About approval of Rules of crossing of frontier by citizens of Ukraine

According to article 3 of the Law of Ukraine "About procedure for departure from Ukraine and entry into Ukraine of citizens of Ukraine" the Cabinet of Ministers of Ukraine decides:

Approve Rules of crossing of frontier as citizens of Ukraine (are applied).

Rules of crossing of frontier by citizens of Ukraine

1. These  rules determine   procedure  and conditions of crossing by citizens of Ukraine of frontier.         

2. Crossing by citizens  of Ukraine  (further  -  citizens) frontier is performed at  check points through frontier and  control Items (further -  check points) if another is not provided by the law, on one of such documents granting the right to departure from Ukraine and entry into Ukraine:         

1) the passport of the citizen of Ukraine for trip abroad;         

2) diplomatic passport;         

3) service passport;

4) the travel document of the child (it is valid during the term for which it is issued);

5) identity certificate of the seaman;

6) certificate of the crew member.

In case when the citizen who is constantly living in Ukraine lost the specified documents (further - passport documents) outside Ukraine or if effective period  of such  documents ended during stay of the citizen  outside Ukraine, or is determined that they are invalid for other reasons, the document granting the right to entry into Ukraine is the identity certificate on return to Ukraine which is issued by diplomatic representation or consular establishment of Ukraine abroad.

In                  the cases provided by international treaties or the legislation of Ukraine  crossing   by the citizen of frontier is performed also according to other documents. In that case border control is exercised  according to the procedure which is applied during provision by the citizen of passport documents.

In the cases determined by the legislation for crossing of frontier citizens except passport  documents shall have also supporting documents.

2-1. In case of introduction in the territory of Ukraine of emergency or warlike situation have the right to cross frontier:

persons with disability in the presence the certificate confirming the corresponding status, or the pension certificate or the certificate confirming purpose of the public assistance according to the Laws of Ukraine "About the government public assistance to persons with disability since the childhood and to children with disability", "About the government public assistance to persons who do not have pension entitlements and to persons with disability" in which the group and the reason of disability, or the reference for receipt of privileges by persons with disability who have no pension entitlements or the public assistance is specified in the form approved by Minsotspolitiki (further - the documents confirming disability);

persons who have the wife (husband) from among persons with disability and accompanying such the wife (husband) for departure out of limits of Ukraine, in the presence of documents (their notarized copies) confirming family relations, disability;

persons who have one of the parents or parents of the wife (husband) from among persons with disability of I or II groups and attendants of one of such parents for departure out of limits of Ukraine, in the presence of documents (their notarized copies) confirming family relations, disability and also the documents confirming cohabitation (their declared or registered residence (stay) matches with the declared or registered place of residence (stay) of their parents or parents of the wife (husband), or implementation of care of the parents or parents of the wife (husband) that is confirmed by the act of factual determination of implementation of care of one of the parents or parents of the wife (husband), or documents (the certificate, the reference) about receipt of compensation (benefit, the allowance) for leaving. The statement of factual determination of implementation of leaving is drawn up based on the address of person with disability of I or II groups or person performing leaving in district, district in Kiev and Sevastopol the state administrations, executive body of village, settlement, city council with the statement for implementation-faced such leaving. If the face with disability of I or II groups is the registered internally displaced person, the address with the statement for implementation of leaving moves in place of registration of the actual residence of such internally displaced person. Based on such address of person with disability of I or II groups or person performing leaving, district, district in Kiev and Sevastopol the state administration, executive body of village, settlement, city council no later than within five working days after receipt of the statement the statement of factual determination of implementation of leaving in any form is drawn up. The specified act goes to the applicant or is issued personally at his desire;

persons performing permanent care of persons with disability of I or II groups also accompany such persons for departure out of limits of Ukraine, in the presence of documents (the certificate, the reference) about receipt of compensation (benefit, the allowance) on leaving or the documents confirming disability and the act of factual determination of implementation of leaving. The act of factual determination of implementation of face care with disability of I or II groups is constituted based on the address of person with disability of I or II groups or person performing leaving in district, district in Kiev and Sevastopol the state administration, executive body of village, settlement, city council with the statement for implementation-faced such leaving. If the face with disability of I or II groups is the registered internally displaced person, the address with the statement for implementation of leaving moves in place of registration of the actual residence of such internally displaced person. parents, guardians, custodians, adoptive parents, parents tutors who bring up the child with disability aged to 18 years in the presence of the certificate of birth of the child or documents confirming appropriate authority of person accompanying the child with disability (in case of implementation of maintenance by the guardian, custodian, one or both adoptive parents, parents tutors), the certificate confirming purpose of the public assistance according to the Law of Ukraine "About the government public assistance to persons with disability since the childhood and to children with disability" in which the status "the child with disability", or certificates of receipt of the government public assistance to children with the disability issued by structural division concerning social protection of the population of the district, district state administration in Kiev, executive body of city council is specified which territory of territorial community includes the territory of the city of regional value, district in the city (in case of its creation) council (irrespective of who is appointed the receiver of benefit), or the individual program of rehabilitation of the child with the disability issued by the medical and advisory commission of healthcare institution, or the medical certificate about the child with disability to 18 years (their notarized copies);

parents on whose content there is full age child who is person with disability of I or II groups, in the presence of the certificate on its birth and documents confirming disability (their notarized copies);

grandmothers, grandfathers, full age brothers, sisters, stepmothers, stepfathers who accompany children with disability for departure out of limits of Ukraine, in case of their belonging to category of the persons which are not subject to conscription during mobilization, in the presence at them the relevant supporting documents and documents, confirming family relations (their notarized copies);
