ORDER OF THE MINISTER OF INTERNAL AFFAIRS OF THE REPUBLIC OF KAZAKHSTAN

About introduction of amendments to the order of the Minister of Internal Affairs of the Republic of Kazakhstan of January 13, 2016 No. 23 "About approval of Rules of activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of January 13, 2016 No. 23 "About approval of Rules of activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 13141) the following changes:

state preamble in the following edition:

"According to the subitem 3) of article 5-1 of the Law of the Republic of Kazakhstan "About education" I ORDER:";

The rules of activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department of personnel policy of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) the direction of the order in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

4. This order becomes effective from the date of its signing.

Rules of activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan

Chapter 1. Basic provisions

1. These rules of activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About education" (further - the Law "About Education").

2. Rules determine procedure for activities of military, special educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - educational institutions of the Ministry of Internal Affairs) which includes the organization: managements of activities; educational activities; educational work; research, publishing and international activities of educational institutions of the Ministry of Internal Affairs.

3. In Rules the following concepts are used:

1) military higher education institutions - the educational institutions of the Ministry of Internal Affairs realizing educational programs of the higher, postgraduate and additional education for National guard of the Ministry of Internal Affairs (further - the Ministry of Internal Affairs) the Republic of Kazakhstan;

2) students are the cadets, undergraduates, doctoral candidates, listeners (including foreigners) professional development course and retraining, and also person for the first time arriving on service in the law-enforcement bodies of the Republic of Kazakhstan (further - Department of Internal Affairs) having initial professional training;

3) higher education institutions - the educational institutions of the Ministry of Internal Affairs realizing educational programs of the higher, postgraduate and additional education, and also initial professional training of persons for the first time arriving on service in law-enforcement bodies;

4) department - the educational structural division of higher education institution which is carrying out educational, methodical and research work on one or several related disciplines, educational work among students;

5) faculty - the main educational and scientific structural division of higher education institution which performs training in one or several directions and (or) educational programs, and also management of educational and methodical and research activities of departments and laboratories.

6) cycle - the educational structural division of Ministry of Internal Affairs Training center which is carrying out educational, methodical work on one or several related disciplines, educational work among students;

7) Ministry of Internal Affairs training center - the Ministry of Internal Affairs educational institution realizing educational programs of additional education, and also initial professional training of persons for the first time arriving on service in law-enforcement bodies (further - Training center).

4. The standard structure and the staff list of educational institutions affirms the Ministry of Internal Affairs.

Chapter 2. Procedure for the organization of management of activities of military, special educational institutions of the Ministry of Internal Affairs

Paragraph 1. Procedure for the organization of management of activities of higher education institutions

5. Control of higher education institution is exercised according to these rules, and also the charter of higher education institution.

6. Direct management of higher education institution is performed by the chief of higher education institution appointed to position and dismissed by the order of the Minister of Internal Affairs of the Republic of Kazakhstan (further - the Minister). Deputy chief of higher education institution are appointed and dismissed by the order of the Minister of representation of the chief of higher education institution (in military higher education institutions - deputy chief are appointed and dismissed by the order of the deputy minister - the Commander-in-chief of National guard of the Republic of Kazakhstan).

7. In higher education institutions collegiate organs of management are created. The academic council, educational and methodical council, and also the bodies created by the charter of higher education institution for the purpose of effective solution of tasks and accomplishment of functions of higher education institution treat bodies of joint management.

8. The structure and the number of members, activities of collegiate organs of management of higher education institution are determined by higher education institutions.

9. Structural divisions are part of higher education institution: faculties, departments, departments, and also the centers, laboratories, departments in case of their availability.

10. Structural divisions of higher education institution perform the activities on the basis of these rules, the charter of higher education institution, regulations on the relevant structural divisions of higher education institution, the annual plan of work developed for academic year.

11. The chief of higher education institution approves regulations on structural divisions in which their main activities, and job descriptions of employees (workers) are determined.

