About approval of the Procedure for training and carrying out certification of the agent of real estate firm

For the purpose of implementation of subitem 1 of article 3 of the Law of the Kyrgyz Republic "About realtor activities in the Kyrgyz Republic", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure for training and carrying out certification of the agent of real estate firm according to appendix.

2. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of the Ministry of Economy and Trade of the Kyrgyz Republic" of November 15, 2021 No. 250 the following changes:

in Regulations on the Ministry of Economy and Trade of the Kyrgyz Republic approved by the above-stated resolution:

- to add the subitem 1 of Item 1 with the paragraph of the following content:

"-realtor activities;";

- add Item 11 with the subitem 11 of the following content:

"11) development and realization of state policy in the field of realtor activities.".

3. Recommend to Chamber of Commerce and Industry of the Kyrgyz Republic to act as responsible body for carrying out training and certification of agents of real estate firm according to the Procedure approved by this resolution.

4. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

Procedure for training and carrying out certification of the agent of real estate firm

Chapter 1. General provisions

1. The procedure for training and carrying out certification of the agent of real estate firm (further - the Procedure) determines the procedure of the training and carrying out certification of the physical person working at the real estate market in the Kyrgyz Republic, applying for the right of receipt of the certificate of the agent of real estate firm.

2. The basic concepts used in this Procedure:

1) the applicant - the physical person who submitted the application for passing of certification according to this Procedure;

2) certification - the procedure of confirmation of professional knowledge and skills of the applicant for provision of services in the real estate market;

3) the certificate - the documentary evidence confirming qualification of the applicant on provision of realtor services;

4) responsible body - the body providing the procedure of training and certification of the agent of real estate firm;

5) certifying commission - the body formed by responsible body for carrying out certification of the applicant for issue of the certificate of the agent of real estate firm;

6) authorized state body - the state body enabling development and the realization of state policy in the field of realtor activities.

Chapter 2. Training on the agent of real estate firm

3. Training on the agent of real estate firm is made by responsible body by the organization of rates in the field of realtor activities.

4. Training shall include:

1) studying of the legislation of the Kyrgyz Republic regulating the questions connected with implementation of purchase and sale, real estate lease;

2) procedure of real estate transactions;

3) technology of sales, marketing;

4) methodology of market research of the real estate and its monitoring;

5) determination of market value of real estate units (real estate appraisal);

6) immersion in the realtor's profession, regulation of documents, the organization of the transaction, the taxation in the field of implementation of real estate transactions;

7) bases of construction and architecture.

5. Training is performed in online and offline formats on paid basis. The amount of payment for training is established by responsible body in coordination with authorized state body.

6. Training is provided according to educational and thematic plans, programs of responsible body.

Chapter 3. Basic principles, purposes, certification tasks

7. The basic principles of certification are: systemacity, transparency, objectivity, inadmissibility of discrimination, effectiveness of certification and legality.

8. The purposes of certification are confirmation of professional qualification of the agent of real estate firm, stimulation of increase in level of knowledge on implementation of realtor activities in the Kyrgyz Republic.

9. Tasks of certification of the agent of real estate firm are:

1) establishment of compliance of professional competence;

2) determination of need for advanced training;

3) increase in efficiency and quality of the provided services in transactions and transactions in the real estate market;

4) increase in level of credibility to services of the agent of real estate firm;

5) increase in level of tolerance between agents.

Chapter 4. Certification implementation

10. Certification is carried out at the initiative of the applicant for confirmation of conformity of its professional qualification and receipt of the certificate of the agent of real estate firm.

11. Certification can be primary and confirming the operating qualification (recertification) of the agent of real estate firm. Certificate effective period five years.

12. Certification is carried out on paid basis at the expense of the applicant. The amount of payment for certification is established by responsible body in coordination with authorized state body.

13. Certification is carried out according to the program and the schedule approved by responsible body. The approved schedule includes: date, time and the venue of certification is also published on the official site of responsible body.

14. Document package for certification passing:

1) the statement according to appendix 1;

2) the copy of the certificate (diploma) about average general and/or average professional and/or higher education;

3) passport copy;

Chapter 5. Requirements to applicants

16. The applicant on passing of certification shall conform to the following requirements:

1) to have average general and/or average professional and/or higher education;

2) lack of criminal record or availability of the extinguished criminal record;

3) the reference from the center of psychiatry and narcology that does not stay on the registry.

