About standards of disclosure of information by the subjects of natural monopolies rendering transportation services of oil and oil products on bulk distribution lines

According to the Federal Law "About Natural Monopolies" Government of the Russian Federation decides:

1. Approve the enclosed standards of disclosure of information as the subjects of natural monopolies rendering transportation services of oil and oil products on bulk distribution lines.

2. Declare invalid the order of the Government of the Russian Federation of October 18, 2010 No. 844 "About standards of disclosure of information by the subjects of natural monopolies rendering transportation services of oil and oil products on bulk distribution lines" (The Russian Federation Code, 2010, No. 43, the Art. 5514).

3. Item 532 of the list of regulatory legal acts and groups of regulatory legal acts of the Government of the Russian Federation, regulatory legal acts, separate provisions of regulatory legal acts and groups of regulatory legal acts of federal executive bodies, legal acts, separate provisions of legal acts, groups of legal acts of executive and administrative organs of the government of RSFSR and USSR, the decisions of the State Commission on Radio Frequencies containing mandatory requirements to which provisions of parts 1, 2 and 3 articles 15 of the Federal law "About Mandatory Requirements in the Russian Federation" approved by the order of the Government of the Russian Federation of December 31, 2020 No. 2467 "About approval of the list of regulatory legal acts and groups of regulatory legal acts of the Government of the Russian Federation, regulatory legal acts are not applied separate provisions of regulatory legal acts and groups of regulatory legal acts of federal executive bodies, legal acts, separate provisions of legal acts, groups of legal acts of executive and administrative organs of the government of RSFSR and USSR, decisions of the State Commission on Radio Frequencies containing mandatory requirements to which provisions of parts 1, 2 and 3 articles 15 of the Federal law "About Mandatory Requirements in the Russian Federation" are not applied (Russian Federation Code, 2021, No. 2, Art. 471), to exclude.

4. This resolution becomes effective since September 1, 2025.

5. The standards approved by this resolution are effective within 6 years from the date of entry into force of this resolution.

Standards of disclosure of information by the subjects of natural monopolies rendering transportation services of oil and oil products on bulk distribution lines

I. General provisions

1. This document determines structure and procedure for disclosure of information which is subject to open entry (further - information), the subjects of natural monopolies rendering services in the field of oil transportation and oil products in bulk distribution lines (further - subjects of natural monopolies) concerning which state regulation and the state control (supervision) in spheres of natural monopolies, and also procedure for its provision are performed.

2. Disclosure of information hereunder is understood as ensuring access of the unrestricted group of people to information on regulated activities of subjects of natural monopolies irrespective of the purpose of receipt of such information.

3. Subjects of natural monopolies information reveals in the way:

a) publications on the official site of the subject of natural monopolies and (or) other official site on the Internet determined by the Government of the Russian Federation (further respectively - Internet network, the official site);

b) publications in the official printing mass media extended in subjects of the Russian Federation in the territory of which subjects of natural monopolies render regulated services in the field of oil transportation and oil products in bulk distribution lines (further - official printing publications);

c) provisions on a grant basis by written requests of consumers of services in the field of oil transportation and oil products in bulk distribution lines, including in electronic form (further respectively - request, the consumer).

4. If information is posted by the subject of natural monopolies only on the official site chosen by it, it shall publish data on it in official printing publications with reference to the corresponding official site. At the same time information posted on the official site shall be available within 5 years.

Subjects of natural monopolies shall report the address of the official site and the name of official printing publications where information is placed at the request of the consumer.

In the territories where there is no access to Internet network, information reveals by publication in official printing publications in full.

5. In case of the address of the consumer to the subject of natural monopolies with the request signed by the consumer, such request shall contain the following data:

a) the name of the organization to which the inquiry is sent;

b) the name of the legal entity or surname, name, middle name (in the presence) person who made inquiry;

c) the list of information concerning which the request is sent;

d) date of the address with request;

e) method of receipt of required information (by means of the mailing, issue personally to the consumer and (or) the directions of the electronic message) with indication of post and (or) electronic addresses.

6. Subjects of natural monopolies no later than 20 calendar days from the date of receipt of request provide to the consumer information according to the method of its obtaining chosen by the consumer.

If information requested by the consumer is opened in required amount on the official site and (or) in official printing publications, subjects of natural monopolies have the right, without opening required information, to tell the consumer the address of the official site and (or) the name and details of official printing publications where such information is placed.

Subjects of natural monopolies keep registration and account of requests of consumers, and also store copies of replies to the requests within 5 years.

7. Subjects of natural monopolies within 5 working days from the date of publication give information on its placement (with indication of official printing publications and (or) the address of the official site) in federal executive body, authorized to exercise the state control (supervision) in spheres of natural monopolies.

