About modification of some regulations (review of some aspects of legal regime of inheritance)
(As amended by the law of the Republic of Moldova of 29.12.2025 No. 330)
The Parliament adopts this organic law.
Art. I. - In the Civil code of the Republic of Moldova No. 1107/2002 (repeated publication: The official monitor of the Republic of Moldova, 2019, Art. No. 66-75, 132), with subsequent changes to make the following changes:
1. Part (Article 509 to state 2) in the following edition:
"(2) the Property right can be acquired according to the law owing to occupancy, the transaction, inheritance, accession, owing to fair acquisition, acquisitive prescription, and also according to the judgment in case it is the basis for transfer of property.".
2. State Article 2163 in the following edition:
"Article 2163. General provisions about inheritance
Inheritance is transition of property after death on the terms of universal succession as single and integrated whole.".
3. State Article 2170 in the following edition:
"Article 2170. Deprivation of inheritance right of the unworthy heir
(1) the Circumstances forming the basis for deprivation of inheritance right of the unworthy heir shall be established by degree of jurisdiction.
(2) Claim for deprivation of inheritance right of the unworthy heir can be submitted by any person to whose benefit discharge of the unworthy heir can serve even if it will occur only after discharge of other person.
(3) On the claims provided by part (2), terms of limitation period, stipulated in Article extend 2211.
(4) Effects of deprivation of inheritance right of the unworthy heir come after the introduction in the final force of the judgment.".
4. Recognize Articles 2171 and 2172 invalid.
5. State Article 2174 in the following edition:
"Article 2174. Effects of deprivation of inheritance right of the unworthy heir
(1) If after inheritance acceptance face is announced by degree of jurisdiction the unworthy heir, it shall return everything, received as inheritance, including the received fruits.
(2) the Heritable share of the unworthy heir deprived of inheritance right shares equally between other heirs.".
