About introduction of amendments to the order of the acting minister on investments and development of the Republic of Kazakhstan of June 26, 2015 No. 727 "About approval of rules of issue, storage, withdrawal of registration certificates and confirmations of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan, certification center of state bodies and national certification center of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of June 26, 2015 No. 727 "About approval of Rules of issue, storage, withdrawal of registration certificates and confirmations of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan, certification center of state bodies and national certification center of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 12181) the following changes:

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 1 to this order;

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by national certification center of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 2 to this order.

2. To department of digital decisions of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan (further – Rules) are developed according to the subitem 12) of Item 1 of article 5 of the Law of the Republic of Kazakhstan "About the electronic document and the digital signature" (further – the Law) and determine procedure for issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) means of cryptographic information security (further – SKZI) – the software or the hardware and software realizing algorithms of cryptographic transformations, generation, forming, distribution or management of enciphering keys;

2) authorized body in the field of informatization (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of informatization and "the electronic government";

3) the integrated management information system the personnel "E-Kyzmet" (further – the E-Kyzmet system) – the integrated management information system personnel and personnel capacity of public service of the Republic of Kazakhstan intended for the solution of paramount tasks of the Agency of the Republic of Kazakhstan for public service and service of personnel management of state bodies, and also development and enhancement of personnel management processes;

4) the workstation – the desktop computer as a part of local network intended for the solution of applied tasks;

5) the withdrawn registration certificate – the registration certificate granted by certification center of state bodies which is terminated according to the procedure, established by these rules;

6) the list of the withdrawn registration certificates (further – SORS) – the part of the register of registration certificates containing data on registration certificates which are terminated their serial numbers, date and the reason of recall (cancellations);

7) the carrier of key information – the specialized carrier in which for protection of the stored closed keys of the digital signature SKZI having the certificate of conformity to requirements of the national Standard of the Republic of Kazakhstan 1073-2007 "Means of cryptographic information security is used. General technical requirements" (3rd level);

8) certification center of state bodies of the Republic of Kazakhstan (further – UTs GO) – the certification center servicing state bodies, officials of state bodies in information systems and other state information resources of state bodies of the Republic of Kazakhstan;

9) the single transport circle of state bodies (further – UTS of GO) – the network of telecommunications entering information and communication infrastructure of "the electronic government" and intended for ensuring interaction local (except for the local networks having Internet access), departmental and corporate networks of telecommunications of state bodies, their subordinated organizations and local government bodies, and also other subjects of informatization determined by authorized body with observance of required level of information security;

10) application service UTs GO online – the service intended for forming online of requests for release and withdrawal of registration certificates of users of UTs GO in GO UTS network;

11) the applicant – state bodies of the Republic of Kazakhstan and their territorial subdivisions;

12) the registration certificate – the electronic document issued by the certification center for confirmation of conformity of the digital signature to requirements established by the Law;

13) the owner of the registration certificate (further – the user) – physical person or legal entity addressed to which the registration certificate legally owning the closed key corresponding to the open key specified in the registration certificate is granted;

14) electronic document management – exchange of electronic documents between state bodies, physical persons and legal entities;

15) electronic document management system (further – EDMS) – system of exchange of electronic documents, the relations between which participants are governed by the Law and other regulatory legal acts of the Republic of Kazakhstan;

16) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

17) open key of the digital signature – the sequence of electronic digital symbols available to any person and intended for confirmation of authenticity of the digital signature in the electronic document;

18) the closed key of the digital signature – the sequence of electronic digital symbols intended for creation of the digital signature with use of means of the digital signature;

19) the operator of information and communication infrastructure of "the electronic government" (further – the operator) – the legal entity determined by the Government of the Republic of Kazakhstan to which ensuring functioning of the information and communication infrastructure of "the electronic government" assigned to it is assigned;

19-1) authorized employee – the employee of state body or subordinated accessory of the organization given authority to the operator of UTs GO for giving, approval and variation of online statements on release and withdrawal of registration certificates UTs GO in the relevant state body;

20) the Type-C socket - the interface for connection of the carrier of key information to tablets;

21) Virtual Private Network the device (further – the VPN device) - virtual private network for exchange of information of two nodes.

Chapter 2. Procedure for issue of the registration certificate of the user

3. Issue of registration certificates UTs GO to the applicant is performed by one of the following methods:

1) offline (in case of filing of application by the employee of the operator);

2) online (in case of filing of application by the applicant);

3) by means of personal account of the authorized employee;

4) by means of the E-Kyzmet system.

4. Issue of registration certificates UTs GO to the applicant, offline, is performed in the following cases:

1) primary issue of the registration certificate of the user of UTs GO;

2) failure or loss of the carrier of key information of the user of UTs GO;

3) in case of need receipts of the second existing registration certificate on the carrier of key information with the Type-C socket.

UTs GO grants the registration certificate to the applicant based on the application for receipt of registration certificates offline directed by means of EDMS, in form according to appendix 1 to these rules. The staff of state bodies can have no more than 2 carriers of key information, one of which with the Type-C socket.

The employee of the operator makes generation of the closed key of the EDS and release of the registration certificate UTs GO to the applicant on the carrier of key information.

The carrier of key information is transferred to the applicant by mail or special mail service, or purposely by proxy the applicant's employee, in case of specifying of its surname, middle name name (in case of its availability) in the letter as the contractor, in case of presentation of the official ID or power of attorney on one-time receipt or withdrawal of registration certificates of users of UTs GO from the applicant in form according to appendix 2 to these rules.

