About introduction of amendments to the Resolution of the Cabinet of Ministers of Ukraine of July 17, 1992 No. 393

The Cabinet of Ministers of Ukraine decides:

1. Bring in the resolution of the Cabinet of Ministers of Ukraine of July 17, 1992 No. 393 "About procedure for calculation of length of service, appointment and pension payment and the monetary assistance to persons having pension entitlement according to the Law of Ukraine "About provision of pensions of persons discharged from military service, and some other persons", except the military personnel of conscription service and members of their families and persons equated to them" (ZP of Ukraine, 1992, No. 7, of Art. 182 with the following changes) the enclosed changes.

2. This resolution becomes effective from the date of its publication taking into account that the paragraphs the first and fourth Item of 6 changes approved by this resolution are applied from the date of entry into force of the Law of Ukraine of March 21, 2024 No. 3621-IX "About introduction of amendments to some laws of Ukraine concerning providing the rights of the military personnel and police officers to social protection", Items 4, of 5, paragraph two of Item of 6 changes approved by this resolution are applied from the date of entry into force of the Law of Ukraine of April 11, 2024 No. 3633-IX "About modification of some legal acts of Ukraine of rather single questions of passing of military service, mobilization and military accounting", subitems 3, of 4, of the 7th Item of 1 changes approved by this resolution are applied from the date of entry into force of the Law of Ukraine of April 25, 2024 No. 3674-IX "About introduction of amendments to some laws of Ukraine concerning settlement of calculation of insurance years of service and provision of pensions", subitems 1, of 2, of 5, of the 6th Item 1, Items 3, of 7-12 changes approved by this resolution are applied from day of entry into force of the Law of Ukraine of July 18, 2024 No. 3886-IX "About introduction of amendments to the Code of Ukraine about administrative offenses and some other laws of Ukraine concerning strengthening of responsibility for small stealing of alien property and settlement of some other questions of activities of law enforcement agencies".

Changes which are made to the Resolution of the Cabinet of Ministers of Ukraine of July 17, 1992 No. 393

1. In Item 1:

Paragraphs of the sixth and eighth after words of "National police" to add 2) with words ", to the State bureau of investigations";

The paragraph the ninth to state 3) in the following edition:

"the military service (service) during the period till January 1, 1992 in Armed Forces, other military forming, the state security agencies and internal affairs of the former USSR is enlisted in length of service (including on favorable terms) to persons living in Ukraine, according to the procedure, established by the legislation of the former USSR existing till January 1, 1992 according to the record of service of the personal record of person passing military service (service);";

"To length of service the military service (service) is enlisted in the period since January 1, 1992 in Armed Forces, law-enforcement bodies, the state security agencies, police, other military forming formed according to the legislation of the states which were part of the former USSR if transfer of such periods is provided in length of service by international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine. The length of service (including on favorable terms) is in that case estimated according to the legislation of the relevant state in the territory of which the military personnel, persons having pension entitlement under the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" passed military service (service) if other is not provided by international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine.

The periods of military service (service) since February 19, 2014 in Armed Forces, law-enforcement bodies, the state security agencies, police, other military forming, stay on positions of public service, on positions in local government bodies in relevant organs (forming) of the Russian Federation, the voluntary periods on the positions connected with accomplishment of organizational and administrative or administrative functions in the illegal authorities formed in temporarily occupied territory of Ukraine, in particular in occupational administration of the state aggressor, in illegal judicial or law enforcement agencies, and also the periods of voluntary participation in the illegal armed or paramilitary forces formed in temporarily occupied territory of Ukraine and/or in paramilitary groups of the state aggressor are not ranked as length of service.".

2. Add the resolution with Item 1-1 of the following content:

"1-1. The length of service for award of pension is estimated according to the record of service of the personal record of the serviceman, person having pension entitlement under the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons", other documents (excerpts from orders, fighting reports, magazines of fighting (operational tasks, maintaining operational situation), shift logs, flight sheets, books of service, orders on attraction to the relevant activities, references of military units, archive organizations, data on accomplishment of prospecting actions).".

