About introduction of amendments to some acts of the Government of the Russian Federation concerning establishment of features of functioning wholesale and the retail markets of electrical energy and capacity in the separate territories of the price zones which were earlier relating to not price zones of the wholesale market

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning establishment of features of functioning wholesale and the retail markets of electrical energy and capacity in the separate territories of the price zones which were earlier relating to not price zones of the wholesale market.

2. Recognize invalid separate provisions of acts of the Government of the Russian Federation according to the list according to appendix.

3. Determine that:

a) in case of establishment according to item 4 of this resolution of regulated prices (rates) for electrical energy (capacity) for the suppliers of electrical energy (capacity) applied for the purpose of sale of electrical energy and capacity in the wholesale market under regulated agreements, provisions of the paragraph of the eleventh Item 45 of Bases of pricing in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" are not applied;

b) in the separate territories of the price zones of the wholesale market which were earlier relating to not price zones of the wholesale market for which the Government of the Russian Federation establishes features of functioning wholesale and the retail markets (further - the separate territories which were earlier relating to not price zones), since January 1, 2025 established are not subject to application:

the prices (rates) for electrical energy (capacity) delivered to buyers in the retail markets of electrical energy in the territories united in not price zones, except for electrical energy (capacity) delivered to the population and categories of consumers equated to it;

the prices (rates) for electrical energy (capacity) delivered by the electric power producers and capacities functioning in the territory of not price zones of the wholesale market, to the guaranteeing suppliers;

regulated prices (rates) for electrical energy established at the level of weighted average on all production volumes of electrical energy included in the balance estimation on thermal power plants with which use suppliers participate in trade in electrical energy (capacity) in the wholesale market;

the weighted average cost of electrical energy (capacity) acquired by the guaranteeing supplier in the retail markets of electrical energy at regulated prices (rates), falling on all amount of the electrical energy delivered by the guaranteeing supplier;

c) forecast market prices of electrical energy (capacity) sold in the wholesale market in the separate territories which were earlier relating to not price zones are determined by executive bodies of subjects of the Russian Federation in case of establishment (review, adjustment) of rates for services in transfer of electrical energy regarding cost determination of losses of electrical energy by its transfer by power networks, and also the expenses on fee on transfer of electrical energy on single national (all-Russian) power network paid by the territorial network organization for the rate used for the purposes of expense determination on payment of the normative losses of electrical energy by its transfer on power networks of single national (all-Russian) power network included in rates for services in transfer of electrical energy on power networks to the territorial network organizations belonging on the property right or other legal cause, and sales allowances of the guaranteeing suppliers of electrical energy regarding cost determination of purchase of electrical energy (capacity) for power supply of the consumers who are not belonging to the population and the categories of consumers equated to it and also determination of weighted average cost of purchase of unit of electrical energy (capacity) for sales objectives of losses to the network organizations taking into account the following features:

forecast market price of the electrical energy sold in the wholesale market in 2025 is determined as the work of arithmetic average from values of the weighted regulated price for electrical energy in the wholesale market determined by results of calculation of the cost of planned hourly production volumes (consumption) of electrical energy and cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) in the wholesale market concerning settlement periods of 2024, and the forecast consumer price index provided by the forecast of social and economic development of the Russian Federation for 2025 and for planning period of 2026 and 2027;

forecast market price of the capacity sold in the wholesale market in 2025 is determined as arithmetic average from values of the weighted regulated price for capacity in the wholesale market concerning settlement periods of 2024 and forecast consumer price index provided by the forecast of social and economic development of the Russian Federation for 2025 and for planning period of 2026 and 2027;

for calculation of forecast market price of electrical energy (capacity) sold in the wholesale market the values of the weighted regulated price for electrical energy in the wholesale market determined by results of calculation of the cost of planned hourly production volumes (consumption) of electrical energy and cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) in the wholesale market concerning settlement period and value of the weighted regulated price for capacity in the wholesale market concerning settlement period, published by the commercial operator for the guaranteeing suppliers - participants of the wholesale market in the separate territories which were earlier relating to not price zones, specified in the paragraph the second Item 198 of Basic provisions of functioning of the retail markets of electrical energy are used approved by the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy", or the organizations which received the status of the guaranteeing supplier by results of tender in the specified territories;

