According to subitem 10-33) of Article 10-2 and subitems 1), 3) and 4) of Item 1 of article 10-8 of the Law of the Republic of Kazakhstan "About the housing relations", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:

1. Approve:

1) Rules of implementation of measures of the state support, housing conditions directed to improvement according to appendix 1 to this order;

2) the List of invalid some orders, according to appendix 2 to this order.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication.

Rules of implementation of measures of the state support, housing conditions directed to improvement

Chapter 1. General provisions

1. These rules of implementation of measures of the state support, the housing conditions directed to improvement (further – Rules) are developed according to the Laws of the Republic of Kazakhstan "About the housing relations" (further – the Law), "About the state services" and determine procedure for provision of the dwelling from the utility housing stock or the dwelling leased by local executive body in private housing stock, concessional mortgage housing loans through system of housing construction savings, housing certificates.

2. In these rules the following basic concepts are used:

1) the web portal of information system (further – the web portal) – the Internet resource placed on the Internet, providing access to information system;

2) preliminary housing loan - the target loan granted by housing construction savings bank to the investor within the contractual amount for the purpose of improvement of housing conditions without repayment provision of principal debt before receipt of the contractual amount on which remaining balance is settled at the expense of the contractual amount according to this Law, domestic credit policy of bank and terms of the contract of bank loan;

3) interim housing loan - the target loan granted by housing construction savings bank to the investor for the purpose of improvement of housing conditions on condition of accumulating of minimum necessary size of cumulative money on which remaining balance is settled at the expense of the contractual amount under the agreement on housing construction savings according to this Law, domestic credit policy of bank and terms of the contract of bank loan;

4) single republican electronic base – the electronic database containing the information about citizens of the Republic of Kazakhstan, kandasa, the registered persons in need in the dwelling local executive bodies according to the Law;

5) subsistence minimum – the minimum cash income on one person, equal in size of cost of the minimum consumer goods basket;

6) the widow (widowers) – persons having dependent on the minor children and children studying according to general education or professional programs in the organizations of general secondary, technical and professional, postsecondary education, the higher, postgraduate education for full-time courses, but no more than before achievement of twenty-three-year age;

7) remuneration rate on loan (further - rate) - the interest rate paid by the investor for agreements on housing construction savings and bank loan for the loan granted by housing construction savings bank in percentage expression to principal debt at the rate of the annual size of the money which is due to housing construction savings bank;

8) mortgage housing loan (further - loan) – the mortgage bank loan granted for the purpose of construction of the dwelling or its purchase and (or) repair;

9) utility housing stock - the dwellings which are under authority of local executive bodies, assigned to special public institution on provision of dwellings in use;

10) large family – the family incorporating four and more jointly the living minor children, including children who are studying full-time according to general education or professional programs in the organizations of general secondary, technical and professional, postsecondary, higher and (or) postgraduate education after achievement of age of majority by them until the termination of the organizations of education (but no more than before achievement of twenty-three-year age);

11) кандас – the ethnic Kazakh and (or) members of his family of the Kazakh nationality who were earlier not consisting in the nationality of the Republic of Kazakhstan, received the corresponding status according to the procedure established by authorized body concerning population shift;

12) participants are citizens of the Republic of Kazakhstan, the kandasa staying on the registry needing the dwelling in single republican electronic base, electronic base "Center of Providing with the Dwelling";

13) the dwelling – the separate residential unit (the individual apartment house, the apartment, the room in the hostel, the modular (mobile) apartment house) intended and used for permanent residence, answering to the established construction, sanitary, environmental, fire protection and other obligatory standards and rules;

The modular (mobile) apartment house is understood as the object intended and used for accommodation of staff of special state bodies, the military personnel and members of their families, located in the closed and isolated military camps, boundary departments and other closed objects;
