Term of rendering the state service

state registration of annulment of marriage (matrimony) by mutual consent of the spouses who do not have minor children appears after monthly term from the date of filing of application. The current of term begins next day after filing of application and expires in the corresponding number of the next month. If this number falls on non-working day, then the working day following it is considered day of the termination of term. Monthly term cannot be reduced; state registration of annulment of marriage (matrimony) on the basis: the judgment which took legal effect about recognition of the spouse it is unknown absent, or incapacitated, also the court verdict about condemnation of the spouse for crime execution to imprisonment for the term of at least three years - 45 (forty five) calendar days (day of acceptance does not enter rendering the state service in time), with the notification in week time from the date of receipt of the statement of the spouse who is in prison, either the guardian of the incapacitated spouse, or the guardian over property of acknowledged it is unknown the absent spouse;

state registration of annulment of marriage (matrimony) based on the resolution of criminal prosecution authority on the announcement in the international search after three years, from the date of authorization by its court – 2 (two) working days;

modification, amendments and corrections in record of the act of civil status - 5 (five) working days;

in case of absence in IS the REGISTRY OFFICE of assembly record the term of rendering service is prolonged no more than for 15 (fifteen) calendar days, with the notification of uslugopoluchatel within 3 (three) calendar days (in case of prolongation of term of the consideration of the application which arrived through the State corporation result of rendering the state service goes the service provider to the State corporation); when giving through the portal – the notification on confirmation of adoption of the statement within 1 (one) working day goes to personal account; The Most allowed time of expectation for delivery of document package - 20 (twenty) minutes. The amount of the payment levied from uslugopoluchatel when rendering the state service and methods of its collection in cases, stipulated by the legislation the Republic of Kazakhstan

1. The cost of payment for services of state registration of acts of civil status is levied according to Item 1 of article 182 of the Code.

2. According to Item 2 of article 182 of the Code are exempted from payment for services of state registration of acts of civil status in case of presentation of supporting documents:

1) the veterans of the Great Patriotic War, veterans equated on privileges to veterans of the Great Patriotic War and combat veterans in the territory of other states, persons awarded with awards and medals of the former USSR for dedicated work and faultless military service in the back in days of the Great Patriotic War, the persons who worked (served) at least six months from June 22, 1941 to May 9, 1945 and are not awarded with awards and medals of the former USSR for dedicated work and faultless military service in the back in days of the Great Patriotic War, persons with disability and also one of parents of person with disability since the childhood, the child with disability, guardians (custodians) in case of presentation of supporting documents – for state registration of acts of civil status and issue of repeated certificates and certificates of state registration of acts of civil status;

2) the state organizations – for issue of repeated certificates of birth;

3) physical persons – for state registration of the birth of the child and issue of the certificate of birth;

4) physical persons – for state registration of death and for issue of certificates, repeated certificates, references and notifications on death;

5) physical persons – for cancellation of acts of civil status;

6) physical persons – for issue of certificates to them in case of change, amendment, recovery and correction of civil registrations in connection with the mistakes allowed in case of state registration of acts of civil status;

7) physical persons – for modification, amendments in assembly records about state registration of the birth in connection with paternity proof, adoption (adoption) of the child by citizens of the Republic of Kazakhstan and issue of repeated certificates of birth in connection with adoption (adoption) and paternity proof.

Working schedule

1) the service provider – Monday through Friday inclusive from 09:00 till 17:30 o'clock, break from 13:00 till 14:30 o'clock, except days off and holidays. The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) the State corporation – Monday through Friday inclusive from 9:00 till 18:00 o'clock without interruption, departments of servicing on duty of the population of the State corporation Monday through Friday inclusive from 9:00 till 20:00 o'clock and on Saturday from 9:00 till 13:00 o'clock except festive and the days off according to the Labor code of the Republic of Kazakhstan. Acceptance is performed according to the procedure of "electronic" queue, without the accelerated servicing, possibly booking of electronic queue by means of the portal;

3) the portal – round the clock, except for the technical breaks connected with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays, reception of an application and issue of result of rendering the state service is performed the next working afternoon).

List of documents necessary for rendering the state service

1) the statement for state registration of annulment of marriage (matrimony) in form according to appendix 18 or 19 to Rules depending on the basis of annulment of marriage (matrimony);

2) the identity document, or the electronic document from service of digital documents (for identification);

3) certificate on marriage (matrimony);

4) the document confirming payment for services of state registration of acts of civil status or the document which is the basis for release from payment (in need of its payment) according to Item 2 of article 182 of the Code;

5) data on the judgment which took legal effect on recognition of the spouse it is unknown absent, incapacitated, is limited capable or sentence the court/statement from the court verdict about condemnation of the spouse (-and) for crime execution to imprisonment for the term of at least three years;

6) the resolution of criminal prosecution authority on the announcement in the international search after three years, from the date of authorization by its court;

7) notarially certified power of attorney, in case of the address of the representative of uslugopoluchatel.