12. Management of faculty is performed by the chief of faculty appointed and dismissed by the order of the chief of higher education institution.

13. Management of research institution is performed by the chief of institute appointed and dismissed by the order of the deputy minister of internal affairs supervising personnel service on representation of the chief of higher education institution.

14. The department will be organized in the presence of at least than 7 regular teachers of profile of department.

The chief of department, the deputy, professors, associate professors, the senior teachers, teachers, educational support personnel enter into staff of department.

15. Proceeding from content of the fixed subject matters according to the standard and working curricula approved according to the Law "About Education" of department are classified on general education and special.

The departments performing preparation and release of specialists are issuing.

The issuing departments are determined by higher education institution independently according to training specialization.

16. Work of department is directed to theoretical and practical training of specialists according to contents of educational programs of the higher, postgraduate and additional education.

17. The number of students in higher education institution is determined by the state educational order.

18. Basis of training process is the academic honesty which realization is provided with higher education institution.

19. Higher education institutions realize educational programs for full-time courses, and also distance training.

In cases of introduction of emergency state, restrictive actions, including quarantine, the announcement of emergency and crisis situations of the organization of formation of the Ministry of Internal Affairs enter distance training for all students according to the procedure, determined by authorized body in the field of education.

20. The fullness of the academic group is determined according to the state educational order on training of specialists with the higher and postgraduate education.

Forming of the academic flows by higher education institution is performed independently.

21. For the purpose of providing and strengthening of office discipline, motivation of increase in level of knowledge, fulfillment of requirements of the curriculum by the chief of higher education institution measures of encouragement and collection are applied to students.

22. Expel of students is made by the order of the chief of higher education institution.

Expel of students at own will, for the academic poor progress, for violation of the principles of the academic honesty, for violation of office discipline, for health reasons is allowed.

The students who reached military age and deducted on the academic poor progress for violation of the principles of the academic honesty, indiscipline, and also at own will, go to bodies of military management for the residence for statement to military accounting.

Paragraph 2. Procedure for the organization of management of activities of Ministry of Internal Affairs Training center

23. Control of Training center is exercised according to these rules, and also the charter of training center.

24. Direct management of Training center is performed by the chief of Training center appointed to position and exempted by the order of the deputy minister.

25. In Training center collegiate organs of management are created. The faculty meeting, methodical council and bodies created according to the charter of Training center for the purpose of effective solution of tasks and accomplishment of functions of training center belong to bodies of joint management.

26. The structure and the number of members, activities of collegiate organs of management of Training center are determined by the provisions developed by Training center.

27. Structural divisions of Training center perform the activities on the basis of these rules, the charter of Training center, regulations on the relevant structural divisions of Training center, the annual plan of work.

28. The chief of Training center approves regulations on structural divisions in which their main activities are determined, approves job descriptions of employees (workers).

29. The cycle performs educational and methodical and educational activities according to the annual plan of work. The state of cycle is determined proceeding from amount of work and annual average pedagogical load of teachers taking into account specifics of educational process.

The chief of cycle, the senior teachers, teachers enter into staff of cycle.

Advanced training, training of employees (workers) of cycle is performed at least once in three years.

30. Persons having initial professional training live in barracks (in the hostel) and are provided with food.

31. For the purpose of providing and strengthening of office discipline, motivation of increase in level of knowledge, fulfillment of requirements of the curriculum by the chief of Training center measures of encouragement and collection are applied to students.

32. Expel of students is made by the order of the chief of Training center.

Expel of students at own will, for poor progress, for violation of office discipline, for health reasons is allowed.

Chapter 3. Organization of educational activities of military, special educational institutions of the Ministry of Internal Affairs

33. In higher education institutions training with the higher, postgraduate and additional education is performed different on content and terms of training in educational programs.

34. Educational activities of higher education institutions are performed on the basis of its academic policy which represents system of the measures, rules and procedures for planning and management of educational activities and the effective organization of educational process directed to realization of praktikooriyentirovanny training and improvement of quality of education.

