov A. G.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of issue and prolongation of effective period of certificates of aviation personnel

Chapter 1. General provisions

1. These rules of issue and prolongation of effective period of certificates of aviation personnel (further – Rules) are developed according to Item 3 of article 54 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for issue and prolongation of effective period of certificates of aviation personnel and rendering the state service "Issue of Certificates to Aviation Personnel" (further – the state service).

2. In these rules the following terms and determinations are used:

1) aviation personnel – the physical persons having special and (or) professional training, performing activities for accomplishment and ensuring flights of aircrafts, airborne transportations and aviation works, maintenance of aircrafts, the organization and servicing of air traffic, air traffic control;

2) the certificate of aviation personnel – the document confirming qualification and powers of aviation personnel;

3) the register of the granted certificates of aviation personnel (further – the Register) – the document in which record about issue of certificates of aviation personnel is kept;

3-1) payments in the field of civil aviation – payment of physical persons and legal entities for the services rendered by authorized organization in the field of civil aviation and also obligatory expels of legal entities for implementation of constant surveillance over safety of flights and aviation safety by it in the budget of authorized organization in the field of civil aviation;

4) authorized body in the field of civil aviation - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

5) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

6) the organization of civil aviation – the legal entity performing activities in the field of civil aviation;

7) special mark – the additional record made in the certificate in which special conditions, the rights or restrictions, including mark about level of proficiency in language, and information relating to this certificate are specified;

9-1) complex aircraft (complex motor-powered aircraft) - airplanes with the maximum take-off weight of 5700 kg and more, or with the maximum configuration of passenger chairs more than nineteen, or for operation with the crew consisting at least of two pilots, or equipped with the turbojet engine / engines or more than one turbo-propeller engine, or the helicopter with the maximum take-off weight of 3175 kg and more, or with the maximum configuration of passenger chairs more than nine, or for operation with the crew consisting at least of two pilots or with rotary rotor;

10) the applicant – the physical person or legal entity (the organization of civil aviation) which addressed to authorized organization in the field of civil aviation for receipt of the certificate of aviation personnel;

11) the unmanned aerial vehicle – the aircraft which is carrying out flight without pilot (crew) onboard and managed in flight automatically, the operator from control center or combination of the specified methods;

12) the external pilot – physical person which performs necessary actions for accomplishment of flight of the unmanned aerial vehicle and which manages relevant organs of flight control during flight time;

13) the member of flight crew – the person belonging to aviation personnel, having the existing certificate of aviation personnel to whom the obligations connected with management of the aircraft during flight time are assigned.

3. The authorized organization issues the following types of certificates of aviation personnel:

1) for members of flight crew:

the certificate of the private pilot of PPL (the airplane, the helicopter, the airship, the aircraft with system of increase in carrying power);

the certificate of the pilot of commercial aircraft of CPL (the airplane, the helicopter, the airship, the aircraft with system of increase in carrying power);

certificate of the pilot of polynomial crew (airplane) of MPL;

the certificate of the linear pilot of ATPL (the airplane, the helicopter, the aircraft with system of increase in carrying power);

certificate of the pilot of free aerostat of FBPL;

certificate of the pilot of glider of GPL;

2) for the members of flight crew other than pilots:

certificate of the navigator of FNL;
