About modification of some regulatory legal acts of the Republic of Kazakhstan in the field of geology

I ORDER:

1. Approve the enclosed list of some orders to which changes are made.

2. To provide to committee of geology of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

The list of some orders to which changes are made

1. Bring in the order of the Acting Minister of ecology, geology and natural resources of the Republic of Kazakhstan of May 22, 2020 No. 117 "About approval of Rules of rendering the state services in the field of geology and use of water resources" (it is registered in the Register of state registration of regulatory legal acts for No. 20723) the following changes:

1) in the Rules of rendering the state service "Approval of the Water Preserving Actions Directed to Prevention of Water Objects from Depletion" approved by the specified order:

and 5 to state items 4 in the following edition:

"4. For receipt of the state service uslugopoluchatel direct to the service provider the application for approval of the water preserving actions directed to prevention of water objects from depletion (further – the statement) by means of object of informatization information system of single platform of subsurface use (further – EPN) in electronic form in form, according to appendix 1 to these rules.

The list of the main requirements to rendering the state service including form and result of rendering the state service are stated in the list of the main requirements to rendering the state service (further – the List of requirements) according to appendix 2 to these rules.

The service provider receives data on identity documents, on state registration (re-registration) of the legal entity from the corresponding information systems through lock of "the electronic government".

In case of filing of application the uslugopoluchatel agrees to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

When giving by uslugopoluchatel of all necessary documents by means of object of informatization information system EPN - in "personal account" of uslugopoluchatel is displayed the status with indication of unique accounting number, date and time of registration of a statement and specifying of the date of receipt of result of the state service.

5. The employee of responsible division within 7 (seven) working days from the moment of receipt of the statement considers the submitted documents regarding compliance to requirements of these rules and creates the conclusion in form, according to appendix 3 to these rules, or motivated refusal in rendering the state service.

In EPN the result of rendering the state service goes and kept in "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.";

"8. Data on stage of rendering the state service are automatically transferred from EPN to information system of monitoring of rendering the state services, according to the subitem 11) of Item 2 of article 5 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law).

9. The service provider within three working days from approval date or change of these rules sends information on the made changes and (or) additions to Single contact center.";

The list of the main requirements to rendering the state service including form and result of rendering the state service is stated in the list of the main requirements to rendering the state service (further – the List of requirements) according to appendix 2 to these rules.

The service provider receives data on identity documents, on state registration (re-registration) of the legal entity from the corresponding information systems through lock of "the electronic government".

State item 4 in the following edition:

"4. For receipt of the state service uslugopoluchatel submit to the service provider the application for licensing for export of information on subsoil on areas and fields of fuel and energy and mineral raw materials (further – the statement) by means of object of informatization information system EPN in electronic form in form, according to appendix 1 to these rules.

In case of filing of application the uslugopoluchatel agrees to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

Data on identity documents of physical persons, on state registration (re-registration) of the legal entity, on the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, the service provider receives from the corresponding state information systems through lock of "the electronic government".

When giving by uslugopoluchatel of all necessary documents by means of object of informatization information system EPN – is made automatic registration of a statement and in "personal account" of uslugopoluchatel the status with indication of unique accounting number, date and time of registration of a statement and specifying of the date of receipt of result of the state service is displayed.

The list of the main requirements to rendering the state service including form and result of rendering the state service is stated in the list of the main requirements to rendering the state service (further – the List) according to appendix 2 to these rules.";

State Items 6 and 7 in the following edition:

"6. Registration number is assigned automatically in EPN after filling of all fields, loading of documents and departure of the request with uslugopoluchatel in day of departure of the request.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the Labor code of the Republic of Kazakhstan, the registration document number is assigned the next working afternoon.

The executive in charge within 8 (eight) working days from the moment of registration of a statement and receipt of documents from uslugopoluchatel, the service provider checks them for compliance to requirements of these rules.

In case of establishment of incompleteness of the submitted documents and (or) documents with the expired effective period, the worker of the service provider prepares the motivated answer about refusal in further review of the statement.

The motivated refusal in further review of the statement signed by the digital signature (further - the EDS) the head of the service provider, goes to the applicant in electronic form.

In case of provision by uslugopoluchatel of complete document package and (or) data the worker of the service provider checks them for compliance to requirements of these rules, and grants the export license of information on subsoil on areas and fields of fuel and energy and mineral raw materials and (or) appendix to it, or the motivated answer within 3 days about refusal in rendering the state service in cases and on the bases, stipulated in Item 9 Lists of the main requirements to rendering the state service

The result of rendering the state service goes to "personal account" in electronic form, the authorized person of the service provider signed by the EDS.

7. After provision by uslugopoluchatel of document package and (or) data the worker of the service provider within 8 (eight) working days checks them for compliance to requirements of these rules, and grants the export license of information on subsoil on areas and fields of fuel and energy and mineral raw materials and (or) appendix to it, or the motivated answer about refusal in rendering the state service in cases and on the bases, stipulated in Item 9 Lists of requirements.";

4) in Rules of rendering the state service "Licensing for Use of Space of Subsoil"

4, of 5, 6 and 7 to state Items in the following editions:

"4. For receipt of the state service uslugopoluchatel submit to the service provider the application for licensing for use of space of subsoil (further – the statement) by means of object of informatization information system EPN in electronic form in form according to appendix 1 to these rules.

According to Item 5 of article 251 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further – the Code) the statement and documents attached to it shall be constituted in the Kazakh and Russian languages.

The main requirements to rendering the state service, including form and result of rendering the state service are stated in the list of the main requirements to rendering the state service (further – the List of requirements) according to appendix 2 to these rules.
