About modification of some regulatory legal acts of the National Bank of Ukraine concerning regulation of activities of banks and banking groups

According to Articles 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 9, of 30, of 33, of 35, of 39, of 44, of 50, of 66, 67 Laws of Ukraine "About banks and banking activity", Articles 2, of 33, of 34, of 36, of 39, of 43, of 46, of 64, of 69, 75 Laws of Ukraine "About ministerial procedure", the Law of Ukraine of October 10, 2024 No. 4017-IX "About modification of some legal acts of Ukraine in connection with adoption of law of Ukraine "About ministerial procedure"", for the purpose of harmonization of procedures of the National Bank of Ukraine concerning regulation of activities of banks and banking groups with the general principles of the administrative right, increase in transparency and efficiency of accomplishment of functions of public administration of Board of the National Bank of Ukraine by the National Bank of Ukraine decides:

1. Approve Changes in:

1) the Instruction about procedure for regulation of activities of banks in Ukraine approved by the resolution of Board of the National Bank of Ukraine of August 28, 2001 No. 368, of Ukraine registered in the Ministry of Justice on September 26, 2001 at No. 841/6032 (with changes) (further – the Instruction No. 368) which is attached;

2) Regulations on procedure for identification and the recognition of banking groups approved by the resolution of Board of the National Bank of Ukraine of April 09, 2012 No. 134, registered in the Ministry of Justice of Ukraine on April 28, 2012 at No. 708/21021 (with changes) (further – No. Provisions 134) which are applied;

3) Regulations on procedure for the regulation of activities of banking groups approved by the resolution of Board of the National Bank of Ukraine of June 20, 2012 No. 254, registered in the Ministry of Justice of Ukraine on July 12, 2012 at No. 1178/21490 (with changes) (further – No. Provision 254) which are applied.

2. In the subitem 2 of Item 6 of the Section I of the Regulations on determination by banks of Ukraine of the extent of the credit risk on active banking activities approved by the resolution of Board of the National Bank of Ukraine of June 30, 2016 No. 351 (with changes), the word of "requirements" shall be replaced with words also in figures "subitems 3-6, 10 of Item 30 of Chapter 7, of subitems 1, 2 Items 65 of Chapter 11 of the Section II, subitems 1, 2 Items 75 of Chapter 13 of the Section III".

3. Approve Changes in Regulations on procedure for determination by banks of Ukraine for the size of the regulatory capital approved by the resolution of Board of the National Bank of Ukraine of December 28, 2023 No. 196 (with changes) (further – No. Provisions 196) which are applied.

4. Bring in Regulations on procedure of payments banks of Ukraine and banking groups value of coefficient of the leverage approved by the resolution of Board of the National Bank of Ukraine of July 19, 2024 No. 89, such changes:

1) in the Section I:

in paragraph one of Item 6 of the word "in hryvnia / hryvnia equivalent on the official rate of hryvnia to each of foreign currencies established by National Bank for settlement date" to exclude;

the fourth Item 7 to add the paragraph with the words "in hryvnia / hryvnia equivalent on the official rate of hryvnia to each of foreign currencies, the established National Bank for settlement date";

the fifth the subitem 1 of Item 10 to exclude the paragraph.

With respect thereto to consider paragraphs of the sixth, seventh respectively paragraphs the fifth, sixth;

5. Administrative productions which on the date of entry into force of this resolution are under consideration of the National Bank of Ukraine come to the end according to requirements of the Instruction No. 368, No. Provision 134, No. Provision 254, No. Provision 196, taking into account the changes approved by this resolution.

6. The National Bank of Ukraine performs consideration of the applications, the petitions, documents received till December 31, 2024 and on which as of January 01, 2025 the decision, according to the Instruction No. 368, No. Provision 134, No. Provision 254, the Provision No. 196 taking into account the terms determined by the legislation of Ukraine existing till December 31, 2024 from the beginning of their counting since January 1, 2025 is not made.

7. To department of methodology of regulation of activities of banks (Oksana Prisyazhenko) after official publication to inform banks of Ukraine information on adoption of this resolution.

8. The resolution becomes effective since January 1, 2025.
