About some questions of regulation of religious activities

For the purpose of realization of provisions of Articles 6, 32 Laws of the Kyrgyz Republic "About religious liberty and religious associations", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

- Procedure for production, acquisition, storage, import, export and distribution of religious materials, and also conducting the state theological examination in the Kyrgyz Republic according to appendix 1;

- Procedure for provision of religious education in the Kyrgyz Republic according to appendix 2.

2. To provide to national agency on cases of religions and the interethnic relations in case of the President of the Kyrgyz Republic the organization and carrying out work on wide explanation of regulations of the Procedure for production, acquisition, storage, import, export and distribution of religious materials, and also conducting the state theological examination in the Kyrgyz Republic and the Procedure for provision of religious education in the Kyrgyz Republic in a month.

3. To the State Customs Service under the Ministry of Finance of the Kyrgyz Republic and the Border service of the State committee of homeland security of the Kyrgyz Republic to take the necessary measures directed to suppression of illegal import and (or) export of religious materials and objects of religious appointment.

4. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

Procedure for production, acquisition, storage, import, export and distribution of religious materials, and also conducting the state theological examination in the Kyrgyz Republic

Chapter 1. General provisions

1. This Procedure for production, acquisition, storage, import, export and distribution of religious materials, and also conducting the state theological examination in the Kyrgyz Republic (further - the Procedure) establishes procedure for conducting the state theological examination of constituent documents of subjects of religious activities, the materials of religious content and objects intended for production (production), import, distribution in the territory of the Kyrgyz Republic and export them out of its limits. The procedure is developed in pursuance of polozheniystatya 32 Laws of the Kyrgyz Republic "About religious liberty and religious associations" for the purpose of streamlining of the specified activities in the territory of the Kyrgyz Republic.

2. This Procedure is applied when conducting the state theological examination for the purpose of the solution of the questions requiring special and (or) scientific knowledge in the field of religious studies, theology when implementing by authorized state body for religions of functions on accounting registration of subjects of religious activities and (or) the state control of production, acquisition, storage, import, export and distribution of religious materials (religious literature, other printing and audiovideo records) and objects of religious appointment (further - religious materials and objects).

3. Conducting the state theological examination is based on the principles of observance of right to liberty of conscience and religion, other rights and freedoms of man and citizen, rights of subjects of religious activities according to the conventional principles and rules of international law and according to the Constitution of the Kyrgyz Republic, the laws and other regulatory legal acts of the Kyrgyz Republic.

4. In this Procedure the following basic concepts are used:

1) the state theological examination (further - GRE) - the procedure of research of printing editions (literature, the brochure), audiovisual works (TV, film and videos, clips, records of concert programs, animated films, anime, the Hentai, etc.), electronic media of information (diskette, CD, the DVD the disks, materials placed on the Internet, and others) and other materials of religious content with participation of specialists, experts, with preparation and registration of conclusions, expert opinions, recommendations;

2) the conclusion of GRE - the written instrument formalizing the fact of carrying out theological research concerning materials GRE in which valid conclusions on the basis of special knowledge and according to competence of the specialist (expert) by means of determination in the materials which arrived on research, availability of variations or misstatements from religious canons, necessary for the solution of question of the admission (refusal in the admission) to production, import and distribution of the specified materials in the territory of the Kyrgyz Republic are stated;

3) materials of religious content (further - religious materials) - books, brochures, magazines, newspapers, leaflets and other printing editions, audiovisual works (TV, film and videos, clips, records of concert programs, animated films, anime, the Hentai, etc.), the electronic media of information (diskette, CD, the DVD the disks, materials placed on the Internet, and others) reflecting bases, history, ideology, doctrines and comments, and also practice of ceremonies of different religions of the world;

4) the expert (specialist) - the employee of authorized state body for religions or its territorial authority having special knowledge in the field of religious studies or theology, ability, professional skills, experience and GRE appointed according to this Procedure for production;

5) expert group - group of scientists, experts and specialists in the field of religious studies and theology in the necessary directions under authorized state body for religions;

6) import - movement of religious materials and (or) objects of the territory of the Kyrgyz Republic in any purposes in any manner, including transfer in the international mailings;

7) export - movement of the religious materials and (or) objects which are in the territory of the Kyrgyz Republic out of its limits in any purposes in any manner, including transfer in the international mailings;
