About introduction of amendments to the Law of Ukraine "About the organization of employment relationships in the conditions of warlike situation" concerning exchange of information and suspension of action of the employment contract

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About the organization of employment relationships in the conditions of warlike situation" of March 15, 2022 No. 2136-IX; with the changes made by the Law of Ukraine of July 1, 2022 No. 2352-IX, the following changes:

1. Add Article 5 with part three of the following content:

"3. During action of warlike situation the worker whose workplace is located in the territories of active fighting which is absent from work, is not subject to dismissal based on item 4 of part one of Article 40 of the Labor code of Ukraine. Time of absence from work of such worker is not subject to payment and is not set off in the length of service granting the right to annual main leave, stipulated in Item 4 parts one of article 9 of the Law of Ukraine "About leaves".

2. In Article 7:

in word part one of "documents in areas of active fighting" shall be replaced with words "documents in the territories of active and possible fighting which list is approved according to the procedure, established by the legislation";

add with parts three and the fourth the following content:

"3. Each of the parties of the employment contract shall constantly (including during suspension of action of the employment contract) to provide possibility of communication with it and instantly (in time no more than 10 calendar days) to inform other party of the employment contract on change of the contact information, in particular addresses of the location (residence), the e-mail address (in the presence), phone numbers and so forth. Accomplishment of this obligation is provided:

the employer - by entering of corresponding changes into the information about him containing in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming;
