About modification of Rules of crossing of frontier by citizens of Ukraine

The Cabinet of Ministers of Ukraine decides:

Bring in the Rules of crossing of frontier by citizens of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of January 27, 1995 No. 57 (ZP of Ukraine, 1995, No. 4, Art. 92; Official Bulletin of Ukraine, 2010, No. 65, Art. 2239; 2025, No. 8, the Art. 676) changes which are applied.

Changes which are made to Rules of crossing of frontier by citizens of Ukraine

Add Rules with Items 2-21 and 2-22 of the following content:

"2-21. In case of introduction in the territory of Ukraine of warlike situation the omission through frontier of citizens of male Ukraine aged from 18 up to 60 years for the purpose of implementation of activities in the field of culture consisting in employment relationships with organizations, the companies, organizations, the organizations of the sphere of culture (further - cultural institutions), the organizations of formation of the sphere of culture, the companies, organizations, the organizations performing activities in the field of cinematography (further - subjects of cinematography) which are in accordance with the established procedure determined crucial for functioning of economy and ensuring life activity of the population during the special period according to the resolution of the Cabinet of Ministers of Ukraine of January 27, 2023 No. 76 "some questions of realization of provisions of the Law of Ukraine "On mobilization preparation and mobilization" concerning booking of persons liable for call-up for mobilization and on wartime" (The Official Bulletin of Ukraine, 2023, No. 15, Art. 940), or are physical persons - the entrepreneurs performing independent professional activity in the field of culture or professional cinema activity is performed by authorized officers of State frontier service on condition of accomplishment of rules of crossing of frontier and availability at them supporting documents.

Supporting documents for crossing of frontier on departure by persons specified in paragraph one of this Item are:

the letter of MKSK to Administration of State frontier service concerning participation of such persons in action with indication of the planned date of crossing of frontier on departure, approximate date of return to Ukraine, the name of the check point through which crossing of frontier is planned for departure, and also vehicle type;

the invitation of the foreign organization for participation of such persons in action with transfer into Ukrainian;

the military and accounting document with the corresponding marks district (the integrated district), city (district in the cities, the integrated city) the territorial center of completing and social support or the military and accounting document electronically.

The letter specified in paragraph three of this Item signed by the head, and in case of its absence - person which is carrying out its obligations is provided to MKSK based on the address of Gosiskusstv, the Ukrainian institute of national memory, State cinema or regional, Kiev city military authorities with recommendations concerning feasibility of participation of persons specified in paragraph one of this Item.

The address specified in paragraph six of this Item is provided:

The Ukrainian institute of national memory - in case of crossing of frontier on departure to the faces consisting in employment relationships with the cultural institution belonging to the sphere of management of MKSK which performs activities in the field of museum case;

State arts - in case of crossing of frontier on departure to the faces consisting in employment relationships with the cultural institution belonging to the sphere of management of MKSK which performs activities in spheres of arts, specialized art education or library science;

State cinema-in case of crossing of frontier on departure to the faces consisting in employment relationships with subjects of cinematography and involved in creation and production of movies, or to the physical persons entrepreneurs performing professional cinema activity and participating in the international art actions brought in the work plan of State cinema;

regional, Kiev city military authorities - in case of crossing of frontier on departure to the faces consisting in the employment relationships with cultural institution or organization of formation of the sphere of culture relating to utility property of the corresponding territorial community and also to the legal entities or physical persons entrepreneurs performing independent professional activity in the field of culture on registration address or the registered/declared residence (stay).

The cultural institution belonging to the sphere of management of MKSK performing activities in the field of protection of cultural heritage in case of crossing of frontier on departure by persons who are with it in employment relationships and also physical persons - the entrepreneurs who are performing independent professional activity in the field of culture and leaving for the purpose of participation in the international art actions brought in the work plan MKSK or the Ukrainian institute of the book for receipt of the letter specified in paragraph three of this Item address directly MKSK.

The letter specified in paragraphs the eighth or twelfth this Item is provided on the basis:

the address with imposing of the digital signature of cultural institution and organization of formation of the sphere of culture, the subject of cinematography, the physical person - the entrepreneur performing independent professional activity in the field of culture, directed to the e-mail address or means of information and communication systems with indication of date, type of the vehicle and the check point through frontier on departure, approximate date of return to Ukraine, and also surname, name, middle name (in the presence), birth dates, series and passport numbers of the citizen of Ukraine for trip abroad of persons planning to participate in the international actions;

order of cultural institution, organization of formation of the sphere of culture or subject of cinematography on business trip of workers abroad;

the documents confirming the employment or civil relations between physical person and cultural institution, organization of formation of the sphere of culture or the subject of cinematography;

the written with own hand personal obligation of each person concerning awareness of responsibility to the Ukrainian people in wartime and obligations to return to Ukraine in the specified terms;