8. The changes made to the opened information are subject to publication in the same sources in which the relevant information was originally published:

a) within 30 calendar days from the date of decision making about modification - in official printing publications;

b) within 5 calendar days from the date of decision making about modification - on the official site.

9. In case of combination by the subject of natural monopolies of activities for rendering transportation services of oil and oil products information reveals separately on each of the specified types of activity.

10. In case of rendering by subjects of natural monopolies of transportation services of oil and oil products on several systems of bulk distribution lines which are technologically not connected among themselves for which different rates for transportation services of oil and oil products are established information reveals separately on each system of bulk distribution lines.

II. Structure of disclosed information

11. Subjects of natural monopolies open information:

a) about rates for transportation services of oil and oil products (with disaggregation of each component of rate) concerning which state regulation, with indication of source of official publication of the decision of regulating authority on establishment of rates is performed;

b) about the main indicators of financial and economic activities in the field of rendering transportation services of oil and oil products (including structure of the main production costs on rendering regulated services);

c) about the main consumer characteristics of regulated services of subjects of natural monopolies and their compliance to the state and other approved quality standards;

d) about availability (absence) of technical capability of access to regulated transportation services of oil and oil products;

e) about registration and the course of implementation of requests for access to transportation services of oil and oil products and requests for connection (connection) to the bulk distribution line of subjects of natural monopolies;

e) about conditions on which rendering regulated transportation services of oil and oil products by subjects of natural monopolies and (or) connection (connection) to the bulk distribution line of subjects of natural monopolies is performed;

g) about procedure for accomplishment of the technological, technical and other actions connected with connection (connection) to the bulk distribution line of subjects of natural monopolies;

h) about investing programs (about projects of investing programs);

i) about methods of acquisition, cost and about amounts of the goods necessary for rendering transportation services of oil and oil products.

12. The list of information which is subject to disclosure according to Item 11 of this document is exhaustive.

13. Information on the main indicators of financial and economic activities in the field of rendering transportation services of oil and oil products (including structure of the main production costs on realization of regulated goods) contains data:

a) about transportation loads (transfers, transfers, discharge, filling, acceptance, delivery) oil and oil products (as in general, and by separate types of oil products);

b) about amounts of commodity transport work in the field of oil transportation and oil products;

c) about revenue from rendering services to consignors in transportation (transfer, transfer, discharge, filling, acceptance, delivery) of oil and oil products;

d) about structure of cost of rendering transportation services of oil and oil products (material expenses, the salary with assignments, depreciation, capital repairs, diagnostics and other expenses);

e) about the number of the personnel occupied in regulated type of activity;

e) about the main technical performances of systems of bulk distribution lines (extent of linear part of bulk distribution lines, quantity of pumping points and total capacity of the repumping aggregates);

g) about the main technical performances of Items of transfer, transfer, discharge, filling, acceptance, delivery of oil and oil products which are technologically connected with bulk distribution lines (handling capacity and amount of the reservoir park).

14. Information on the main consumer characteristics of regulated services of subjects of natural monopolies and their compliance to the state and other approved quality standards contains:

a) average oil quality figures and oil products on leaving the system of bulk distribution lines, including on the main export delivery points;

b) normative indicators of losses of oil and oil products when transporting;

c) data on compliance of quality of the rendered services to the state and other standards (in the presence).

15. Information on availability (absence) of technical capability of access to regulated transportation services of oil and oil products reveals quarterly with breakdown on months, including with disaggregation on zones of entrance to pipeline system and exit from it - for subjects of natural monopolies, the rate for transportation services of oil and oil products on bulk distribution lines for which is established with disaggregation on the zones of entrance to pipeline system and exit from it determined based on regulatory legal acts.

16. In case of change of the indicators influencing availability (absence) of technical capability of access to regulated transportation services of oil and the oil products on bulk distribution lines including connected with change of technical characteristics of the bulk distribution line and weather conditions, essential fluctuations of temperature of outside air in relation to the average values determined based on statistical data, such information reveals in addition. At the same time, when in the specified cases information on availability (absence) of technical capability of access to regulated transportation services of oil and oil products on bulk distribution lines acquires uncertain nature, information reveals with indication of on its uncertainty.

17. Information on registration and the course of implementation of requests for access to transportation services of oil and oil products and requests for connection (connection) to the bulk distribution line of subjects of natural monopolies (further - requests) contains:

a) the number of the arrived requests (the number of the requests which arrived from applicants - legal entities and applicants - physical persons separately is specified);

b) number of rejected requests;

c) the number of the requests which are under consideration;

d) the number of the satisfied requests, including about commissioning of new delivery and acceptance points and systems of measurement of amount of oil and oil products.

