1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 16, 2015 No. 220 "About approval of the Instruction on the organization of activities of divisions of the investigation, inquiry and military investigating bodies, law-enforcement bodies of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 10761):

state heading in the following edition:

"About approval of the Instruction on the organization of activities and to implementation of procedural control of work of staff of divisions of the investigation and inquiry of law-enforcement bodies of the Republic of Kazakhstan";

state Item 1 in the following edition:

"1. Approve the enclosed Instruction on the organization of activities and implementation of procedural control of work of staff of divisions of the investigation and inquiry of law-enforcement bodies of the Republic of Kazakhstan";

To be reworded as follows the instruction on the organization of activities of divisions of the investigation, inquiry and military investigating bodies, law-enforcement bodies of the Republic of Kazakhstan approved by the specified order according to appendix to this order.

2. To provide to investigative department of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) within five working days from the date of signing of this order the direction its in electronic form in the Kazakh and Russian languages in the republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) the direction in Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan data on execution of the action provided by the subitem 1) of this Item.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan police major general Adilova S.A. and Investigative department of the Ministry of Internal Affairs of the Republic of Kazakhstan (Kozhayev M. Zh.).

4. This order becomes effective from the date of its signing.

Instruction on the organization of activities and implementation of procedural control of work of staff of divisions of the investigation and inquiry of law-enforcement bodies of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Instruction is developed according to the Criminal Code of Kazakhstan (further - UK), the Code of penal procedure of the Republic of Kazakhstan (further - the Code of Criminal Procedure), the Law of the Republic of Kazakhstan "About law-enforcement bodies of the Republic of Kazakhstan" (further - the Law), other regulatory legal acts and establishes procedure for the organization of activities and procedural control of divisions of the investigation and inquiry of law-enforcement bodies.

2. For the purposes of this Instruction the following main terms and their determinations are applied:

1) procedural control - system of the measures directed to effective implementation of tasks of criminal procedure in case of pre-judicial investigation;

2) technique - certain area of the systematized knowledge resolving issues of providing the organization of pre-judicial investigation by development and implementation of the most optimum and effective recommendations;

3) methodical providing - management process of selection, accumulation, transfer and preserving valuable professional information in the field of pre-judicial investigation by means of which use of progressive ideas, recommendations, innovative the practician and techniques in office activities of divisions of the investigation and inquiry is provided;

4) methodical recommendations and information letters - the documents of methodical nature of interdepartmental or interdepartmental use prepared by results of generalization of investigative and court practice, studying of separate criminal cases or questions of law-enforcement practice;

5) the best practices - positive experience of investigative work which generalization and distribution is performed for the purpose of increase in professional level and overall performance of the investigator, the investigator (division), the solution of the tasks set for it and the arising problems, remedial action in activities of the investigative device and increase in its role in fight against crime.

6) the investigative office of law-enforcement bodies - system of investigative divisions: Investigative department (further - SD) in central office of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs) and in territorial authorities of internal affairs - investigation departments, departments, departments, groups;

7) regular inquiry - Management of the organization of work of inquiry of SD Ministry of Internal Affairs in central office, managements (departments, departments, groups) inquiries in territorial authorities of police.
