1. Approve the enclosed Program of simplification of formalities in case of the international airborne transportations representing set of the measures designed to assist establishment of procedures for the purpose of simplification of formalities in civil aviation of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

The program of simplification of formalities in case of the international airborne transportations representing set of the measures designed to assist establishment of procedures for the purpose of simplification of formalities in civil aviation of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Program of simplification of formalities in case of the international airborne transportations represents set of the measures designed to assist establishment of procedures for simplification of formalities in civil aviation of the Republic of Kazakhstan (further - the Program), is developed according to the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the international treaties ratified by the Republic of Kazakhstan.

The purposes of this Program are assistance and acceleration of airborne transportations, and also prevention of unreasonable delays of aircrafts, crews, passengers and load through simplification of the formalities connected with boundary, customs, sanitary and other types of control.

2. The basic concepts and terms used in this Program:

1) the commander of the aircraft of civil aviation (further - the commander of the aircraft) - the pilot having the admission for independent control of the aircraft of certain type on whom according to task for flight in commercial aircraft or the similar document in aircraft of general purpose responsibility for safe completion of flight (flights) is conferred;

2) authorized body in the field of civil aviation - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

3) authorized organization in the field of civil aviation - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

4) dining and saloon facilities - objects one-time or reuse, used by the operator of the aircraft for the purpose of servicing during flight, in particular, of food and ensuring convenience of passengers;

5) baggage - the personal belongings of passengers or crew members transported onboard the aircraft under the agreement with the operator of aircrafts;

6) the onboard equipment - objects, including means for first aid, crash equipment, dining and saloon facilities, held for use onboard the aircraft during flight, except for spare parts or onboard supplies;

7) onboard supplies - the sold or not sold goods intended for consumption by passengers and crew onboard the aircraft and the goods necessary for operation and maintenance of the aircraft, including fuel and lubricants, and also goods, held for sale to passengers and crew members for the purpose of their carrying out from aircraft board;

8) the unaccompanied minor passenger - the minor passenger accepted for airborne transportation without full age passengers, performing trip independently or with other minor passenger;

9) disinsection - complex of preventive and destructive actions for extermination of insects and arthropods for the purpose of protection from them of the person, animals, rooms and the territory;

10) disinfection - complex of the special events directed to destruction of causative agents of infectious and parasitic diseases in the external environment;

11) the customs applicant - person who declares goods, or on behalf of whom goods are declared;

12) the identity document, - the passport or other official document proving the identity and recognized in this quality by the Republic of Kazakhstan, issued by the state or the organization which can be used by the legal owner in case of international delivery;

13) the land equipment - the special devices intended for maintenance, repair and servicing of aircrafts on the earth including the test equipment and the equipment for load handling and servicing of passengers;

14) load - any property transported onboard the aircraft, except for mailings, onboard supplies and the accompanied or sent baggage;

15) unknown baggage - baggage which arrived to the airport with luggage label or without it and was not received or identified by the passenger;

16) unaccompanied baggage - baggage which is not transported on the same aircraft on which there is person which is its owner and is drawn up as air freight;

17) the area of spread of infectious disease (for the purposes of health protection of people) - the geographical area of active spread of infectious and parasitic diseases of the person;

18) customs duty - the obligatory payment levied by customs authorities in connection with movement of goods through customs border of the Eurasian Economic Union;

19) customs control - set of the measures performed by customs authorities including with use of risk management system, for the purpose of ensuring compliance with the customs legislation of the Eurasian Economic Union and (or) the Republic of Kazakhstan;

20) the customs declaration - the customs paper containing data on goods and other data necessary for release of goods;

21) customs payments - the customs fees, customs duties, customs fees which are subject to payment in the budget according to the Code of the Republic of Kazakhstan about customs regulation in the Republic of Kazakhstan in connection with movement of goods through customs border of the Eurasian Economic Union;

22) person without the right to entrance - person to whom by the interested state bodies it is refused or will be refused the right to entry into the Republic of Kazakhstan;