The academic policy affirms the collegiate organ of the organization of education determining its concept of development and is observed according to the current legislation in the field of education taking into account the priorities and tasks facing higher education institutions.

The structure and the directions of the academic policy are determined by higher education institution independently.

35. Educational and methodical work in higher education institutions is carried out in all structural divisions implementing and coordinating educational process, educational programs of the higher, postgraduate and additional education.

36. Direct management of educational and methodical work of higher education institution is performed by the deputy chief supervising study.

37. Educational and methodical work of higher education institution includes:

1) development of the academic calendar, educational programs, working curricula and programs (syllabuses), educational and methodical complexes of disciplines, and also working programs and educational and methodical complexes of initial professional training;

2) educational and methodical providing subject matters with textbooks, education guidances, collections of tasks, complex tasks, benefits according to laboratory, control, term papers, methodical recommendations about studying of disciplines, and also materials of the current, rubezhny and final control of knowledge, final assessment of students about all forms of education;

3) development of programs professional practician, and also methodical recommendations (instructions) for writing of theses (projects), master and doctoral dissertations (projects);

4) development, use of the modern educational technologies and training methods increasing assimilation of training material by students;

5) educational and methodical ensuring the independent work of students aimed at the development of their capability to search, the analysis and the formulation of result of activities;

6) development of programs for advanced training and retraining of teachers and specialists;

7) other activities directed to realization of educational and methodical activities of higher education institution.

38. Planning of content, method of the organization and structure of educational and methodical activities is performed by higher education institution on the basis of credit technology of training.

39. Educational activities in educational institutions of the Ministry of Internal Affairs are performed on the basis of information resources.

The library stock is component of information resources and includes educational and scientific literature.

Higher education institution provide students with educational and educational and methodical literature and (or) electronic resources according to educational programs.

The higher education institution provides functioning of management information system with education (the information and education circle including the website, the information and education portal, the automated system of ensuring credit technology of training).

40. Academic year for students on full-time in higher education institution begins according to the working curriculum, since September 1, is divided into the academic periods (semester, trimesters, quarters) and comes to an end in the terms established by the academic calendar. For 1 rate start date of academic year, when carrying out educational and camp charges, begins before September 1.

41. The academic leaves are provided to cadets, undergraduates and doctoral candidates based on the conclusion of the district military-medical commission by duration for from 6 to 12 months due to illness, and also in case of the birth, adoption (adoption) of the child before achievement of age of three years by it.

Higher education institutions determine and provide observance of procedure for provision of the academic leaves.

42. The higher education institution establishes duration of the academic period independently according to the State obligatory standard of the higher and postgraduate education (further - GOSO) approved by the order of the Minister of science and the higher education of the Republic of Kazakhstan of July 20, 2022 No. 2 "About approval of the state obligatory standards of the higher and postgraduate education" (it is registered in the Register of state registration of regulatory legal acts at No. 28916).

43. Examinations of students of distance training, their periods and quantity in academic year are established by the academic council of higher education institution. Terms of initial professional training, advanced training and retraining are established according to the scheduled plan approved by the order of the Minister.

44. Introduction of summer semester (except for final year) for forming of additional competences at students, including carrying out educational and field charges is allowed.

45. The organization of educational activities is performed on the basis of the academic calendar, the schedule of studies.

46. The structure of educational activities is created on the basis of curricula and educational programs, amount of academic load, duration of the academic periods, types of the academic occupations, amount of training material.

47. Educational programs are developed by higher education institutions in coordination with profile services and departments of the Ministry of Internal Affairs.

48. The academic calendar, working curricula of specialties and annual average pedagogical load of the faculty affirm the solution of the academic council of higher education institution.

49. Planning of pedagogical load of the faculty is performed in class periods.

In higher education institutions pedagogical loading is calculated proceeding from regulation that 1 class period is equal to at least 40 minutes.

