About classification of carcasses of cattle, pigs and sheep and representation of market prices of hulks and live animals

The parliament adopts this ordinary law.

This law:

– shifts Article 10 and appendix IV to Regulations of the European parliament and Council (EU) No. 1308/2013 of December 17, 2013 about creation of the general organization of the markets of agricultural products and about cancellation of regulations of Council (EEC) No. 922/72, (EEC) No. 234/79, (EU) to No. 1037/2001 and (EU) No. 1234/2007, published in the Official magazine of the European Union by L 347 of December 20, 2013 of CELEX: 013R1308, with the subsequent changes made by Regulations of the European parliament and Council (EU) 2024/1143 of April 11, 2024;

– partially shifts the Delegated regulations of the Commission (EU) 2017/1182 of April 20, 2017, the No. 1308/2013 supplementing rules of application of Regulations of the European parliament and Council (EU) about the scales of classification of carcasses of cattle used in the European Union, pigs and sheep and representation of market prices of certain categories of hulks and live animals published in the Official magazine of the European Union by L 171/74 of July 4, 2017, CELEX: 32017R1182;

– partially shifts Executive regulations of the Commission (EU) 2017/1184 of April 20, 2017 about establishment of rules of application of Regulations of the European parliament and Council (EU) No. 1308/2013 about the scales of classification of carcasses of cattle used in the European Union, pigs and sheep and representation of market prices of certain categories of hulks and live animals published in the Official magazine of the European Union by L 171/103 of July 4, 2017, CELEX: 320170R1184.

Chapter I. General provisions

Article 1. Subject and sphere of regulation

(1) This law establishes legal and economic basis of the National classification system of carcasses of cattle, pigs and sheep, and also relations between the public institutions and operators participating in cultivation and slaughter of animals.

(2) the Purpose of this law is ensuring transparency of activities of the parties participating in cultivation and slaughter of animals and also ensuring objectivity and correctness of classification of carcasses of cattle, pigs and sheep.

(3) Operation of this law does not extend to the hulks received in individual farms for private consumption.

Article 2. Basic concepts

For the purposes of this law the following basic concepts are used:

1) permission of the specialist in classification – the document issued by supervision body and control, confirming the right to implementation of activities in the field of classification of carcasses of cattle, pigs and sheep;

2) hulk – the whole body of the slaughtered animal after bleeding, nutrovka and removals of skin;

3) classification of hulks – transaction on ink quality evaluation depending on ratio of three main components: meat, fat and bones;

4) the classification specialist – the physical person specializing in the field of classification of carcasses of cattle, pigs and sheep, having the certificate on the termination of rates on classification of hulks;

5) half carcass – the product which is turning out as a result of symmetric razrub of ink on the center of everyone cervical, chest, lumbar and sacral vertebrae and on the center of breast and sciatic and pubic union;

6) the National classification system of carcasses of cattle, pigs and sheep (further – the National classification system of hulks) – set of the procedures including activities for classification and tracking of carcasses of cattle, pigs and sheep, to registration, representation and receipt of the prices of hulks and also for use of the equipment and methods for classification of hulks.

Chapter II. Organization of national classification system of hulks

Article 3. Ministry of Agriculture and food industry

(1) the Industry body of the central public management providing realization of government policy for the National classification system of hulks is the Ministry of Agriculture and the food industry.

(2) for the purposes of this law Ministry of Agriculture and the food industry performs the following powers:

a) develops program documents concerning the National classification system of hulks;

b) approves technical rules of classification of hulks, registration and representations of market prices of carcasses of cattle, pigs and sheep and on live animals of the specified types;

c) approves samples of reports on classification of hulks, about check of results of classification of hulks and about check of representation of the prices of hulks;

d) approves samples of check sheets of check of specialists in classification on slaughters.

Article 4. Supervision body and control

(1) the Supervision body and control performing implementation of the National classification system of hulks is the National agency on safety of foodstuff (further – supervision body and control).

(2) the Supervision body and control performs the following powers:

a) manages the National classification system of hulks;

b) issues permissions of the specialist in classification;

c) constitutes and quarterly updates the list of persons having permission of the specialist in classification;

d) withdraws or cancels permissions of the specialist in classification;

e) creates the Commission on classification of hulks.

Article 5. Commission on classification of hulks

(1) the Commission on classification of hulks (further – the Commission) is the collegiate organ created by supervision body and control for decision making which has no status of the legal entity, consists of the odd number (at least five) members and bears responsibility for carrying out testing on validation of methods of classification of hulks (further – validation testing).

(2) at least two representatives of supervision body and control, and also representatives of the Ministry of Agriculture and food industry, profile research establishments, branch associations of producers/processors of agricultural products are part of the Commission.

(3) In addition to the subjects specified in part (2), the Commission has the right to involve in carrying out validation testing and other experts as observers.

(4) the Commission carries out validation testing according to appendices 1 and 2.

(5) Regulations on procedure for the organization and functioning of the Commission affirm the order of the head of supervision body and control.