copies of the first and second pages of the passport of the citizen of Ukraine in the form of book or the copy of front and reverse side of the passport of the citizen of Ukraine in the form of card;

copies of the first page of the passport of the citizen of Ukraine for trip abroad;

the invitation of the foreign organization with transfer into Ukrainian with indication of stay conditions abroad employees of cultural institution, educational institution of the sphere of culture or the subject of cinematography, or the physical person - the entrepreneur performing independent professional activity in the field of culture, and also the documents containing the description of action in which it is planned to take part (purpose of visit references to public announcements of holding actions (resource selling tickets for action, the announcement about holding action on special platforms and on pages on social networks, etc.), motivation and the expected result from participation in action, financial conditions of stay abroad, country name and settlements in which according to the program of trip events, names of actions, places and dates of their carrying out, contact information of person coordinator of trip, the agreement (contract) for participation in action will be held).

The physical persons entrepreneurs performing independent professional activity in the field of culture in addition provide the extract from the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming, and also the materials confirming implementation of such activities within the last three years.

Also the copy of the processed properly military and accounting document (for persons liable for call-up - the military ID or the temporary certificate of the person liable for call-up, for recruits certificates about addition is attached to draft sites) with the corresponding marks district (integrated district), city (district in the cities, integrated city) the territorial center of completing and social support or the military and accounting document electronically generated not later than day before submission of the address.

Cultural institutions, educational institutions of the sphere of culture, subjects of cinematography also provide the decision on determination of the company, organization, organization crucial for functioning of economy and ensuring life activity of the population during the special period, certified properly.

If technically possible documents (data) specified in paragraphs the sixteenth, the eighteenth, the nineteenth, twenty first, twenty second this Item, which are available in the state electronic information resources turn out according to the procedure of electronic information exchange.

Documents are filed on the e-mail address or means of information and communication systems to MKSK not later than 10 working days before date of crossing of frontier on departure, in the Ukrainian institute of national memory, Gosiskusstv, State cinema or regional, Kiev city military authorities - not later than 15 working days before date of crossing of frontier on departure.

Responsibility for accuracy of the information, specified in paragraphs the fourteenth - twenty third this Item, heads of cultural institutions, organizations of formation of the sphere of culture, subjects of cinematography, physical persons - the entrepreneurs performing independent professional activity in the field of culture or professional cinema activity bear.

The letter of MKSK is not provided in Administration of State frontier service in case of discrepancy of the submitted documents to the requirements determined by paragraphs the fourteenth - twenty third this Item, and also in case of identification among organizers of persons who are representatives of the state recognized by the Verkhovna Rada of Ukraine the state aggressor or the state invader or in case such participation provides cooperation with the purpose of creation of general cultural product.

The maximum term of stay abroad constitutes persons specified in paragraph one of this Item according to the letter of MKSK no more than 60 calendar days from the date of crossing of frontier. The term of continuous stay abroad can be increased up to 30 calendar days if such persons participate in other action which date begins within 10 working days from the date of completion of the approved sixty-day period of stay abroad.

Activities continuation approval abroad of persons specified in paragraph one of this Item is performed by MKSK according to the appeal of the Ukrainian institute of national memory, Gosiskusstv, State cinema or regional, Kiev city military authorities based on the documents specified in paragraphs the fourteenth - twenty third this Item.

MKSK the letter informs Administration of State frontier service, and also persons specified in paragraph one of this Item on participation in actions abroad or activities continuation approval abroad.

In case of non-confirmation of purpose of visit authorized officers of State frontier service refuse crossing of frontier to persons specified in the paragraph one of this Item, according to the procedure determined by part one of article 14 of the Law of Ukraine "About border control".

2-22. In case of introduction in the territory of Ukraine of warlike situation the omission through frontier of citizens of male Ukraine aged from 18 up to 60 years performing professional activity in the field of strategic communications, media and the information sphere is performed by authorized officers of State frontier service on condition of accomplishment of rules of crossing of frontier and availability at them supporting documents. If such persons are in employment relationships, the omission through frontier is performed if the company, organization, the organization is in accordance with the established procedure determined crucial for functioning of economy and ensuring life activity of the population during the special period according to the resolution of the Cabinet of Ministers of Ukraine of January 27, 2023 No. 76 "Some questions of realization of provisions of the Law of Ukraine "On mobilization preparation and mobilization" concerning booking of persons liable for call-up for mobilization and on wartime" (The Official Bulletin of Ukraine, 2023, No. 15, the Art. 940).

Supporting documents for crossing of frontier by persons specified in paragraph one of this Item are:

the letter of MKSK or Mintsifra to Administration of State frontier service concerning participation of such persons in action with indication of the planned date of crossing of frontier on departure, approximate date of return to Ukraine, type of the vehicle and the check point through which crossing of frontier is planned for departure;

the invitation of the foreign organization for participation of such persons in action with transfer into Ukrainian;

the passport of the citizen of Ukraine for trip abroad;

the military and accounting document with the corresponding marks district (the integrated district), city (district in the cities, the integrated city) the territorial center of completing and social support or the military and accounting document electronically.