In case of receipt purposely of the carrier of key information containing the registration certificate of the user of UTs GO, the authorized employee of the applicant undersigns for register of issue of registration certificates of users of UTs GO in form according to appendix 3 to these rules.

5. Issue of the registration certificate UTs GO to the applicant, online, is performed in case of availability of the carrier of key information at the user:

1) the applicant connects the carrier of key information to the workstation;

2) the applicant generates the closed key, by application in application service UTs GO online by means of UTS of GO;

3) the applicant by means of EDMS sends to UTs GO the letter with the statement on receipt of the registration certificate by means of application service online in form according to appendix 4 to these rules.

The employee of the operator, after receipt of the statement on receipt of the registration certificate by means of application service online from the applicant, performs verification of provided data on completeness and confirms the request for issue of registration certificates.

The applicant after confirmation of the request by the employee of the operator, establishes the registration certificate on the carrier of key information of the applicant.

6. Issue of the registration certificate UTs GO to the applicant, by means of personal account of the authorized employee, in case of availability of the carrier of key information:

1) the authorized employee of the applicant connects the carrier of key information to the workstation;

2) the authorized employee of the applicant submits the application by means of personal account;

3) the request is approved by the EDS of the authorized employee;

4) UTs GO, after receipt of the request from the authorized employee, issues the registration certificate of the user of UTs GO.

The applicant, after confirmation of the request by the employee of the operator, establishes the registration certificate on the carrier of key information.

7. Issue of the registration certificate UTs GO to the applicant, by means of the E-Kyzmet system, in case of availability of the carrier of key information at the user:

1) the employee of the applicant connects the carrier of key information to the workstation;

2) the employee of the applicant submits the application by means of the E-Kyzmet system;

3) the request is signed by keys of the EDS of the applicant and by means of UTS of GO goes to the owner of the E-Kyzmet system;

4) the owner of the E-Kyzmet system signs EDS keys the request which goes to UTs GO;

5) UTs GO, after receipt of the request from the E-Kyzmet system, issues the registration certificate of the user of UTs GO.

The applicant, after confirmation of the request by the employee of the operator, establishes the registration certificate on the carrier of key information.

8. Issue of the registration certificate of users of UTs GO is performed in the following terms:

1) for administrative government employees – within five working days from the moment of receipt of the request;

2) for political government employees – within one working day from the moment of receipt of the request.

9. The registration certificate is granted in electronic form, with structure of the registration certificate for users of UTs GO in form according to appendix 5 to these rules.

10. Local executive bodies of the Republic of Kazakhstan submit the application according to Item 5 of these rules.

11. The answer to the request on release of the registration certificate of the user of UTs GO of the applicant is:

1) for offline mode – transfer to the applicant of the carrier of key information purposely, mail or special mail service;

2) for online mode, personal account of the authorized employee and the E-Kyzmet system – release of the registration certificate of the user of UTs GO.

12. UTs GO refuses issue of the registration certificate in the following cases:

1) incompleteness of the submitted documents;

2) submissions of false information, including, discrepancy of the data of the applicant with data of the owner of the registration certificate, except as specified, connected with territorial or subordinated accessory of the organization;

3) according to the judgment which took legal effect;

4) not achievements of sixteen-year age by person;

5) availability of the existing registration certificate at the user of UTs GO, except for:

concurrent work of the user in two state bodies (in the presence of supporting documents);

the owner of the registration certificate with right to sign of requests for release of registration certificates of users of UTs GO in IS "E-Kyzmet";

concurrent work of the user with two carriers of key information, one of which has the Type-C socket.

13. The answer about refusal in issue of the registration certificate UTs GO to the applicant:

1) for offline mode – the written motivated answer is provided to the applicant by means of EDMS, within five working days from the date of the address of the applicant to UTs GO;

2) for online mode – by request variation in application service online with provision of cause of failure;

3) for personal account of the authorized employee - by request variation in application service online, with provision of cause of failure;

4) for the E-Kyzmet system – by request variation in application service online, with provision of cause of failure.

14. In case of not provision by the applicant of the letter sent according to the subitem 3) of Item 5 of these rules the application submitted by the applicant for receipt of the registration certificate online in electronic form, is cancelled after fourteen working days from the moment of application.

15. Effective period of the registration certificate constitutes three years from the moment of its release.

16. Issue of the registration certificate UTs GO for the VPN device:

1) the applicant by means of EDMS sends the letter on receipt of the registration certificate to Authorized body;

2) the authorized body after verification of the letter and the positive decision on need of release of the registration certificate for UTs GO for the VPN device, writes the letter to the employee of the operator for its further release;

3) the employee of the operator, after receipt of the letter from Authorized body, performs verification of provided data on correctness of data, further issues the registration certificate;

4) the employee of the operator reports the registration certificate for VPN devices to the applicant, by means of special mail service or purposely.

The registration certificate is granted in electronic form according to appendix 6 to these rules.

17. Issue of the registration certificate for the employee of archive to be made based on the application for the receipt of registration certificates offline on the employee of archive directed by means of EDMS in form according to appendix 7 to these rules.

The registration certificate of "The employee of archive" is granted in electronic form according to appendix 8 to these rules.

Chapter 3. Procedure for storage of the registration certificate of the user

18. Document storage about creation and cancellation of the EDS is performed according to the List of the standard documents which are formed in activities of the state and non-state organizations, with indication of storage duration, to No. 263 approved by the order of the acting minister of culture and sport of the Republic of Kazakhstan of September 29, 2017 (it is registered in the Register of state registration of regulatory legal acts for No. 15997).