18. Information on conditions on which rendering transportation services of oil and oil products by subjects of natural monopolies and (or) connection (connection) to the bulk distribution line of subjects of natural monopolies is performed contains:

a) essential conditions and (or) standard form of the agreement

about rendering transportation service of oil and oil products (in case of its availability);

b) essential conditions and (or) standard form of the agreement on connection (connection) to objects of bulk distribution lines and (or) to the Items of transfer, transfer, discharge, filling, acceptance, delivery of oil and oil products which are technologically connected with bulk distribution lines of subjects of natural monopolies (in case of its availability).

19. Information on procedure for accomplishment of the technological, technical and other actions connected with connection (connection) to the bulk distribution line contains regulations of accomplishment of the technological, technical and other actions connected with connection (connection) to the objects of bulk distribution lines and (or) Items of transfer, discharge, filling, acceptance, delivery of oil and oil products which are technologically connected with bulk distribution lines of subjects of natural monopolies.

20. Information on investing programs (projects of investing programs) contains:

a) data on construction, reconstruction or capital repairs of the objects which are part of the bulk distribution line;

b) data on the long-term financial investments;

c) data on acquisition of non-current assets;

d) reports on realization of investing programs regarding rendering transportation services of oil and oil products on bulk distribution lines.

21. In structure of investing program total investment in general for the program and for its Sections in particular, capital construction projects (the main buildings) with separation on the reconstructed (modernized) and new objects, the long-term financial investments, and also acquired non-current assets which cost exceeds 3 percent of the general amount of investments on appropriate sections are without fail specified, but constitutes at least 1 percent of the general size of investing program. For the main buildings which cost exceeds 10 percent of total cost of capital construction the construction cost of linear part of the bulk distribution line and pumping points is given separately.

For objects of the long-term financial investments cost assessment of investments in general on object and for the considered calendar year in particular is also specified.

22. Information on investing programs, except for information concerning item-by-item disaggregation of the long-term financial investments and acquisition of non-current assets and also information on the main indicators of financial and economic activities in the field of rendering transportation services of oil and oil products for bulk distribution lines reveal prior to the beginning of the accounting period. After the reporting period reports on realization of investing program and forming of the main indicators of financial and economic activities reveal.

23. If subjects of natural monopolies create several programs (investing program, the program of reconstruction and other programs) which include investees, information on all programs with indication of the volumes of investment for each of them reveals.

24. If subjects of natural monopolies perform investments which at the same time affect regulated and non-regulated types of activity, and correct reference of their part on regulated type of activity is impossible, information on such investments reveals completely with the corresponding comments.

25. If in one group of persons with the subjects of natural monopolies rendering transportation services of oil and oil products only part of investing programs is on a centralized basis created and (or) only the part of procurements of the goods necessary for rendering regulated services, information on the investing programs which are not entering centralized investing program and (or) about the decentralized purchases of the goods necessary for rendering regulated services is on a centralized basis conducted, reveals the certain subjects of natural monopolies creating the decentralized part of investing program and conducting the decentralized procurements of the goods necessary for rendering regulated services.

26. Information on methods of acquisition, cost and amounts of the goods necessary for rendering transportation services of oil and oil products on bulk distribution lines, contains data (including separately on the specialized organizations entering in accordance with the legislation of the Russian Federation about protection of the competition one group of persons to the subjects of natural monopolies rendering transportation services of oil and oil products, and on a centralized basis conducting procurement of the goods necessary for rendering regulated services):

a) about types (groups) of goods (works, services), transportation services of oil and oil products, necessary for rendering, on bulk distribution lines;

b) about amounts of acquired goods (works, services);

c) about the cost of acquired goods (works, services);

d) about methods of purchase of goods (works, services) in relation to each type (group) of these goods (works, services), including conditions of carrying out open tenderings (tenders, auctions).

27. Concerning subjects of the natural monopolies entering in accordance with the legislation of the Russian Federation about protection of the competition one group of persons, rendering transportation services of oil and oil products on bulk distribution lines generally on group of persons its main managing society reveals:

a) information specified in the subitem "an" of Item 11 of this document - in case of the conclusion of service agreements on oil transportation and oil products with consignors the main managing society of group of persons;

b) information specified in the subitem "b" of Item 11 of this document - in case of establishment of rates for transportation services of oil and oil products based on the consolidated information on group of persons;

c) information specified in the subitem "v" of Item 11 of this document - in case of identity of the main consumer characteristics of transportation services of oil and oil products;

d) information specified in subitems "g" - Item 11 of this document, - in case of the conclusion of service provision agreements on oil transportation and oil products and connection (connection) to bulk distribution lines of subjects of natural monopolies;

e) information specified in the subitem "z" of Item 11 of this document - in case of centralized forming of investing programs regarding regulated type of activity;

e) information specified in the subitem "i" of Item 11 of this document - in case of centralized implementation of purchases of the goods necessary for rendering regulated services.