50. In higher education institutions applicable to all types of studies, all types the practician and final assessment constitutes one class period at least 40 minutes.

51. In higher education institutions the following main types of study are established: lectures, seminars, practical and laboratory researches, consultations, examinations, independent work of the student, independent work of the student under the leadership of the teacher, settlement and graphical works, practical works, all types of doctrines, camp charges, professional practice, educational or scientific training, the term paper (project), the thesis (project), research work, experimental and research work, the master thesis, the doctoral dissertation.

52. The ratio of amount of the credits (hours) between lectures and seminars, practical and laboratory researches is determined by higher education institution independently.

53. Chiefs of departments, deputy chiefs of departments, professors, associate professors, the senior teachers, teachers (having experience of practical work and pedagogical years of service on profile at least 3 years) are allowed to lecturing, management of theses (projects), research work of students.

The procedure for the admission of the teacher to lecturing is established by the academic council of higher education institution.

Scientists, honored workers of culture, art, sport, members of the creative unions or experienced specialists are also involved in lecturing and carrying out other types of studies.

54. Study is subdivided on classroom (lectures, seminars, practical and laboratory researches, independent work of the student under the leadership of the teacher) and out-of-class to which all other types of study belong.

55. The higher education institution independently determines forms, methods and tutorials, creating the most favorable conditions for development by students of educational programs of the higher, postgraduate and additional education.

56. The compulsory provision in activities of higher education institution is availability of the relevant classroom base, the educational offices, specialized polygons, shooting galleries, gyms and other rooms providing its activities.

57. Derivation of students from studies (including independent work) is allowed only with the written permission of the chief of the higher education institution or its deputy supervising study.

58. Educational programs of the higher, postgraduate education are developed according to GOSO.

59. The list and content of disciplines of obligatory component are determined by the standard training program, the list and content of disciplines of high school component are determined by working training programs by subject matters.

60. Studying of discipline within several academic periods is allowed.

61. Training is performed on the basis of educational programs, single for all forms of education.

62. Educational process in higher education institution according to educational programs with the reduced term of training in distance training is allowed for persons having technical and professional, postsecondary or higher education.

63. Professional practice, research and experimental and research work and final assessment of students are carried out according to the academic calendar according to requirements of GOSO.

64. Contents of the program developed by higher education institution and base of professional practice are provided in compliance to profile of specialty (educational program).

65. Bases professional the practician are the relevant divisions and departments of the Ministry of Internal Affairs. For passing professional the practician based on the relevant division of the conclusion of the agreement is not required (except military higher education institutions).

66. The direction on passing of professional practice is drawn up by the order of the chief of higher education institution.

Students on distance training on condition of their work on profile of the direction of preparation are exempted from professional practice. In this case they represent to higher education institution the reference (in any form) and the characteristic reflecting them professional activity.

67. Scientific management of externship is performed by the research supervisor of the thesis (project).

68. The research supervisor and subject of research of the undergraduate, the doctoral candidate based on the solution of the academic council affirm the order of the chief of higher education institution.

69. Within two months after transfer of the undergraduate the order of the head of higher education institution based on the solution of the academic council the subject of the master thesis (project) affirms and the research supervisor is appointed.

Scientific management of doctoral candidates on competition of degree of the doctor of philosophy (PhD) is performed of consultants in number of at least 2 people.

Scientific consultants provide accomplishment of the doctoral dissertation and respect for the principles of the academic honesty, and timely representation of dissertation work on protection.

70. Within research (experimental and research) work, the individual work plan of the undergraduate and doctoral candidate provides passing of scientific training in the scientific organizations and (or) the organizations of the corresponding industries or fields of activity.

71. The organization and carrying out protection of the doctoral dissertation is performed according to Rules of award of the academic degrees approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of March 31, 2011 No. 127 (it is registered in the Register of state registration of regulatory legal acts at No. 6951).

