About modification of Licensed conditions of implementation of economic activity on cultivation of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the List of drugs, psychotropic substances and precursors approved by the Cabinet of Ministers of Ukraine, development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list

The Cabinet of Ministers of Ukraine decides:

1. Bring in Licensed conditions of implementation of economic activity on cultivation of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the list of drugs, psychotropic substances and precursors approved by the Cabinet of Ministers of Ukraine, development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list, approved by the resolution of the Cabinet of Ministers of Ukraine of April 6, 2016 No. 282 "Some questions of licensing of economic activity on cultivation of plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors"), included in the table I of the list of drugs, psychotropic substances and precursors approved by the Cabinet of Ministers of Ukraine, development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list" (In the Official Bulletin of Ukraine, 2016, No. 30, the Art. 1209, No. 65, Art. 2202; 2021, No. 74, Art. 4637; 2024, No. 90, the Art. 5805), the enclosed changes.

2. Determine, that the subjects of managing who obtained the license before entry into force of this resolution shall not later than within six months from the date of publication of this resolution to file to body of licensing the document according to appendix 10 to Licensed conditions of implementation of economic activity on cultivation of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the list of drugs, psychotropic substances and precursors approved by the Cabinet of Ministers of Ukraine, development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list No. approved by the resolution of the Cabinet of Ministers of Ukraine of April 6, 2016 282, taking into account the changes made by this resolution.

3. This resolution becomes effective in two months from the date of its publication.

Changes which are made to Licensed conditions of implementation of economic activity on cultivation of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the list of drugs, psychotropic substances and precursors approved by the Cabinet of Ministers of Ukraine, development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list

1. In Item 6:

Subitem 2 to state 1) in the following edition:

"2) the copies of certificates of the relevant state or utility healthcare institution of absence certified by the subject of managing at workers who on the service duties receive (or have) access directly to the drugs, psychotropic substances and precursors, mental disturbances connected with abuse of alcoholic beverages, drugs or psychotropic substances and also about absence among the specified workers of persons recognized unsuitable to accomplishment of the separate types of activity (works, professions, service) connected with drug trafficking, psychotropic substances and precursors (in the form established by the Ministry of Health);";

The paragraph of the sixth of subitem 6 to state 2) in the following edition:

"Pages of the data provided in paper form are numbered, make sure the signature with indication of surname and own name of the subject of managing (authorized person);";

4) to add Item with the subitem 9 of the following content:

"9) data on absence over the license applicant, the licensee of control in the value given in article 1 of the Law of Ukraine "About protection of the economic competition" and/or trade relations with residents of the states performing the armed aggression against Ukraine in the value given in article 1 of the Law of Ukraine "About defense of Ukraine" (appendix 10).".

2. Add Licensed conditions with Item 8-1 of the following content:

"8-1. The license applicant, the licensee, the heir cannot be directly or indirectly under control (in the value given in article 1 of the Law of Ukraine "About protection of the economic competition") and/or trade relations with residents of the states performing the armed aggression against Ukraine (in the value given in article 1 of the Law of Ukraine "About defense of Ukraine")".

3. State Item 10 in the following edition:

"10. In case of the termination of implementation of economic activity on drug trafficking, psychotropic substances and precursors fully or partially the licensee submits the method provided by part one of article 10 of the Law to body of licensing the statement for cancellation of the license fully or partially (appendix 5).".

4. State Item 13 in the following edition:

"13. The licensee shall notify body of licensing on change of the data specified in the statement, documents and data which are enclosed to the application for receipt of the license and tax within 10 days from the date of approach of such changes in body of licensing the adequate notice by any by method, convenient for it (by the personal address, the mailing or electronically). Data on condition of material and technical resources of the subject of managing and availability of personnel with indication of its qualification level are attached to the message (except the changes specified in the statement); availability of permission of National police to use of the objects and rooms intended for implementation of economic activity on drug trafficking, psychotropic substances and precursors; absence at workers who on the service duties will receive (or have) access directly to drugs, psychotropic substances and precursors, the criminal record which is not removed or not extinguished in accordance with the established procedure for making of the not heavy, heavy and especially serious crimes or criminal offenses connected with drug trafficking, the psychotropic substances and precursors including made outside Ukraine (appendix 3) in which only data which changed are specified.

In case of change of workers who will have access to the work connected with drug trafficking, psychotropic substances and precursors also documents according to the subitem 2 of Item 6 are attached.".

5. In Item 15:

in paragraph one of the word "shall inform in writing body of licensing and provide the documents provided by subitems 1-8" shall be replaced with words "submits to body of licensing the notification on change of data together with the documents provided by subitems 1-9";

exclude paragraph two.

"In case of submission by the licensee of the statement for suspension of action of the license fully or partially or statements for cancellation of the license fully or partially the copy of balance of inventory items according to appendix 6 to the Procedure of the activities connected with drug trafficking, psychotropic substances, precursors, including hemp for the medical purposes, and the control of their turnover approved by the resolution of the Cabinet of Ministers of Ukraine of June 3, 2009 No. 589 is enclosed to such applications (further - the Procedure) (The Official Bulletin of Ukraine, 2009, No. 44, the Art. 1477).".

9. State Item 30 in the following edition:

"30. The licensee shall have qualified personnel in quantity (depending on amount of drugs, psychotropic substances and precursors) that at least two people allow to carry out all tasks assigned to the licensee by these Licensed conditions, but.".

10. State Item 76 in the following edition:

"76. Destruction of drugs, psychotropic substances and precursors (except their unused balances in open ampoules, the waste formed in production process according to production schedules) is performed by licensees in coordination with Gosleksluzhboy according to procedure.".

11. In Item 77 of the word "without involvement of the representative of territorial authority of National police" to exclude.

12. State Item 79 in the following edition:

"79. Destruction (removal) of afterharvest remaining balance of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the list, remaining balance after cleaning of seeds of poppy, crops of plants for any reasons in the licensee performs according to procedure.".

13. Exclude Item 80.

14. State Item 81 in the following edition:

"81. The licensee shall observe requirements to the objects and rooms intended for implementation of activities for drug trafficking, the psychotropic substances and precursors established by the order of the Ministry of Internal Affairs of January 29, 2018 No. 52.".

15. State Item 82 in the following edition:

"82. In the pharmaceutical institutions performing retail trade by medicines it is allowed to use for storage of the drugs, psychotropic substances and precursors included in the list No. 1 of the table IV of the list the room for storage of medicines.".

16. Exclude Items 83 and 85.

17. State Item 85-1 in the following edition:

"85-1. Licensees in each place of implementation of economic activity on drug trafficking, psychotropic substances and precursors shall provide creation of necessary conditions to persons with disability and to other handicapped national groups for open entry to rooms according to the state construction regulations and rules that is documented by the specialist in the questions of technical inspection of buildings and constructions having the qualification certificate or the relevant organization authorized on carrying out such inspection (for subjects of managing, perform economic activity on medical practice, except the centers of the emergency medical care and medicine of catastrophic crashes in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol, and retail trade by medicines).".

18. Add the Procedure with Item 85-2 of the following content:

"85-2. Implementation of activities for drug trafficking, psychotropic substances in apartment houses for the purpose of provision to patients of the replacement supporting therapy with use of drugs is not allowed.".

19. Exclude Item 86.

20. Appendix 1 to Licensed conditions to state in the following edition:
