About approval of the Regulations on procedure for lease and payment of leased premises in the State Border Service of Ukraine

For the purpose of enhancement of procedure for lease and payment of leased living space by the military personnel according to the Law of Ukraine "About social and legal protection of the military personnel and members of their families" and the resolution of the Cabinet of Ministers of Ukraine of 03.08.2006 of N1081 "About Approval of the Procedure for Providing the Military Personnel and Members of Their Families by Premises" I ORDER:

1. Approve Regulations on procedure for lease and payment of leased premises in the State Border Service of Ukraine it (is applied).

2. To chiefs of bodies of the State Border Service of Ukraine to bring into accord with requirements of the current legislation and this Provision procedure for provision of leased premises for temporary residence of the military personnel and members of their families in a month.

3. To impose control over the implementation of this order on the vice-chairman of the State Border Service Ukrainydirektor Departament of providing and the head of finance and economy of Administration of the State Border Service of Ukraine.

4. N341 "About Approval of the Regulations on Procedure for Lease and Payment of Rent Living Space in Border Troops of Ukraine" registered in the Ministry of Justice of Ukraine on September 2, 1996 for N492/1517, to consider the order of the State committee on cases of protection of frontier of Ukraine of July 25, 1996 invalid.

5. Distribute the order according to mailing calculation.

Regulations on procedure for lease and payment of leased premises in the State Border Service of Ukraine

1. General provisions

1.1. This Provision determines procedure for lease by bodies of the State Border Service of Ukraine (further - body of State frontier service) premises of all patterns of ownership for temporary residence in them of the military personnel and members of their families (further the military personnel), and also procedure for their payment.

1.2. In case of absence in body of State frontier service of office housing stock such body of State frontier service shall lease for accommodation of the military personnel and members of their families housing within the regulations established by the legislation.

2. Procedure for lease of premises, their payment and accounting

2.1. Lease of premises for accommodation of the military personnel and members of their families is performed by body of State frontier service based on the agreement which is drawn up according to requirements of the current legislation.

2.2. Lease agreements of premises are signed between body of State frontier service in which the serviceman, and the owner of housing serves.

2.3. Lease agreements of the premises which are in private property of physical persons are subject to registration in the housing and operational organizations (ZhEK, KEU, DU, etc.) and if such premises are located in the rural zone, in local government bodies.

2.4. The amount of the rent for use of premises which are in the state-owned or utility property is determined with the consent of the parties, proceeding from the cost of leased living space and actual expenses on its content.

The amount of household and other expenses is determined by the rates established for the population of the respective area. The approximate list of expenses which are included the rent is given in appendix 1 to this Provision.

2.5. If the lessee is physical person, the amount of the rent is determined in the lease agreement of premises. At the same time the amount of the rent specified in the lease agreement of premises cannot be less minimum amount of lease payment for complete or incomplete month. The minimum amount of lease payment is determined by the technique established by the Cabinet of Ministers of Ukraine proceeding from minimal cost of lease of one square meter of total area of the real estate, taking into account the place of its arrangement, other functional and qualitative indexes which are established by local government bodies of the village, settlement, city in the territory of which the premises are located.

2.6. Payment of cost of lease of premises is performed on clearing settlement at the expense of code of economic qualification 1343 (lease of premises) in sizes and in the terms stipulated by the lease agreement.

2.7. Reception-transmission of leased premises is performed by bodies of State frontier service for the act of acceptance transfer of leased premises (appendix 2 to this Provision) according to the signed lease agreement.

2.8. Room and operational divisions of bodies of State frontier service are responsible for the conclusion of lease agreements of premises, accomplishment of their conditions by the parties, accounting of leased premises.

Accounting of leased premises is performed in the Book of accounting of leased premises (appendix 3 to this Provision).

2.9. From the military personnel of means for accommodation in leased premises and provision of housing and communal services room and operational divisions of bodies of State frontier service, and for implementation of lease payments under agreements arendyfinansovo-economic divisions of bodies of State frontier service are responsible for implementation of calculations for deduction.

3. Procedure for provision in the sublease the serviceman of living space and its payment

3.1. The body of State frontier service leases premises and presents him in the sublease to the serviceman with the obligatory conclusion of the contract of the sublease of these premises with it and creation of the delivery-acceptance certificate of leased premises which is signed by representatives of the lessor, body of State frontier service and the tenant.

3.2. Leased premises are provided in the sublease to the military personnel who is registered in the location of body of State frontier service. The specified rooms are provided without observance of priority and privileges established for providing citizens with housing.

3.3. Leased premises are provided to the military personnel in the sublease in limits of 13,65 of square meter of living space on one person.

3.4. For receipt of premises the serviceman submits the official report to the sublease on command.

Are applied to the official report:

the reference from the residence on registration and family composition (F-3);

excerpt from the personal record of the serviceman about family composition;

the copy of the certificate of delivery of living space from the previous duty station.

3.5. In case of the conclusion of the agreement of the sublease passports of all adult family members to which housing, with mark about removal from registration at the previous place of residence and registration on the duty station is provided are shown.

3.6. Military personnel and members of their families who live in leased premises shall:

comply with terms of the contract of the sublease of premises and the instruction for use them, contents of the apartment house and the house adjoining territory;

monthly timely to bring payment for utilities (water supply, gas, electrical, heat energy and other services) at the rates and rates approved in accordance with the established procedure.

3.7. The military personnel who did not lease housing on the previous duty station resolve the housing issue independently.

In exceptional cases, if members of the family of the serviceman remained to live on the previous duty station, such serviceman can receive leased housing in the sublease (bed place in the hostel) only on himself.

3.8. In case of the movement of the military personnel on service connected with moving to other area, disposals for accomplishment of service duties abroad, dismissals from military service, leased premises which they occupied on the previous duty station are subject to release from the date of the publication of the order on exception of lists of staff of body of State frontier service in a month.

3.9. The serviceman and members of his family immediately exempt the leased premises occupied by them in case of receipt of office (permanent) housing or acquisition of housing for permanent residence.

3.10. In case of release of the leased housing room the military personnel shall hand over it under the delivery-acceptance certificate of leased premises to body of State frontier service.
