About use of the family capital on improvement of housing conditions

Based on part two of Item 21 of the Regulations on provision of the family capital approved by the Presidential decree of the Republic of Belarus of September 18, 2019 No. 345, of part three of Item 39 of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital approved by the resolution of Council of Ministers of the Republic of Belarus of February 24, 2015 No. 128, the Ministry of Architecture of the Republic of Belarus DECIDES:

1. Approve the Instruction about use of the family capital on improvement of housing conditions it (is applied).

2. Recognize to invalid:

the resolution of the Ministry of Architecture of the Republic of Belarus of March 31, 2015 No. 10 "About approval of the Instruction about use of funds of the family capital for improvement of housing conditions";

the resolution of the Ministry of Architecture of the Republic of Belarus of December 11, 2019 No. 68 "About change of the resolution of the Ministry of Architecture of the Republic of Belarus of March 31, 2015 No. 10";

the resolution of the Ministry of Architecture of the Republic of Belarus of December 16, 2021 No. 104 "About change of the resolution of the Ministry of Architecture of the Republic of Belarus of March 31, 2015 No. 10";

the resolution of the Ministry of Architecture of the Republic of Belarus of May 17, 2024 No. 41 "About change of the resolution of the Ministry of Architecture of the Republic of Belarus of March 31, 2015 No. 10".

3. This resolution becomes effective after its official publication.

The instruction about use of the family capital on improvement of housing conditions

1. This Instruction determines single questions of realization by citizens of the right to use (including early) one-time state support in form of non-cash (further – the family capital) according to the paragraph the second parts two and the paragraph the second parts three of Item 9 of the Regulations on provision of the family capital, and also procedure for return of unused means of the family capital.

2. For early use of the family capital the citizen addresses to division of open joint stock company "Belarusbank savings bank (further – JSC ASB Belarusbank), performing account transactions on accounting of bank deposits (deposits) "Family capital" of physical persons, with the statement for early use of the family capital in form according to appendix 1.

When using the family capital after the expiration of 18 years from birth date of the child, in connection with the birth (adoption, adoption) of which the family capital is appointed, the citizen addresses to division of JSC ASB Belarusbank with the statement for use of the family capital after the expiration of 18 years from birth date of the child, in connection with the birth (adoption, adoption) of which the family capital, in form according to appendix 2 is appointed.

3. With the statements specified in Item 2 of this Instruction, the citizen submits the identity document, and also the document confirming powers of the representative – in case of the address of the citizen with the statement through the representative, the copy of the decision (the statement from the decision) district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city about the order means of the family capital (including early) (rural, settlement, district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city – if the decision on the early order is made by means of the family capital till September 9, 2022 inclusive), and also the following documents:

3.1. in case of construction or reconstruction of the single-family apartment house, the apartment in the apartment or blocked apartment house (further – premises) based on the agreement of creation of object of shared-equity construction:

copy of the contract of creation of object of shared-equity construction with presentation of the original of this agreement;

the certificate of construction cost (reconstruction) of premises in current prices determined based on estimate documentation, issued by the builder;

3.2. in case of construction or reconstruction of premises as a part of the organization of builders:

the copy of the agreement of construction (reconstruction) of premises as a part of the organizations of builders with presentation of the original of this agreement;

the certificate of construction cost (reconstruction) of premises in current prices determined based on estimate documentation, issued by the organization of builders;

3.3. in case of construction or reconstruction of the single-family apartment house, the apartment in the blocked apartment house economic, contract or mixed (economic and contract) method:

the copy of the construction contract (in case of construction or reconstruction by economic method) with presentation of the original of this agreement (in case of its availability) and (or) agreements (invoices) on acquisition of construction materials and products or the copy of the civil agreement (when implementing construction works by the individual entrepreneurs or citizens performing independent professional activity) with presentation of the original of this agreement;

the certificate of the cost of construction, reconstruction of the single-family apartment house or the apartment in the blocked apartment house in current prices determined based on estimate documentation (estimate), and cost of the performed works, the purchased materials and products;

3.4. in case of acquisition of premises, share (shares) in the property right to it, including premises which construction was performed according to the state order, – the copy of the contract for acquisition of premises, share (shares) in the property right to it with presentation of the original of this agreement registered in accordance with the established procedure;

3.5. in case of return (repayment) of the credit, including preferential, provided on construction, reconstruction, acquisition of premises, acquisition of share (shares) in the property right to it (including based on agreements on transfer of debt, on acceptance of debt on such credits, on refinancing of such credits), and interest payment for use of it:

the copy of the credit agreement (agreement on transfer of debt, on acceptance of debt on the credit) with presentation of the original of this agreement;

the certificate of remaining balance of debt on the credit, including the amount of principal debt and interests on credit, – from the bank which granted the loan;

3.6. in case of capital repairs and reconstruction of premises, construction of engineering networks, construction of economic rooms and constructions (further, unless otherwise specified, – capital repairs of premises):

the copy of the construction contract with presentation of the original of this agreement and (or) agreements (invoices) on acquisition of construction materials and products;

the copy of summary estimate calculation of cost of capital repairs of premises with presentation of the original of this summary estimate calculation;

3.7. in case of return (repayment) of the credit, including the preferential, provided on capital repairs premises, and interest payment for use of it:

the copy of the credit agreement with presentation of the original of this agreement;

the certificate of remaining balance of debt on the credit, including the amount of principal debt and interests on credit, – from the bank which granted the loan;

3.8. in case of return (repayment) of the loan granted by the organization on construction, reconstruction, acquisition of premises, acquisition of share (shares) in the property right to it, and interest payment for use to them:

the copy of the loan agreement with presentation of the original of this agreement;

the certificate of remaining balance of debt on loan, including the amount of principal debt and interest for using loan, – from the organization which granted loan.

4. The references listed in paragraph three of subitems 3 are attached to the statements specified in Item 2 of this Instruction. 1, 3.2, 3.5, 3.7 and 3.8 of Item 3 of this Instruction, the filing of applications issued not earlier than 30 days before date. The reference provided in paragraph three of subitem 3.3 of Item 3 of this Instruction is provided in case of the initial address with the statement.

5. Return of the unused means of the family capital transferred by JSC ASB Belarusbank into accounts of legal entities or physical persons, including individual entrepreneurs according to Item 39 of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital, is made no later than three months from the date of agreement cancelation and (or) unilateral refusal of agreement performance, change of its conditions, from the date of the termination of organizational membership of builders, approach of other circumstance if other term is not established by the legislation.