3. State Item 2 in the following edition:

"2. To length of service to police officers, the staff of Service of judicial protection, faces of officers, faces of average, the senior and highest commanding structure of law-enforcement bodies, the State fire protection, Public service of special communication and information security, bodies and divisions of civil protection, tax police or the Public criminal and executive service, to persons having special ranks of Bureau of economic safety, to faces of ordinary structure, younger, average, the senior and highest commanding structure of the State bureau of investigations, to persons specified in the Item of article 1-2 of the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" in case of award of pension according to the Item "and" of part one of article 12 of the specified law training time in limits up to five years (irrespective of education form) in educational institutions (except training in organizations of military specialized education (military and sports) profile, military educational institutions and educational institutions of the Ministry of Internal Affairs and the state fire protection) upon termination of which the officer (special) rank, to the accession on military service, service to law-enforcement bodies, National police, the State bureau of investigations is given, Services of judicial protection, the state fire protection, bodies and divisions of civil protection, tax police or the Public criminal and executive service, Bureau of economic safety or before appointment to the corresponding position from calculation - one year of training in six months of service in addition is set off.".

4. State Item 3 in the following edition:

"3. To length of service for determination of the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" it is enlisted on favorable terms:

1) to persons specified in paragraph one of Item 1 of this resolution - one month of service in three months of time of service during which person was directly involved in implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with the armed aggression of the Russian Federation against Ukraine, being directly in areas and during implementation of the specified actions during action of warlike situation;

2) to faces of the private and the commanding structure of the Public criminal and executive service - one month of service in 40 days;

to persons serving in paramilitary forces and organizations of execution of the punishments intended for content of convicts to lifelong imprisonment - one month of service in one and a half months;

to persons serving in organizations of execution of the punishments intended for content and treatment of the convicts sick with infectious and mental diseases, - one month of service in two months according to the list of positions and according to the procedure, approved by the Ministry of Justice.".

5. State item 4 in the following edition:

"4. Determine that the period of compulsory military service is set off in length of service for purpose of pensions to persons specified in paragraph one of Item 1 of this resolution in calendar calculation, and the periods which are set off on favorable terms - for determination of the size of pension.".

6. Add the resolution with Item 4-1 of the following content:

"4-1. Determine that to persons specified in paragraph one of Item 1 of this resolution by which according to Item 3 of this resolution in the edition operating till May 17, 2024 inclusive transfer of the periods of service was provided on favorable terms for determination of the size of pension during award of pension for long service such periods are enlisted in length of service according to the legislation existing till May 17, 2024 inclusive for determination of the size of pension.

Determine that to persons specified in paragraph one of Item 1 of this resolution to length of service for determination of the size of pension one month of service in three months of time of service during which person was directly involved in implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with the armed aggression of the Russian Federation against Ukraine is enlisted on favorable terms, being directly in areas and during implementation of the specified actions during action of warlike situation from February 24, 2022 to May 3, 2024 inclusive.

Determine that to persons specified in paragraph one of Item 1 of this resolution, the period of participation in fighting during warlike situation from May 4, 2024 to May 17, 2024 inclusive, and also time of service during which person was directly involved in implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with the armed aggression of the Russian Federation against Ukraine during the specified period is set off on favorable terms in length of service for determination of the size of pension - one month of service in three months.

The length of service estimated in case of award of pension for long service to persons specified in Item 1 of this resolution about day of entry into force of the resolution of the Cabinet of Ministers of Ukraine of December 27, 2024 in No. 1508 "About introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of July 17, 1992 No. 393" is not reviewed.".

7. In Item 7:

1) to add Item after the paragraph of the ninth with new paragraphs of the following content:

"For faces of the private and the commanding structure of the State bureau of investigations and members of their families having pension entitlement according to the Law of Ukraine "About provision of pensions of persons discharged from military service" and some other persons" pension it is estimated from the amount of cash cover taking into account salary on position, surcharge for special rank, surcharge for long service in the sizes established on the last established post held before dismissal; monthly surcharges and the award determined for 24 last calendar months of service in a row before dismissal from service in the State bureau of investigations. The average amount of monthly surcharges and award is determined by division into 24 total amounts of such types of cash cover for 24 last calendar months of service in a row before dismissal from service in the State bureau of investigations.

If service life in the State bureau of investigations made less than 24 calendar months, the average monthly amount of surcharges and award is determined by division of total amount of such types of cash cover for the last actual months of service in a row before dismissal (death) on the number of such months. At the same time for faces of the private and the commanding structure of the State bureau of the investigations dismissed in August, 2024, the amount of monthly surcharges and award is determined on the date of dismissal from service (death) at the rate of such payments for full moon.".
