About measures for the effective organization of activities of the Ministry of ecology, environmental protection and climate change

According to the Presidential decree of the Republic of Uzbekistan of May 31, 2023 No. UP-81 "About Measures for Transformation of the Sphere of Ecology and Environmental Protection and the Organization of Activities of Authorized State Body":

1. Approve:

Priority activities of the Ministry of ecology, environmental protection and climate change, according to appendix No. 1;

The schedule of the organization of organization activity, transferred to system of the Ministry of ecology, environmental protection and climate change, according to appendix No. 2;

The schedule of establishing activities of the new structures created in system of the Ministry of ecology, environmental protection and climate change according to appendix No. 2a;

The schedule of establishing activities of the reorganized structures in system of the Ministry of ecology, environmental protection and climate change, according to appendix No. 2b;

Organizational structure of the Ministry of ecology, environmental protection and climate change, according to appendix No. 3;

"Road map" on deepening of reforms in the field of ecology and environmental protection and transformation of activities of system, according to appendix No. 4 *;

The plan of development of regulatory legal acts in spheres of ecology, environmental protection, forestry and hydrometeorology, according to appendix No. 5*.

Renew the rights to the real estate units, vehicles and other properties assigned to the organizations which will be reorganized, abolished, will be transformed and are transferred by the Ministry of ecology, environmental protection and climate change (further - the Ministry) to system of other organizations, without collection of the corresponding charges and other payments.

2. For the purpose of work on conducting the state monitoring of the surrounding environment to create in structure of the Ministry the Situational center without formation of legal entity.

Determine that for implementation of modern information and satellite technologies in obtaining, collection and distribution of hydrometeorological information is annually allocated no more than 3 percent of funds of off-budget fund of the Ministry.

3. Create the National center for climate change in the form of public institution under the Ministry, responsible for obligation fulfillment, accepted within the Parisian agreement (Paris, on December 12, 2015), and tasks in the field of sustainable development during the period till 2030.

4. Agree with offers of the Ministry according to which:

a) till July 1, 2023 the solid waste landfills belonging to the state unitary enterprises "Toza Hudud" and managements of improvement are transferred to the jurisdiction of the Ministry and registration of the property rights connected with it, including cadastral documentation, is performed on a grant basis;

b) the organizations forming waste submit in accordance with the established procedure to territorial subdivisions of the Ministry the report on building wastes for the period from the beginning of works on construction, reconstruction and (or) installation, repair, improvement, demolition of buildings and constructions before completion of these actions till the 5th day of the next month;

d) since August 1, 2026 the system of "expanded obligations" of producers of separate packing materials and goods which after loss of the consumer properties cause environmental damage (except for the exported goods), and also their importers on the republic territory, concerning the goods determined in appendices No. No. 6-7 to this resolution step by step takes root;

e) since July 1, 2023 actions for declaration about recovery by enforcement of the formed receivables for the services rendered to the population on collection and export of municipal solid waste are introduced in judicial authorities by the companies rendering services of sanitary cleaning.

5. To the ministry to develop and introduce to three-months time in accordance with the established procedure drafts of regulatory legal acts on improvement of ecological situation, rational operation of resources and transformation of the Andijan, Bukhara and Surkhandarya regions into regions, free from waste.

6. Introduce since March 1, 2026 regime of the environmentally friendly territory in tourist and recreational zones of Bostanlyksky and Zaaminsky districts.

7. To the ministry together with the Prosecutor General's Office, other interested ministries and departments to develop and introduce to three-months time in accordance with the established procedure the bill providing:

a) on input of the mode of the environmentally friendly territory:

import ban, realization and production of one-time plastic products, including glasses, plastic tubules, sticks for ice cream, Q-tips, packing film and separate types of plastic bags;

stimulation of use of organic fertilizers in agricultural industry;

establishment of the obligation of connection to centralized system of sewage or equipment by alternative treatment facilities of business entities as a result of which activities sewage are formed. At the same time application to the physical persons which did not fulfill this obligation, financial sanctions in the amount of 50-fold to the 100-fold size of basic settlement size to legal entities - from 100-fold to the 300-fold size of basic settlement size;

collection of ecological collection for entrance on vehicles, except for electric vehicles, special vehicles and vehicles of the citizens living in the territories in which the regime of the environmentally friendly territory is introduced;

determination of creation of the territories in which the regime of the environmentally friendly territory, and also other conditions and requirements is introduced;

b) prohibition on production and realization in the territory of the republic of packets from polymeric film less than 100 microns thick (polyethylene of high density (HDPE), polyethylene of the average density (MDPE), polyethylene of the low density (LDPE), rolled polyethylene of the low density (LLDPE), multilayer polyethylene (COEX)). At the same time:

this procedure does not extend to the packets from polymeric film made for export, which do not have handles and being integral part of goods, realized by rolls for use in economy and also to the packets made of biodegradable polymeric materials;

violation of requirements of this subitem is regarded as rejection of measures for mitigation of consequences of negative impact on the environment and is the basis for administrative prosecution. At the same time the extent of the harm done to the environment by waste is determined on the basis of procedure of payments of the harm done to the environment;

c) prohibition on implementation of activities acting and creation of the new Items of car wash which do not have system of circular water supply in the city of Tashkent and the regional centers for the purpose of protection of water, land resources and subsoil of the republic.

