About some questions of court practice connected using the Law of the Kyrgyz Republic "On regulation of land legal relations"
For the purpose of ensuring uniform application by courts of provisions of the Law of the Kyrgyz Republic of April 1, 2022 No. 21 "On regulation of land legal relations" (further - the Law), and also the dispute resolutions connected with the rights to the parcels of land falling under operations of "land amnesty", being guided by the p. 3 of Art. 98 of the Constitution of the Kyrgyz Republic, Art. 18 of the Law of the Kyrgyz Republic "About the Supreme Court of the Kyrgyz Republic and local courts", the Plenum of the Supreme Court of the Kyrgyz Republic decides:
1. About transfer of the parcels of land in category of lands of settlements
Courts should consider that according to part 1 of article 10 of the Law the parcels of land specified in article 2 of this Law are considered transferred (transformed) to category of lands of settlements from the moment of decision making of authorized body about approval of the list of the lands falling under operation of land amnesty.
Such decision of public authority has normative and legal nature and forms the basis for origin at citizens of legitimate rights for the corresponding parcels of land.
According to the resolution of the KR Cabinet of Ministers of May 31, 2022 No. 291 "About approval of the Regulations on procedure for carrying out land amnesty" (in edition of the resolution of the KR Cabinet of Ministers of March 29, 2023 No. 174) local public administrations, local government bodies and state bodies by consideration of questions of fixing, registration of the property right and issue of right certifying documents on subjects of land amnesty are guided only by regulations of the above-stated Law and Regulations on procedure for carrying out land amnesty.