d) in 2025 - 2028:

the electric power producers functioning in the separate territories which were earlier relating to not price zones are among the subjects of power industry corresponding to provisions of the subitem "g" of Item of 2 criteria of reference of subjects of power industry to number of subjects which investing programs (including determination of sources of their financing) affirm authorized federal executive body, or authorized federal executive body together with State Atomic Energy Corporation "Rosatom", or executive bodies of the subjects of the Russian Federation approved by the order of the Government of the Russian Federation of December 1, 2009 No. 977 "About investing programs of subjects of power industry" in the presence of investing program approved concerning such electric power producers in accordance with the legislation of the Russian Federation about power industry till January 1, 2024, for its realization which comes to the end no later than 2027 (further - the approved investing program);

the paragraph third ceased to be valid according to the Order of the Government of the Russian Federation of 30.09.2025 No. 1504

the conclusion by results of consideration of projects of investing programs of the electric power producers specified in the paragraph the second this subitem containing motivated notes to projects of investing programs, specified in Item 43 of Rules of approval of investing programs of the subjects of power industry approved by the order of the Government of the Russian Federation of December 1, 2009 No. 977 "About investing programs of subjects of power industry" (further - Rules of approval of investing programs), goes in cases, stipulated in Item 43 Rules of approval of investing programs;

approval of projects of investing programs of the electric power producers specified in the paragraph the second this subitem stops the executive body of the subject of the Russian Federation authorized on approval in accordance with the legislation of the Russian Federation about power industry of investing programs of subjects of power industry in the cases specified in Item 44 of Rules of approval of investing programs, and also in case, the specified in paragraph four of this subitem if the conclusion by results of consideration of projects of investing programs containing notes to it was already sent to such electric power producers according to Item 43 of Rules of approval of investing programs;

e) for the generating objects functioning in the separate territories which were earlier relating to not price zones which capacity is delivered in the forced mode for the purpose of ensuring reliable electric utility service of consumers based on the decision of the Government of the Russian Federation whose part installations generating with the gas turbine engine (the OKPD2 code from 27.11 are. 32) which according to information in the passport of the equipment are made on the basis of aviation engines in the territories of the foreign states and the territories making concerning the Russian Federation, the Russian legal entities and physical persons unfriendly actions and which capital repairs according to the operation manual and to maintenance are possible only in the conditions of specialized enterprises, in case of determination for 2025 of the prices (rates) for delivery of capacity in the forced mode according to Item 45 of Bases of pricing in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry", expense allocation which are not carried to expenses on fuel between activities for production of electrical energy (capacity) and activities for production of heat energy (capacity) it is made according to accounting policy of the supplier;

e) in the territories of the subjects of the Russian Federation specified in Item IV of appendix No. 2 to the Rules of the wholesale market of electrical energy and capacity approved by the order of the Government of the Russian Federation of December 27, 2010 No. 1172 "About approval of Rules of the wholesale market of electrical energy and capacity and about introduction of amendments to some acts of the Government of the Russian Federation concerning the organization of functioning of the wholesale market of electrical energy and capacity" the settlement period under agreements of power supply (purchase and sale (delivery) of electrical energy (capacity), including for the purpose of compensation of losses of electrical energy) preceding January, 2025 increases by difference between Moscow time and time of the 9th hour zone (MCK+7, Moscow time plus 7 hours) determined by the Federal Law "About Computation of Time". To the hours constituting the specified difference are applied to calculation of values of final regulated prices established for 2024 by executive bodies of subjects of the Russian Federation in the field of state regulation of rates of the price (rates) for electrical energy (capacity) delivered to buyers, except for electrical energy (capacity) delivered to the population and categories of consumers equated to it.

