About approval of the technical regulation "Requirements to Coals and Products of Their Conversion"

1. Approve the enclosed technical regulation "Requirements to Coals and Products of Their Conversion".

2. To provide to committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) the direction of the electronic copy of this order in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after twelve months from the date of the first official publication.

Technical regulation "Requirements to Coals and Products of Their Conversion"

Chapter 1. Scope

1. This technical regulation "Requirements to Coals and Products of Their Conversion" (further – the technical regulation) is developed according to the subitem 1) of article 8 of the Law of the Republic of Kazakhstan "About technical regulation" and establishes requirements to coals and products of their conversion (further – products).

2. The technical regulation is developed for the purpose of ensuring protection of life and health of the person, property, environmental protection, the prevention of the actions misleading consumers concerning purpose of products and also for ensuring energy efficiency and resource-saving.

3. Objects of technical regulation in this technical regulation are:

1) coals and products of their sorting, enrichment and agglomerating:

coal ordinary, the coal nonenriched (sorted), coal the enriched (concentrate), промпродукт, slime, the fuel agglomerated;

2) products of thermochemical conversion of coals:

coke, semicoke, pitch coal, oil coal, fuel boiler coal, the coal activated.

4. The list of products to which this technical regulation extends is provided in the list of products falling under action of this technical regulation and their codes on the qualifier according to the single commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further - the CN FEA EEU) in appendix 1 to this technical regulation.

5. Products are intended for domestic needs of the population, social facilities, layered and powdered burning in stationary installations, cokings (devolatilization of coal), hydrogenation and gasification, needs metallurgical, chemical, construction, agricultural, medical and other industries.

6. The major dangerous factors (risks) who should be avoided and considered for safety of products are:

1) environmental pollution;

2) radiation hazard;

3) fire-and-explosion hazard (ignition, self-ignition).

Chapter 2. Terms and determinations

7. In this technical regulation the terms and determinations established by the Law of the Republic of Kazakhstan "About technical regulation" and also the following terms and determinations are applied:

1) agglomerating – process of enlargement of trifle with receipt of lumpy aggregates of different form and the sizes by the physical, chemical, thermal or combined impact for their more effective use;

2) the fuel agglomerated – the fuel received in the course of okomkovaniye of fine particles with addition of the binding material providing adhesion or without it;

3) the coal enriched – the coal received in the course of enrichment of coal, wet or dry;

4) coal nonenriched – the coal which did not undergo any other processes of preparation except screening or crushing;

5) the coal activated – the porous product received from coals by removal of resinous substances, developing in case of contact with gaseous or liquid circles significant area of surface for course of sorption processes (use for ensuring ecological and biological safety of the environment and the person regarding purification of air, gases, water and other liquids of pollution);

6) briquetting – process of receipt of pieces (briquettes) with additive or without additive of binding substances with the subsequent pressing of mix in briquettes of the necessary size and form;

7) the manufacturer – the legal entity registered according to the legislation of the Republic of Kazakhstan or state member of the Eurasian Economic Union or the physical person registered as the individual entrepreneur, the production or production and sales of products performing on its own behalf;

8) person authorized by the manufacturer – the legal entity registered according to the legislation of the Republic of Kazakhstan or state member of the Eurasian Economic Union or the physical person registered as the individual entrepreneur who based on the contract with the manufacturer, including with the foreign manufacturer, performs actions on behalf of this manufacturer in case of assessment of conformity and release into the stream of commerce of products in the territory of the Republic of Kazakhstan;

9) rank (subcategory) – the coal arrangement in genetic row showing its maturity on the basis of genetic and physical and chemical properties on the international classification system;

10) screening – the process of separation, material on fineness classes performed on devices (grokhota) with the sifting surfaces;

11) coke high-temperature – the firm caked carbonaceous remaining balance received in the course of coking of coals at temperature above 850 °C;

12) coking (devolatilization of coal) – process of thermal conversion of coals by their heating without access of air or at its presence;