8. Determine that since July 1, 2023:

means of off-budget fund of the Ministry are created at the expense of the sources determined in appendix No. 8;

3 percent of the utilization collection paid by the physical persons and legal entities performing registration of vehicles under customs regime "release for free circulation (import)" are transferred in off-budget fund of the Ministry.

Since July 1, 2024 10 percent of utilization collection are transferred for pneumatic rubber tires and tires in off-budget fund of the Ministry.

9. For the purpose of strengthening, development in the population of the country of concepts about ecological consciousness and ecological culture to organize at the high level carrying out on the republic of the actions dated to the important dates devoted to environmental issues, environmental protections and climate changes on the basis of the schedule according to appendix No. 9.

Determine that the first heads of the relevant republican organs and executive bodies on places bear the personal responsibility for holding these actions.

10. Determine the Ministry authorized body by mutual cooperation and coordination of international treaties and the international organizations, according to appendix No. 10.

11. Approve the List of perspective projects of non-paid assistance (grants) realized in spheres of ecology, environmental protection, forestry and hydrometeorology according to appendix No. 11.

At the same time the minister of ecology, environmental protection and climate change and its deputies is allowed to participate in these international actions without additional approval.

12. Approve:

The list of the international conferences, assemblies and the events held on system basis in spheres of ecology, environmental protection and climate change in 2023 - 2025 according to appendix No. 12.

The perspective projects in spheres of ecology, environmental protection, forestry and hydrometeorology financed by direct investments and the credits of the international financial institutions according to appendix No. 12a;

The list of the innovative business ideas and startup projects recommended for realization in spheres of ecology, environmental protection, forestry and hydrometeorology according to appendix No. 12b.

13. To the ministry till July 1, 2023 for the purpose of reducing formation of food wastes and the prevention of excessive squandering in the field of public catering, and also implementation of recommendations (Global Initiative on Food Loss and Waste Reduction) of the Food and Agriculture Organization (FAO) of the UN to develop and introduce the Balanced diet Program providing in the Cabinet of Ministers:

determination of rational regulation of the use of food products, reducing the excessive use, including determination of regulation of one-time food of one person on the actions organized by state bodies;

increase in responsibility of business entities in the field of public catering and consumers for the use of food products;

forming of habit of healthy nutrition at citizens and the prevention of excessive squandering among the population, and also restriction of promotion of the above-standard use of food;

application of financial measures to persons which allowed squandering, and also establishment of mechanisms of control.

14. Determine the Ministry, the Ministry of Economics and finance, and also the Ministry of digital technologies responsible for establishment of control of cardinal reducing use of paper in state bodies and the organizations, by the separate directions - complete refusal of paper by complete digitalization of activities.

15. To the ministry together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent and the Ministry of Internal Affairs with involvement of volunteers since July 1, 2023 within one month to hold in regions mass event "Let the tree breathes", directed to release of trees from different lighting fixtures, advertizing banners and boards, and root systems of trees - from concrete and asphalt.

To the agency of information and mass communications, National broadcasting company of Uzbekistan, National news agency of Uzbekistan together with the Ministry by demonstration of social rollers and performances in mass media it is regular to carry out among the population explanatory work that causing such harm to trees is the basis for attraction to the corresponding responsibility.

16. To the ministry of investments, the industry and trade together with the Ministry:

attract foreign investments to spheres of ecology, forestry and hydrometeorology in 2023 - in the amount of 20 million US dollars, since 2024 - annually to attract at least 100 million US dollars. At the same time the corresponding employee of the Ministry of investments, the industry and trade is attached to the Ministry for rendering the practical help;

provide opening in commercial banks of credit line for business entities in the amount of 100 million US dollars at the expense of funds of the international financial institutions for installation heat - and gas-purifying devices, local water treatment constructions and systems of automatic monitoring.

17. To the ministry to enter project information of the National sustainability programme, widespread introduction of innovations and green technologies in the region Priaralya in 2022 - 2026 providing the following main directions in a month:

consecutive continuation of creation of green coverings - protective afforestations, and also system development of the protected natural territories;

creation of modern infrastructure of scientific and innovative activities, strengthening of integration of science and production;

cultivation and conversion of agricultural products, development of other types of production industries, use renewable and alternative energy sources;