The list of necessary documents for modification, amendments and corrections of assembly record about annulment of marriage (matrimony):

1) the statement for modification, amendments and corrections in form according to appendix 32 to Rules;

2) the identity document, or the electronic document from service of digital documents (for identification);

3) the original certificate about state registration of the act of civil status which is subject to exchange in connection with modification, of amendment and corrections in record of the act of civil status, in case of loss of the original certificate to specify about its loss and data on registration of the act of civil status;

4) the document confirming availability of the basis for modification, amendment and correction of record of the act of civil status;

5) notarially certified power of attorney, in case of the address of the representative of uslugopoluchatel. In case of modification of the birth record in connection with change of name, middle name, surname - the statement for change of name, middle name, surname in form, according to appendix 7 to Rules, one photo of uslugopoluchatel of 3*4 cm in size.

In case of the address on the portal for registration of annulment of marriage (matrimony) by mutual consent of the spouses who do not have minor children:

1) the electronic statement certified by the EDS of uslugopoluchatel or the one-time password in case of registration and connection of subscriber number of the uslugopoluchatel provided by mobile operator to accounting record of the portal;

2) data on civil registration. In case of the repeated address for state registration of annulment of marriage (matrimony) by mutual consent of spouses in the same registering body if one of spouses cannot be for state registration of annulment of marriage (matrimony) after the expiration of monthly term in addition notarially certified consent to annulment of marriage (matrimonies) is provided. Service providers receive digital documents from service of digital documents through the realized integration on condition of the consent of the owner of the document provided by means of the "electronic government" of subscriber number of cellular communication of the user registered on the web portal by transfer of the one-time password or departure siding of the short text message as the answer to the notification portal web of "the electronic government".

The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, to requirements of the Code of the Republic of Kazakhstan "About scrap (matrimony) and family", to the Laws of the Republic of Kazakhstan "About identity documents" and "About national registers of identification numbers", these rules;

3) in case of the address for state registration of annulment of marriage (matrimony) based on the joint statement of spouses through the representative;

4) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service. By the laws of the Republic of Kazakhstan other bases for refusal in rendering the state services can be established.

Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporation

Uslugopoluchatelyam, having complete or partial loss of capability or opportunity to perform self-service in the procedure established by the legislation, independently to move, be guided, documents acceptance is made by the employee of the State corporation with departure at the place of residence by means of the address through Single contact center for rendering the state service 1414, 8 800 080 7777.

Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "personal account" of the portal, service desks of the service provider, and also Single contact center "1414", 8-800-080-7777.

Conditions of receipt of service by the third parties:

Electronic request of the third parties, on condition of the consent of person concerning which are requested the data provided from "personal account" on the portal and also by means of the subscriber number of cellular communication of the subject registered on the portal by transfer of the one-time password or departure siding of the short text message as the answer to the notification of the portal.

Service of digital documents is available to the users authorized in mobile application.

For use of the digital document it is necessary to undergo authorization in mobile application with use of the electronic and digital signature or one-time password, further to pass into the Section "Digital Documents" and to choose the necessary document.

In case of modification of assembly record about annulment of marriage (matrimony) in connection with change of name, middle name, surname if necessary by the employee of the service provider requests the additional documents confirming the reasons in connection with which the uslugopoluchatel asks to change name, middle name, surname.

2) the identity document, or the electronic document from service of digital documents (for identification);

3) the document confirming payment for services of state registration of acts of civil status or the document which is the basis for release from payment (in need of its payment) according to Item 2 of article 182 of the Code;

4) notarially certified power of attorney, in case of the address of the representative of uslugopoluchatel. In case of filing of application about issue of the repeated certificate (certificate) of death copies of the documents confirming relationship with the dead are in addition attached.

Verification of presence of assembly record about state registration of marriage (matrimony) is made from sixteen-year age in IS the REGISTRY OFFICE in case of receipt of the statement for issue of the certificate of marriage legal capacity for state registration of marriage (matrimony) outside the Republic of Kazakhstan.

For receipt of the certificate of marriage legal capacity copies of the certificate on annulment of marriage (matrimony) or the death certificate of the spouse (spouse) are in addition attached if the uslugopoluchatel was married (matrimony) outside the Republic of Kazakhstan.

Repeated registration certificates of acts of civil status, except death certificates, are issued to persons concerning whom the corresponding assembly record, and also to person (attorney) in writing (notarially certified power of attorney) to the representative for representation on behalf of this person (principal) is constituted.

In case of the address on the portal:

1) the electronic request signed by the EDS of uslugopoluchatel or certified by the one-time password in case of registration and connection of subscriber number of the uslugopoluchatel provided by mobile operator to accounting record of the portal;

2) documents of uslugopoluchatel in the form of electronic copies if civil registration is made outside the Republic of Kazakhstan.
