About the state support in case of housing construction

For the purpose of enhancement of the state housing policies I decide:

1. Approve Regulations on provision conditions to citizens of the state support in case of construction, reconstruction or acquisition of premises it (is applied).

2. Establish features of application of earlier existing legislation to the relations on provision to citizens of the state support in case of construction, reconstruction or acquisition of premises and to other relations connected with such support (appendix 1).

3. Make changes to presidential decrees of the Republic of Belarus (appendix 2).

4. Recognize invalid presidential decrees of the Republic of Belarus (appendix 3).

5. Grant the right to Council of Ministers of the Republic of Belarus to explain questions of application of this Decree.

6. To impose control over the implementation of this Decree on the State Control Committee.

7. To provide to Council of Ministers of the Republic of Belarus till June 1, 2025 reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

8. This Decree becomes effective in the following procedure:

Item 7 and this Item - after official publication of this Decree;

other provisions of this Decree - since June 1, 2025.

Appendix 1

to the Presidential decree of the Republic of Belarus of March 6, 2025 No. 95

Features of application of earlier existing legislation to the relations on provision to citizens of the state support in case of construction, reconstruction or acquisition of premises and to other relations connected with such support

1. On conditions, stipulated by the legislation, No. 13 operating before entry into force of the Presidential decree of the Republic of Belarus of January 6, 2012 "About some questions of provision to citizens of the state support for construction (reconstruction) or acquisition of premises" taking into account regulations of the called Decree and other regulatory legal acts which action extended to earlier signed credit agreements (the arisen relations) before entry into force of the called Decree and the signed credit agreements, are regulated:

the relations on support of credit agreements on receipt of soft credits on construction, reconstruction or acquisition of the premises concluded by citizens till January 17, 2012 within the term of their action;

other relations, including on pledge (mortgage), alienation of the premises built, reconstructed or acquired with use of soft credits, to their provision according to the employment contract of premises of private housing stock or lease of premises.

2. The relations on provision of soft credits on construction, reconstruction or acquisition of premises to the citizens who signed credit agreements from January 17, 2012 to June 1, 2025 on the terms of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13, on support of these credit agreements within the term of their action, regulation of other relations including on pledge (mortgage), alienation of the premises built, reconstructed or acquired with use of soft credits, to their provision according to the employment contract of premises of private housing stock or lease of premises are performed on the terms of the called Decree and other regulatory legal acts operating before entry into force of this appendix, and the signed credit agreements.

3. The relations on provision on the terms of the Presidential decree of the Republic of Belarus of July 4, 2017 No. 240 "About the state support of citizens for construction (reconstruction) of premises" subsidies for payment of part of interest for using the credits (subsidies for payment of part of interest for using the credits and subsidies for repayment of principal debt on the credits) (further - subsidy (subsidies), regulation of other relations, including on pledge (mortgage), alienation of premises, in case of construction which reconstruction the subsidy (subsidies) was used to their provision according to the employment contract of premises of private housing stock or lease of premises, are performed on the terms of the called Decree, the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13 and other regulatory legal acts operating before entry into force of this appendix.

At the same time in case of change of person in the credit obligation on the party of the borrower after state registration of emergence of the property right of the borrower to the built, reconstructed premises district, city (the cities of regional and district subordination) the executive committee, local administration of the area in the city has the right according to the procedure, No. established in part two of subitem 1.15 of Item 1 of the Presidential decree of the Republic of Belarus of July 4, 2017 240, to make the decision on modification of the decision on provision of subsidy (subsidies) in which the receiver of subsidy (subsidies) the former spouse (spouse) of the receiver of subsidy (subsidies) who assumed obligations according to the credit agreement improving together with it housing conditions and included in the decision on provision of subsidy (subsidies) based on its statement is specified.

4. Operation of this Decree (regarding failure to provide soft credit and (or) one-time subsidy for construction of premises in apartment apartment houses) does not extend on:

construction of premises under agreements of creation of objects of shared-equity construction in apartment apartment houses on which the project declaration is published till June 1, 2025;

construction of premises as a part of the organizations of the builders created till June 1, 2025;

construction of premises in apartment apartment houses which construction is performed with establishment according to the decision of the President of the Republic of Belarus of other procedure and (or) conditions of provision to citizens of soft credit on construction of premises.

5. The relations on provision to citizens of soft credits, one-time subsidies for construction of the premises specified in item 4 of this appendix, on support of credit agreements on receipt of soft credits on construction of premises within the term of their action (execution of decisions on provision of one-time subsidies), regulation of other relations, including on pledge (mortgage), alienation of the specified premises, their provision according to the employment contract of premises of private housing stock or lease of premises, are performed on the terms of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13 and other regulatory legal acts operating before entry into force of this appendix, the decisions of the President of the Republic of Belarus specified in paragraph four of item 4 of this appendix, and the signed credit agreements.

6. Decisions district, city (the cities of regional and district subordination) executive committees, local administrations of areas in the cities about provision of one-time subsidies for debt repayment on the soft credits obtained on the construction, reconstruction or acquisition of premises accepted till June 1, 2013 are performed according to earlier existing legislation.

7. Compensation of the state support on construction, reconstruction or acquisition of premises provided with the condition established in subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of July 31, 2023 No. 239 "About compensation of the given state support" is made according to earlier existing legislation.

8. Giving and consideration of the applications about provision of financial support according to the Presidential decree of the Republic of Belarus of November 22, 2007 No. 585 "About provision to young and large families of financial support of the state" in debt repayment on the loans granted according to the credit agreements concluded till August 7, 2017, acceptance according to such statements of decisions and their execution are performed according to earlier existing legislation.

The list of the changes made to presidential decrees of the Republic of Belarus

1. In Item 1 of the Presidential decree of the Republic of Belarus of August 30, 2005 No. 405 "About some measures for construction of apartment houses (apartments) in the rural zone":

in subitem 1.1 of the word "construction (reconstruction)" shall be replaced with words "construction, reconstruction";

in subitem 1.2 part one to replace the word "constructions" with the word "constructions";

in subitem 1.4:

second and third to state parts in the following edition:

"The state support in case of acquisition of premises which construction was performed according to the state order is provided to the military personnel directed to such acquisition of premises in the place of registration of the housing conditions needing improvement in the place of military service with the condition established in Item 40 of the Regulations on the provision conditions to citizens of the state support in case of construction, reconstruction or acquisition of premises approved by the Presidential decree of the Republic of Belarus of March 6, 2025 No. 95.