72. The undergraduate, the doctoral candidate who did not implement the curriculum is deducted by the order of the chief of higher education institution and recalled to the former duty station.

73. For implementation of accounting of the mastered credits, the organization of intermediate certification and final assessment, accounting of educational achievements of students in higher education institution the division for monitoring and control (assessment) of quality of education is created.

74. For the purpose of carrying out studies, the organization and carrying out professional the practician, training, preparation of term papers (projects), theses (projects), master theses and doctoral dissertations higher education institutions will organize branches of departments (cycles) of higher education institution in the divisions of Department of Internal Affairs corresponding to their profile.

Paragraph 2. Organization of educational activities of training centers of the Ministry of Internal Affairs

75. Transfer of students in Training center for passing of initial professional training and terms of training is performed according to the order of the Minister of Internal Affairs of March 13, 2020 No. 211 "About approval of Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training" (it is registered in the Register of state registration of regulatory legal acts at No. 140252).

76. The training center will organize teaching and educational process, chooses forms, methods and tutorials, creates necessary conditions for development of educational programs.

77. Direct management of educational and methodical work of Training center is performed by the deputy chief on study.

78. Educational and methodical work of Training center includes:

1) schedule development of educational process, working curricula and programs;

2) educational and methodical providing subject matters with education guidances, collections of tasks, complex tasks, methodical recommendations about studying of disciplines, and also materials of the current and final control of knowledge;

3) educational and methodical ensuring independent work of students;

4) other activities aimed at educational and methodical providing educational process.

79. The organization of educational activities is performed on the basis of the schedule of studies.

80. The structure of educational activities is created on the basis of standard curricula and training programs, amount of academic load, types of occupations, amount of training material.

81. Standard curricula are developed by personnel division of the Ministry of Internal Affairs together with profile services of the Ministry of Internal Affairs and affirm the Minister.

82. Working training programs and plans, the schedule of educational process, annual average pedagogical load of teachers affirm the decision of faculty meeting of Training center.

In case of development of curricula Training centers redistribute number of hours, the disciplines which are taken away on development of training material on each cycle within 20% of total quantity of hours of the standard curriculum.

83. Planning of academic load of teachers is performed in class periods which constitutes at least 40 minutes.

84. In Training center the following main types of study are established: lectures, seminars, practical and laboratory researches, independent work of students, preparation and passing of final control, all types of doctrines.

85. Study is subdivided on classroom (lectures, seminars, practical and laboratory researches) and out-of-class to which all other types of study belong.

86. The training center is independent in the choice of forms, procedure and frequency of carrying out the current and final control of progress.

87. The compulsory provision in activities of Training center is availability of the relevant classroom base, the educational offices, specialized polygons, shooting galleries, gyms and other rooms providing its activities.

88. Upon termination of training at rates of initial professional training, advanced training and retraining by the student the certificate in form according to the order of the Minister of Internal Affairs of March 13, 2020 No. 211 "About approval of Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training" is issued (it is registered in the Register of state registration of regulatory legal acts at No. 140252).

Chapter 4. The organization of educational work in military, special educational institutions of the Ministry of Internal Affairs

89. Educational activities of educational institutions of the Ministry of Internal Affairs are component of educational process and include:

1) forming at the studying abilities independently and competently to accept and realize decisions;

2) forming at students of sense of patriotism, civic consciousness, internationalism, high morals and morality;

3) forming at students of motivation to healthy lifestyle, active participation in public actions;

4) forming at students of anti-corruption behavior;

5) holding thematic actions for profile of department (faculty (institute)), cycle of the students promoting expansion of outlook, to forming of the valuable attitude towards the chosen specialty;

6) carrying out professional orientation work among the studying high comprehensive schools, the organizations of technical and professional education;

7) the actions directed to realization of tasks of educational process.

90. Educational activities are performed on the basis of mutual respect of human dignity of students and the faculty and strict execution of requirements of the charter of higher education institution (Training center).

