According to the subitem 2) of Item 2 of article 6-2 of the Law of the Republic of Kazakhstan "About information access" and the subitem 271) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501, I ORDER:

1. Approve the enclosed Rules of carrying out data analysis, except for information with limited access, the state bodies containing in objects of informatization.

2. To provide to department of digital transformation of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out data analysis, except for information with limited access containing in objects of informatization of state bodies

Chapter 1. General provisions

1. These rules of carrying out data analysis, except for information with limited access, the state bodies containing in objects of informatization (further – Rules) are developed according to the subitem 2) of Item 2 of article 6-2 of the Law of the Republic of Kazakhstan "About information access", the subitem 271) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501 and determine procedure for carrying out data analysis, the state bodies containing in information systems.

2. In these rules the following basic concepts are used:

1) the user of information – the physical person or legal entity requesting and (or) using information;

2) authorized body in the field of informatization (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of informatization and "the electronic government";

3) open data – the public electronic information resources presented in the machine-readable form and intended for further use, the repeated publication in invariable type;

4) set of open data – the systematized set of the same data provided in the form of open data consisting of the separate elements which are characterized by set of attributes and allowing information systems to identify, interpret and process such elements without participation of the person;

5) the Internet portal of open data (further – the Internet portal) – the web portal component of "the electronic government" providing centralized storage of descriptive and reference information on open data;

6) information with limited access – information carried to the state secrets, personal, family, bank, trade secret, the secret of the health worker and (or) other secrets protected by the law, personal data of limited access, and also office information of limited distribution;

7) the service integrator of "the electronic government" (further – the service integrator) – the legal entity determined by the Government of the Republic of Kazakhstan to which functions on methodological ensuring development of architecture of "the electronic government" and standard architecture of "electronic akimat", and also other functions provided by the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization" are assigned.

3. Data analysis, except for information with limited access, the state bodies containing in objects of informatization, is carried out for the purpose of their subsequent placement on the Internet portal of open data.

Chapter 2. Procedure for carrying out data analysis, except for information with limited access, the state bodies containing in objects of informatization

Authorized body for the purpose of expansion of quantity of sets of open data on the Internet portal and increases in their demand by users of information, based on the decision of the Commission, created according to Regulations on the Commission on the questions of information access approved by the Order of the Minister of information and social development of the Republic of Kazakhstan of July 13, 2023 No. 281-HK (it is registered in the Register of state registration of regulatory legal acts at No. 33096) (further – the Commission), creates the list of the state bodies which are to be surveyed for carrying out data analysis, except for information with limited access, containing in objects of informatization of state bodies.

5. The authorized body sends official request to the service integrator for carrying out data analysis, the state bodies containing in objects of informatization included in the list.

6. The service integrator sends official request to the inspected state body, according to appendix 1 to these rules, on receipt of unloadings from information systems, with reference to official request of authorized body.

7. The service integrator within two months carries out the analysis of the provided unloadings, reveals availability of open data for forming of set of open data, develops the draft of the technological passport of set of open data (further – the draft of the passport) according to appendix 2 to these rules.

When carrying out data analysis the service integrator proceeds from the following criteria:

1) data are not information with limited access;

2) data are demanded by citizens and business;

3) there is high degree of readiness of the open data this for their publication in format;

4) data are already published, but not in machine-readable type.

During its carrying out the service integrator analyzes the arrived requests of users of the Internet portal for the publication and updating of open data, and also determines requirements of business by means of the direction of the corresponding request to National chamber of entrepreneurs of the Republic of Kazakhstan.

8. The service integrator sends developed drafts of passports of approval to state body.

9. The service integrator sends results of the carried-out analysis to authorized body and authorized body in the field of information access for the subsequent removal at commission session.

10. The commission, taking into account public concerns in the field of information access and needs of users of information, makes recommendations to drafts of passports.

In case of availability of notes and proposals of members of the commission to drafts of passports, the corresponding notes and offers are considered by gosudartsvenny bodies and the motivated answer about acceptance or rejection goes to authorized body in the field of information access and to the service integrator.

11. Drafts of passports affirm state bodies and sets of open data are placed on the Internet portal.
