About modification and amendments in the order of the Minister of Defence of the Republic of Kazakhstan of January 24, 2017 No. 28 "About approval of Rules of military accounting of persons liable for call-up and recruits"

I ORDER:

1. Bring in the order of the Minister of Defence of the Republic of Kazakhstan of January 24, 2017 No. 28 "About approval of Rules of military accounting of persons liable for call-up and recruits" (it is registered in the Register of state registration of regulatory legal acts at No. 14881) the following changes and amendments:

in Rules of military accounting of the persons liable for call-up and recruits approved by the specified order:

state Item 2 in the following edition:

"2. Citizens, except for are subject to military accounting:

1) the women who do not have military specialty;

2) the persons retired from military service or excluded from military accounting on reaching age limit of stay in inventory or recognized not suitable for military service with exception from military accounting;

3) persons serving custodial sanction;

4) persons who are constantly living outside the Republic of Kazakhstan;

5) employees, and also cadets and students of military, special educational institutions of law enforcement and special state bodies of the Republic of Kazakhstan, bodies of civil protection.";

2) of Item 3 to state the subitem in the following edition:

"2) procedure for carrying out addition of citizens to local authorities of military management;";

"5. Duration of finding of citizens on military accounting is determined according to the Law "About Military Service and the Status of the Military Personnel" (further – the Law).

On age, persons liable for call-up are divided into categories of accounting:

1) in the first category consist:

officers – up to 50 years inclusive;

ordinary and sergeant structure – up to 40 years inclusive;

2) in the second category consist:

officers – from 51 to 60 years inclusive;

ordinary and sergeant structure – from 41 to 50 years inclusive.

Persons liable for call-up of the woman stay on the military registry in the second category:

officers – up to 45 years inclusive;

ordinary and sergeant structure – up to 35 years inclusive.

The military personnel dismissed from military service and the citizens who are staying in inventory, having military ranks "foreman", "chief ship foreman", "ensign", "warrant officer", "senior warrant officer", "senior warrant officer" stay on the military registry of the second category up to 50 years inclusive.";

"10. Addition of citizens to MOVA – the events of military accounting held MOVA for initial statement of citizens on military accounting.

The following persons are subject to addition to MOVA:

1) male citizens on reaching seventeen-year age;

2) the male citizens who were earlier not staying on the military registry;

3) persons who were naturalized the Republic of Kazakhstan, except for persons specified in Item 2 of these rules;

4) the female citizens having military specialty.

Initial statement of citizens on military accounting is performed by means of interaction of information systems of state bodies.";

add with Items 10-1 and 10-2 of the following content:

"10-1. The addition of male citizens on reaching seventeen-year age is carried out in the automatic mode.

In day of execution to the male citizen of seventeen years of IS of MO RK in the automatic mode creates electronic accounting card and receives the following data by means of ensuring interaction of information systems of state bodies: individual identification number (further – IIN); surname, name and middle name (in the presence); date, birthplace; place of employment (studies); about education availability; about family composition; about availability of the car driver license; about stay in the territory of the Republic of Kazakhstan; about recognized as persons with disability; about being on hospitalization and consisting on dynamic observation; about registration and removal from registration accounting of citizens at the place of residence; about availability or lack of committing by person of criminal offense; concerning which inquiry or pretrial investigation is carried on; concerning which the court considers criminal cases, and also about the sentences which took legal effect in their relation.

After receipt of data of IS of MO RK in electronic accounting card establishes the status about the citizen's relation to military service "Doprizyvnik" and determines MOVA by registration address of the permanent residence.".

In case of receipt of the notification in MO RK'S IS on addition of the male citizen of seventeen-year age area MOVA (the city of regional value) is carried out by the corresponding records to the accounting and alphabetic book.

10-2. Statement on military accounting to area MOVA (the city of regional value) of persons provided by subitems 2) – 4) Item 10 of these rules, is carried out according to Item 78 of these rules.";

"16. Treat private accounting and military papers:

1) the military ID of the reserve officer of Armed Forces of the Republic of Kazakhstan in form according to appendix 1 to these rules (further - the military ID of the reserve officer);

2) military ID of the reserve officer of special state bodies;

3) the military ID of ordinary and sergeant structures in form according to appendix 2 to these rules (further - the military ID of ordinary and sergeant structures);

4) the certificate of draft deferment on military service during mobilization, warlike situation and in wartime.

17. Treat documents of the main accounting:

1) the personal record of the recruit in form according to appendix 4 to these rules (further - the personal record of the recruit);

2) accounting card of the recruit in form according to appendix 4-1 to these rules;

3) accounting card of the person liable for call-up in form according to appendix 5 to these rules (further - accounting card);

4) personal card of form No. T-2 in form according to appendix 6 to these rules (further - personal card);

5) accounting послужная card (for officers);

6) the notice on transfer of the person liable for call-up on special military accounting.";

exclude Chapter 3;

state Item 42 in the following edition:

"42. The accounting and alphabetic book joins all recruits attributed to MOVA.";

state Item 46 in the following edition:

"46. In area MOVA (the city of regional value) all personal records of recruits are distributed on card-indexes in the following sequence:

1) attributed to MOVA in the current year (on rural districts alphabetically);

2) subject to appeal on conscription military service, separately in March-June, September-December (on rural districts alphabetically);

3) having draft deferment (the card-index is constituted on nature of delays "on family circumstances", "for education continuation", "for health reasons", "for other reasons");

4) candidates for receipt for military educational institutions;

5) specialized card-index (accounting of personal records of the recruits intended for completing of the Border service of Committee of homeland security of the Republic of Kazakhstan);

6) made criminal offense.

Personal records in each of the card-indexes stated above are distributed strictly alphabetically.

Personal records of the recruits recognized for health reasons unusable to military service in peace time it is limited suitable in wartime and unusable to military service with exception from military accounting are transferred to archive.";

state Item 61 in the following edition:

"61. In peace time military IDs are issued to citizens:

1) in MOVA in case of appeal on military service or military charges in Armed Forces, other troops and military forming;

2) military, special educational institutions in case of their transfer;

3) MOVA according to Item 77 of these rules:

dismissed from military service or service in law enforcement, special state bodies and served fixed term of military service;

exempted from places of detention and passing military service or service in law enforcement, special state bodies and served fixed term of military service;

arrived from other states and naturalized the Republic of Kazakhstan, from among earlier passing military (alternative) service or service in law enforcement and special state bodies;

recovered in military rank and passing military service or service in law enforcement and special state bodies.

Forms of military IDs of ordinary and sergeant structures are issued to military, special educational institutions MOVA on their request in quantity necessary for providing the arrived citizens.

Forms of military IDs of ordinary and sergeant structures are issued by military, special educational institutions to the studying citizens according to the sheet of issue, according to appendix of 22 these rules.

The sheet of issue is constituted in duplicate which second copy with not issued (damaged) forms of military IDs of ordinary and sergeant structures go to MOVA no later than 10 working days from the moment of issue.

Are issued to the citizens who were not passing military service, service in law enforcement and special state bodies for the purpose of ensuring mobilization readiness of the state military IDs during mobilization, warlike situation and in wartime according to the procedure, established by the legislation.";

"70. The citizens dismissed from law enforcement and special state bodies, who did not reach 27-year age and did not serve fixed terms of conscription military service are accepted on military accounting of recruits at the place of residence and further are called on conscription military service in accordance with general practice.