The letter specified in paragraph three of this Item signed by the head, and in case of its absence - person which is carrying out its obligations is provided:

MKSK - in case of crossing of frontier on departure by persons consisting in employment relationships with the companies, organizations and the organizations:

the managements of MKSK belonging to the sphere;

Goskomteleradio's managements relating to the sphere and also concerning which Goskomteleradio directly performs functions on management of corporate laws of the state in the authorized capital, - based on Goskomteleradio's appeal to MKSK;

belonging to utility property of the corresponding territorial community, and also the legal entities or physical persons entrepreneurs performing activities in the field of strategic communications, media and the information sphere to the address of the registered/declared residence (stay) - based on the address regional, Kiev city military authorities in MKSK;

Mintsifra - in case of participation in the actions connected with ensuring functioning of the multimedia platform "UNITED 24" ("UNITED 24 MEDIA").

The letter of MKSK or Mintsifra, and also Goskomteleradio's address or regional, Kiev city military authorities to MKSK is provided on the basis:

the address of the legal entity or physical person - the entrepreneur with imposing of the digital signature directed to the e-mail address or means of information and communication systems with reasons for need of participation in the planned international actions directed to promoting and forming of positive image of Ukraine in world information resources and national information resource of foreign states that will promote protection of its political, economic and welfare interests, strengthening of national security and recovery of territorial integrity of Ukraine. In the address date, type of the vehicle and the check point through frontier on departure, approximate date of return to Ukraine, and also surname, name, middle name (in the presence), birth date, series and passport number of the citizen of Ukraine for trip abroad of persons who plan to participate in the international actions is specified;

the invitation of the foreign organization with transfer into Ukrainian and/or accreditations and/or descriptions of action in which it is planned to take part, with indication of stay conditions abroad of the citizen of Ukraine;

editorial task and/or the order for business trip from principle place of employment;

the written with own hand personal obligation of each person concerning awareness of responsibility to the Ukrainian people in wartime and obligations to return to Ukraine in the specified terms;

copies of the first page of the passport of the citizen of Ukraine for trip abroad;

copies of the first and second pages of the passport of the citizen of Ukraine in the form of book or the copy of front and reverse side of the passport of the citizen of Ukraine in the form of card;

the documents confirming the employment, economic or civil relations with appropriate subject in the field of strategic communications, media and/or the information sphere. In case of stay in employment relationships the decision on determination of the company, organization, organization crucial for functioning of economy and ensuring life activity of the population during the special period or crucial for ensuring needs of Armed Forces, other military forming during the special period, certified properly is also provided;

extracts from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming with indication of the main business activity in the field of strategic communications, media and the information sphere, and also the materials confirming carrying out such activities for the last three years (for physical persons - entrepreneurs);

military and accounting documents (for persons liable for call-up - the military ID, the military and accounting document, the temporary certificate of the person liable for call-up, and for recruits - the certificate of addition to draft sites) with the corresponding marks district (integrated district), city (district in the cities, integrated city) the territorial center of completing and social support or the military and accounting document electronically;

the statement from the Unified state register of recruits, persons liable for call-up and reservists.

If technically possible documents (data) specified in paragraphs the eighteenth - twenty third this Item, available in the state electronic information resources, turn out according to the procedure of electronic information exchange.

Documents are filed on the e-mail address or means of information and communication systems to MKSK or Mintsifra not later than 10 working days before date of crossing of frontier on departure, to Goskomteleradio or regional, Kiev city military authorities - not later than 15 working days before date of crossing of frontier on departure.

The letter of MKSK or Mintsifra is not provided in State frontier service in case of discrepancy of the submitted documents to the requirements determined by paragraphs the fourteenth - twenty third this Item, and also in case of identification among organizers of persons who are representatives of the state recognized by the Verkhovna Rada of Ukraine the state aggressor or the state invader or in case such participation provides cooperation with the purpose of creation or production of joint product.

Persons specified in paragraph one of this Item can be continuously abroad to the term specified in the letter of MKSK or Mintsifra. The maximum term of temporary stay of citizens of Ukraine abroad according to letters of MKSK or Mintsifra constitutes no more than 60 calendar days from the date of crossing of frontier. The term of continuous stay abroad can be increased up to 30 calendar days only in the cases connected with force majeur circumstances or with holding the international events, sign for Ukraine.

MKSK or Mintsifra the letter informs State frontier service, and also persons specified in paragraph one of this Item on participation in actions abroad or approval of prolongation of continuous stay abroad.

In case of non-confirmation of purpose of visit authorized officers of State frontier service refuse crossing of frontier to persons specified in the paragraph one of this Item, according to the procedure determined by part one of article 14 of the Law of Ukraine "About border control".".
