About modification of part one of article 16 of the Law of Ukraine "About the organization of employment relationships in the conditions of warlike situation" concerning conducting checks concerning making of mobbing (persecution)
The Verkhovna Rada of Ukraine decides:
I. Part one of article 16 of the Law of Ukraine "About the organization of employment relationships in the conditions of warlike situation" of March 15, 2022 No. 2136-IX; with the changes made by the Law of Ukraine of July 1, 2022 No. 2352-IX to state in the following edition:
"1. During action of warlike situation the central executive body realizing state policy concerning supervision and control of compliance with law about work, and its territorial authorities can perform according to the statement of the worker or labor union unplanned actions of the state supervision (control) of compliance with law about work by legal entities irrespective of pattern of ownership, type of activity, managing and the physical persons using wage labor regarding observance of requirements of this Law, and also concerning identification of not properly executed employment relationships, making of mobbing (persecution) and legality of the termination of employment contracts.
Unplanned actions of the state supervision (control) concerning making of mobbing (persecution) cannot be performed along with the unplanned actions of the state supervision (control) for any other questions.".
II. Final provisions
1. This Law becomes effective from the date of, its publication following behind day, and becomes effective in three months from the date of its publication.
2. To the Cabinet of Ministers of Ukraine within three months from the date of entry into force of this Law:
adopt the regulatory legal acts necessary for implementation of this Law;
bring the regulatory legal acts into accord with this Law;
provide reduction by the ministries and other central executive bodies of their regulatory legal acts in compliance with this Law.