Chapter 6. Organization of carrying out certification

17. The organization and carrying out certification are performed by responsible body according to the training program and certifications.

18. Information on carrying out certification is posted on the website of responsible body or in mass media.

19. For carrying out certification the certifying commission which structure affirms the decision of the head of responsible body for a period of one year is created.

20. The quantitative structure of certifying commission is established by odd number at least seven people.

21. In structure of certifying commission representatives of state bodies, educational institutions, without fail representatives of professional associations and associations in the field of realtor activities, notaries and representatives of other spheres connected with rendering realtor services are attracted.

22. Certifying commission in accordance with the established procedure:

1) develops test questions for certification;

2) is performed by procedure for holding qualification examinations (tests);

3) carries out certifications of applicants;

4) considers appeals, applications on re-examination;

5) makes the decision on issue or on refusal in issue of the certificate;

7) considers the matters of argument arising in the course of carrying out certification;

8) makes decisions on cancellation of the certificate (cancellation).

23. The solution of certifying commission can be appealed according to the civil legislation of the Kyrgyz Republic.

24. Solutions of certifying commission are drawn up by the protocol (appendix 2) and are signed by all members of certifying commission and the secretary.

25. Meetings of certifying commission are considered competent in the presence of at least two thirds of total number of its structure, decisions are made by a simple majority vote from number of attendees.

26. When carrying out certification presence of representatives of state bodies and other representatives of professional associations and associations is allowed.

27. Person which did not undergo certification is allowed to its repeated delivery not earlier than in 3 months.

28. Documents acceptance from applicants begins in two months prior to the established date of certification and stops in ten working days prior to certification.

29. Certification is carried out to two rounds:

1) the first round is held in the form of the testing consisting of theoretical questions for the purpose of objective and transparent assessment of the professional training level, and also determination of skill level and knowledge of provision of services in the field of the real estate. Testing is performed in the state or official languages;

2) the second round is held in the form of interview for the purpose of confirmation of knowledge, work experience and disclosure of potential of the applicant, readiness of the applicant to render realtor services.

30. The lowest passing score by results of testing makes at least 60% of affirmative answers.

31. The applicants who gained lowest passing score by results of the first round are invited to the second round.

32. The certifying commission determines success of passing an examination by the second round simple vote (by a majority vote).

33. Each member of certifying commission for the purpose of objective carrying out certification, and also establishment of professional and personal qualities of the applicant asks questions about subjects of the training program and estimates applicants (from 0 to 10 points inclusive).

34. According to the got final points (in case of receipt of 60% by the applicant and above from the total amount of points of two rounds) the certifying commission passes the decision on successful passing of certification.

35. By results of certification by responsible body the certificate of the agent of real estate firm is issued.

Chapter 7. Cancellation (cancellation) of the certificate

36. The certificate is terminated:

- after the term for which it is issued (in the presence of term);

- in case of death, recognition it is unknown absent, announcements the dead of the owner of the certificate;

- according to the solution of certifying commission.

37. The solution of certifying commission the certificate is terminated:

- based on the written notice of the owner of the certificate on decision making of the termination of rendering realtor services;

- if the owner of the certificate did not address for receipt of the certificate within six months from the date of decision making about its issue;

- in case of the nationality termination.

38. The certificate is cancelled based on the solution of certifying commission in cases:

- provisions by the applicant on receipt of the certificate of false information in the submitted application and documents attached to it;

- pronouncement of two and more preventions within 12 months in a row to the owner of the certificate for violation of the law regulating activities for rendering realtor services.

39. The certificate is considered cancelled and its action stops from the date of, specified in the solution of certifying commission.

40. The owner of the certificate is notified on the decision on cancellation (cancellation) of the certificate made by certifying commission in writing within three working days from the date of decision making.

Chapter 8. Register of agents of real estate firm

41. The register of the certified agents of real estate firm conducts responsible body.

42. Information on certification of agents of real estate firm has the right to receive any citizen of the Kyrgyz Republic, the citizen of foreign state, the stateless person according to the established responsible body rather.
