About modification and amendments in some orders of the acting minister of transport and communications of the Republic of Kazakhstan and the acting minister on investments and development of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the acting minister of transport and communications of the Republic of Kazakhstan of November 1, 2013 No. 859 "About approval of Rules of rendering services in transportation of persons with disability road transport" (it is registered in the Register of state registration of regulatory legal acts at No. 8950) the following changes and amendment:

in Rules of rendering services in transportation of faces with disability road transport approved by the specified order:

add Item 24 with the subitem 6) of the following content:

"6) availability of persons on duty of invataksa for servicing of persons with disability and children with disability in evening and night time of day, days off and holidays.";

3) of Item 28 to state the subitem in the following edition:

state Item 29 in the following edition:

"29. The basis for provision of service of invataksa to persons and children with disability of the first, second or third group (including age up to 7 years) is the existing conclusion of the medical and consulting commission for the term of disability establishment.

For receipt of service person with disability needs to provide to the organization rendering service of invataksa, the following documents:

1) the statement (in any form);

2) identity document or certificate of birth;

3) the conclusion of the medical and consulting commission on form 026/at, the acting minister of health care of the Republic of Kazakhstan approved by the order of October 30, 2020 No. KR DSM-175/2020 "About approval of forms of accounting documentation in the field of health care, and also instructions for their filling" (it is registered in the Register of state registration of regulatory legal acts at No. 21579);

4) the certificate of disability in form according to appendix 19 to the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 29, 2023 No. 260 "About approval of Rules of conducting medico-social examination" (it is registered in the Register of state registration of regulatory legal acts at No. 32922).

The documents specified in subitems 2), 3) and 4) are represented in originals and copies for reconciliation then originals of documents return to person with disability.

The identity documents used and represented to physical persons and legal entities by means of service of digital documents are equivalent to paper documents.

In case of absence in medical institution (polyclinic) of the profile specialist corresponding to the basic and (or) the accompanying diagnosis of the child with disability or persons with disability, the medical and consulting commission of medical institution (polyclinic) takes the conclusion of the private profile specialist having the corresponding qualification and the license for medical activities as basis.".

2. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of March 26, 2015 No. 349 "About approval of Rules of transportations of passengers and baggage by road transport" (it is registered in the Register of state registration of regulatory legal acts at No. 11550) the following changes and amendments:

in the Rules of transportations of passengers and baggage by road transport approved by the specified order:

add Item 3 with subitem 7-1) of the following content:

"7-1) operator of electronic payment system of journey – the individual entrepreneur or the legal entity providing the organization and functioning of electronic payment system of journey;";

add with Item 41-1 of the following content:

"41-1. Payment of journey on regular city and suburban routes is made by the passenger after vehicle start of motion from Item of landing and before implementation of stop this vehicle on the following stopping point.";

state Item 42-1 in the following edition:

"42-1. Registration of journey on regular routes of transportations of passengers and baggage on which the electronic payment system for journey is used is performed by the passenger by applying of the electronic travel document, payment card to working area of the reader of the corresponding electronic transport self-service terminal of the passenger or through electronic payment system for journey, including by means of the Internet and devices of cellular communication (including the foreign subscriber), without issue of the paper travel document (ticket) about payment for journey, including by scanning of Kyyur-ukazaniya (QR specifying), sending the SMS message (Sms) and (or) through mobile application of payment of journey.

Information on payment of journey is provided to the passenger in the Kazakh and Russian languages, and also in addition in English.";

add with Item 52-1 of the following content:

"52-1. On regular city and (or) suburban transportations of passengers and baggage servicing of routes by two and more operators of electronic payment system of journey is allowed.";

state Item 83 in the following edition:

"83. Modification on railway vehicles, in Certificates, is allowed by the body which granted this Certificate in case of the appeal of carrier and with condition of the fact that:

1) the replaced railway vehicles are similar class (or above) and years of release (or after it);

2) the supplemented railway vehicles in the main structure of the Certificate is not lower than class and years of release of the railway vehicles which are earlier specified as the main structure are not more senior;

3) the supplemented railway vehicles in reserve structure of the Certificate is not lower than class and years of release of the railway vehicles which are earlier specified as reserve structure are not more senior.";

state Item 156 in the following edition:

"156. The Commission joins representatives:

1) local executive bodies;

2) territorial authorities of transport control;

3) CAP;

4) associations of passenger bus carriers;

5) self-regulatory organizations in the field of motor transportations of passengers and baggage (in the presence in the settlement where competition is held);

6) regional chamber of entrepreneurs.

The structure of the Commission is created with prevention and elimination of conflict of interest according to the Law of the Republic of Kazakhstan "About anti-corruption".";

"174. Following the results of check the pretender committee puts down mark about reliability of the data provided in competitive offers in the filled form of information on the participant and attaches the certificate of compliance of the vehicles and technological base specified in competitive proposals of the participant to the requirements specified in Chapter 13 of these rules (further – the Reference), in form according to appendix 12-1 to these rules, and also results photo and (or) video filming of the vehicles and technological base provided in competitive offers.

For optimization of time, separation of members of pretender committee on objects and types of check, for the purpose of creation of opinions on reliability of the data provided in competitive offers and signing of the Reference is allowed.

The specified documents are sealed in the corresponding envelope with the request and documents submitted by the participant.";

"185. To the winner Konkursa who signed the Agreement the Certificate (on all duration of the agreement) on each route separately, the confirmatory right of work on the corresponding route is granted. Implementation of the specified transportations without Certificate is not allowed.";

add with Item 189-1 of the following content:

"189-1. The conclusion of cooperation agreement, the works agreement and (or) other contract of civil nature for performance of works and (or) rendering the services directed to direct transportation of passengers and baggage on regular city and suburban transportations is not allowed.";

state Item 190 in the following edition:

"190. In the presence of parity carrier (carriers) on regular long-distance interregional route, the carriers determined by local executive bodies sign the agreement on joint implementation of transportations on the parity basis.

Within 30 calendar days from the date of issue of allowing documents the carrier represents to local executive body of the copy of the agreements signed by carriers and administration of bus stations, bus stations, service point of passengers according to these rules (except city (rural).";

add with Item 196-3 of the following content:

"196-3. Modification on railway vehicles, in Certificates, is allowed by the body which granted this Certificate in case of the appeal of carrier and with condition of the fact that:

1) the replaced railway vehicles are similar class (or above) and years of release (or after it);

2) the supplemented railway vehicles in the main structure of the Certificate is not lower than class and years of release of the railway vehicles which are earlier specified as the main structure are not more senior;

"345-1. In case of the appeal of administration of bus station and (or) bus station, local executive bodies approve places of additional Items of landing and disembarkation of passengers along the regular route serviced by bus station and (or) bus station within the territory of the settlement in which this bus station and (or) bus station is located.";

3. To provide to committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-minister.

5. This order becomes effective after ten calendar days after day of its first official publication.
