Based on the paragraph of the fifth of part two of article 9 of the Law of the Republic of Belarus of June 23, 2008 No. 356-Z "About labor protection", subitem 7.1.5 of Item 7 of the Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1589, the Ministry of Labour and Social Protection of the Republic of Belarus DECIDES:

1. Approve Rules on labor protection in case of production of food products (are applied).

2. This resolution becomes effective since April 1, 2025.

Rules on labor protection in case of production of food products

Section I. General requirements in case of production of food products

Chapter 1. General provisions

1. These rules on labor protection in case of production of food products (further - Rules) establish requirements for labor protection in case of performance of works, connected with production processes of food products on objects of the industry on production of food products (further - object).

2. The requirements for labor protection containing in these rules are aimed at providing the healthy and safe working conditions working, occupied with production of food products (further - working), and extend to all employers irrespective of their forms of business and patterns of ownership performing production of food products on object (further - employers).

3. For the purposes of these rules terms and their determinations in the values established by the Law of the Republic of Belarus of June 23, 2008 No. 356-Z "About labor protection", the Decree of the President of the Republic of Belarus of November 23, 2017 No. 7 "About development of entrepreneurship", the technical regulation of the Customs union "About safety of food products" are used (TR CU 021/2011) made by the decision of the Commission of the Customs union of December 9, 2011 No. 880, the technical regulation of the Customs union "On safety of machines and the equipment" (TR CU 010/2011) made by the decision of the Commission of the Customs union of October 18, 2011 No. 823, the Rules on labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of July 1, 2021 No. 53, the Standard instruction for labor protection in case of performance of works in capacity constructions the Republic of Belarus approved by the resolution of the Ministry of Labour and Social Protection of October 19, 2022 No. 59, and also the following terms and their determinations:

protective barrier - the protection covers, boards, covers, screens, doors and other designs which are part of the machine and (or) equipment of the object used in case of production of food products (further, if is not determined other, - the equipment), excluding (interfering) penetration working to the danger area;

instrumentations - the measuring instruments of parameters of engineering procedures of production of food products (further - engineering procedures) serving for receipt of information and control of their condition;

the working area - the workplace space limited on height of 2 meters over the level of floor or the platform;

sulphitation - conservation of fruits and vegetables by means of sulphurous anhydride, sulphurous acid, and also hydrosulphite (bisulphite) of sodium for the purpose of prevention of spoil of fruits and vegetables;

maintenance of the equipment - complex of works on maintenance of working capacity or operability of the equipment during its service life in case of application to destination;

technological documentation - set of technological documents which determine engineering procedure of production of food products on object;

operation of the equipment - the stage of lifecycle of the equipment from the moment of its commissioning before utilization including installation, its application to destination, maintenance and repair, and also storage of the equipment during operation.

4. In case of production of food products requirements of the Law of the Republic of Belarus "About labor protection" shall be observed, specific sanitary and epidemiologic requirements to objects of the industry on conversion of agricultural products, the food staples and production of food products approved by the resolution of Council of Ministers of the Republic of Belarus of March 5, 2019 No. 146, Governed on labor protection, these rules, other regulatory legal acts, including technical regulatory legal acts which are according to legal acts and the orders of the Government of the Republic of Belarus obligatory for observance (further if other is not determined, - technical regulatory legal acts), technical regulations of the Customs union and Eurasian Economic Union, interstate standards, local legal acts.

5. In case of production of food products operation of hazardous production facilities and potentially dangerous objects according to appendices 1 and 2 to the Law of the Republic of Belarus of January 5, 2016 "About industrial safety" shall be performed No. 354-Z according to requirements of the legislation in the field of industrial safety, these rules.

On the basis of the technical regulatory legal acts, provisions on labor protection stated in technological documentation, operational documents of the organizations manufacturers to the used equipment (further - operational documents of manufacturers), these rules, the employer develops instructions for labor protection for professions of working and (or) separate work types (services).

7. In production process of food products on the harmful and (or) dangerous production factors working perhaps impact:

the increased dust content and (or) gas contamination of air of the working area;

mobile parts of the equipment;

emergence in the working area of explosive and fire-dangerous environments;

the increased or lowered temperature of surfaces of the equipment;

the increased or lowered air temperature of the working area;

the increased noise level;

the increased vibration level;

the increased humidity of air of the working area;

absence or lack of natural lighting of the working area;

insufficient illumination of the working area;

physical and psychological overworks;

the increased value of tension in electric chain which short circuit can happen through body of the person;

the increased level of static electricity;

the toxic and irritating chemicals, pathogenic microorganisms and products of their life activity, and also parasites activators of infectious and invasive diseases, general for animals and the person;

workplace arrangement at height concerning the Earth's surface (floor).

In production process of food products on other harmful and (or) dangerous production factors working perhaps impact.

8. In production process of food products in air of the working area the hazardous substances showing dangerous properties concerning the life and health working can be allocated (further if other is not determined, - hazardous substances) with which in case of performance of works it is necessary to observe requirements of Rules for labor protection during the work with the chemicals showing dangerous properties, the approved resolution of the Ministry of Labour and Social Protection of the Republic of Belarus and National academy of Sciences of Belarus of December 12, 2022 No. 90/9, of other technical regulatory legal acts.