91. Educational work is included into general load of the faculty.

Chapter 5. Organization research, publishing and international activities of military, special educational institutions of the Ministry of Internal Affairs

92. Research activities of higher education institutions are aimed at providing integration of science, education and practical activities of divisions and departments of the Ministry of Internal Affairs, development on this basis of scientific and educational process, increase in competitiveness of scientific research and innovative activities.

93. The organization and carrying out research works (basic, exploratory, applied scientific research) (further - NIR) is performed in structural divisions of higher education institution.

94. NIR in higher education institutions is carried out by persons from among professorial and scientific structure, students.

95. For accomplishment of the specified works in higher education institutions temporary groups of authors are created.

96. Accomplishment of NIR for professorial and scientific structure of higher education institutions is among fundamental obligations and is performed in working hours according to the individual work plan.

97. NIR of higher education institution includes:

1) carrying out fundamental, search, applied research works, the developmental works directed to the solution of tasks of practical activities of divisions and departments of the Ministry of Internal Affairs;

2) scientific, scientific and methodical, information and analytical ensuring rule-making and practical activities of divisions and departments of the Ministry of Internal Affairs;

3) research and development of theoretical and methodological bases of development of the higher, postgraduate and additional education;

4) development and deployment of innovative technologies of training in educational process;

5) implementation of results of scientific research in educational process and practice;

6) forming and development of own schools of sciences (in the presence of the corresponding scientific potential), active attraction to research work of scientific and pedagogical employees and students;

7) protection of intellectual property and copyright of researchers and developers;

8) organization and management of research work of students.

98. Coordination of research activities in higher education institution is performed by the deputy chief on scientific work and division of the organization of research and publishing work.

99. NIR enters pedagogical load of the faculty.

100. By results of NIR the intermediate and final reports provided by the schedule are constituted. Responsibility for accuracy of the data, containing in the report, heads and contractors of NIR bear.

101. Main objectives of publishing activities of higher education institution:

1) preparation and release of training, educational and methodical and scientific materials necessary for ensuring educational process of higher education institution and practical activities of divisions and departments of the Ministry of Internal Affairs;

2) promotion and distribution of editions of higher education institution in educational institutions and practical law-enforcement bodies.

102. The higher education institution issues the following printing editions:

1) monographs, textbooks, education guidances (educational and methodical, educational visual aids), workshops, courses of lectures on all disciplines (rates) of curricula;

2) methodical materials and educational and methodical documentation for ensuring educational process (working training programs, guidelines manuals, recommendations, development, instruction for studying or teaching subject matter (rate) or its part);

3) thematic collections of scientific works of the faculty, research associates (workers), students;

4) materials of the scientific, scientific and practical and methodical conferences, charges, meetings, round tables and seminars including held together with other educational institutions and state bodies;

5) help, information and other printed materials.

103. Higher education institutions perform international cooperation in the field of training, scientific and pedagogical activities.

104. International cooperation is performed according to international treaties of the Republic of Kazakhstan, agreements signed by the Ministry of Internal Affairs of the Republic of Kazakhstan with the relevant organizations of the foreign states, the direct bilateral agreements signed by higher education institution in coordination with the Ministry of Internal Affairs of the Republic of Kazakhstan.

105. Special higher education institutions perform international cooperation in the following forms:

1) the direction according to programs of bilateral and multilateral exchange out of limits of the Republic of Kazakhstan students, representatives of professorial and scientific structure;

2) participation in scientific conferences, seminars and other actions;

3) involvement of teachers of educational institutions and law enforcement officers of foreign states for lecturing, carrying out seminar and practical training, performances at conferences and participations in other actions;

4) training of foreign citizens;

5) the direction of professorial and scientific structure, undergraduates and doctoral candidates in foreign scientific and educational institutions on pedagogical, scientific training;

6) carrying out joint basic and applied scientific research, joint edition of scientific works, educational and educational and methodical literature;

7) exchange of educational, scientific and methodical databases;