4. To Federal Antimonopoly Service:

a) till January 1, 2025 to establish in the separate territories which were earlier relating to not price zones, the regulated prices (rates) for electrical energy and capacity which are subject to application since January 1, 2025 for suppliers of electrical energy (capacity) for the purpose of sale of electrical energy and capacity in the wholesale market taking into account the changes approved by this resolution;

b) till January 1, 2025 to determine for 2025 in the composite balance estimation of production and deliveries of electrical energy (capacity) within Power pool system of Russia by subjects of the Russian Federation forecast scopes of supply of electrical energy and (or) capacity under regulated agreements for electric power producers (capacity) in the separate territories which were earlier relating to not price zones, for providing the population with electrical energy (capacity) and (or) categories of consumers equated to it;

c) till January 1, 2025 to provide to the Government of the Russian Federation offers on the sizes created till December 31, 2023 inclusive of the half-received (excessively gained) income formed as a result of variation of actual expenses on fuel from the planned costs on fuel considered in case of establishment of rates for electrical energy for thermal power plants which during forming of the specified income belonged on the property right or other legal cause to suppliers - the subjects of the wholesale market functioning in the separate territories which were earlier relating to not price zones regardless of trade methods in the wholesale market electrical energy and capacity by means of which the electrical energy and capacity of the specified thermal power plants is implemented;

d) till May 31, 2025 to provide to the Government of the Russian Federation offers on the sizes created following the results of 2024 of the half-received (excessively gained) income formed as a result of variation of actual expenses on fuel from the planned costs on fuel considered in case of establishment of rates for electrical energy for thermal power plants which during forming of the specified income belonged on the property right or other legal cause to suppliers - the subjects of the wholesale market functioning in the separate territories which were earlier relating to not price zones regardless of trade methods in the wholesale market electrical energy and capacity by means of which the electrical energy and capacity of the specified thermal power plants is implemented. Offers on the created sizes of the half-received (excessively gained) income offers on term during which the specified sizes are subject to accounting in the cost of capacity of the supplier - the subject of the wholesale market functioning in the separate territories which were earlier relating to not price zones are also included;

e) bring the regulatory legal acts into accord with this resolution.

5. This resolution becomes effective from the date of its official publication, except for Items 1 and 2 of this resolution which become effective since January 1, 2025.

1. In standards of disclosure of information by subjects wholesale and the retail markets of electrical energy approved by the order of the Government of the Russian Federation of January 21, 2004 No. 24 "About approval of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy" (The Russian Federation Code, 2004, No. 4, Art. 282; 2024, No. 16, Art. 2245):

3) in Item 56:

third to add the paragraph with the offer of the following content: "For the separate territories which were earlier relating to not price zones of the wholesale market, provisions of this paragraph are applied since November 1 year in which such territories were included in structure of price zones of the wholesale market.";

the fourth to add the paragraph with the offer of the following content: "For the separate territories which were earlier relating to not price zones of the wholesale market, provisions of this paragraph are applied to the settlement periods beginning since January 1 the year following after year in which such territories were included in structure of price zones of the wholesale market.".

"16) trade in electrical energy and (or) capacity at regulated prices (rates) in the separate territories which were earlier relating to not price zones for the purpose of providing with electrical energy and capacity of the consumers who are not belonging to the population and (or) categories of consumers equated to it;

17) trade in capacity according to purchase and sale agreements (delivery) of capacity of the generating objects modernized (reconstructed) or constructed in the separate territories which were earlier relating to not price zones concluded according to these rules according to the procedure, established by the Treaty of Accession to trade system of the wholesale market, concerning the generating objects included in the list of the generating objects which are subject to upgrade (reconstruction) or construction in the separate territories which were earlier relating to not price zones approved by the Government of the Russian Federation;

18) trade in capacity according to purchase and sale agreements (delivery) of capacity of the generating objects functioning in the separate territories which were earlier relating to not price zones.";
