About the single questions connected with determination of signs of acquiring of payment instruments

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", articles 10-12, 79 of the Law of Ukraine "About payment services", article 29 of the Law of Ukraine "About financial services and finance companies", for the purpose of determination of operations procedure of non-bank financial institutions in connection with determination of signs of acquiring of payment instruments the Board of the National Bank of Ukraine decides:

1. Finance companies which as of day of entry into force of this resolution have the right to provision of financial payment service on money transfer without opening of the account in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments determined by the conditions provided in Item 39 of the Section III of Provisions on the procedure for issue and acquiring of payment instruments approved by the resolution of Board of the National Bank of Ukraine of July 29, 2022 No. 164 (with changes) (further - signs of provision of financial payment service of implementation of acquiring of payment instruments) and which intend to provide financial payment service of implementation of acquiring of payment instruments, shall within four months from the date of entry into force of this resolution address to the National Bank of Ukraine (further - National Bank) on expansion of amount of their license for activities of finance company according to the procedure, determined by the Regulations on authorization of suppliers of financial services and conditions of implementation by them of activities for provision of financial services approved by the resolution of Board of the National Bank of Ukraine of December 29, 2023 No. 199 (with changes) (further - No. Provision 199).

2. Payment organizations which as of day of entry into force of this resolution have the right to provision of financial payment service on money transfer without opening of the account in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments and which intend to provide financial payment service of implementation of acquiring of payment instruments shall within four months from the date of entry into force of this resolution address to National Bank for expansion of amount of authorization of activities for provision of financial payment services according to the procedure, the determined Regulations on procedure of authorization of activities of suppliers of financial payment services and limited payment services approved by the resolution of Board of the National Bank of Ukraine of October 07, 2022 No. 217 (with changes) (further - No. Provision 217).

3. Finance companies and payment organizations which as of day of entry into force of this resolution have the right to provision of financial payment service on money transfer without opening of the account (further - the organization having the right to provision of financial payment service on money transfer without opening of the account) in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments or which intended to perform activities in which there are signs of provision of financial payment service of implementation of acquiring of payment instruments, and noted about it in the information reference concerning conditions and procedure for provision of financial payment services (further - the information reference) (in case of its submission to National Bank) and which do not plan to provide further financial payment service of implementation of acquiring of payment instruments, submit to National Bank the information reference / the updated information reference (in case of its submission to National Bank) which is drawn up in the form given in appendix 5 to No. Provision 217, within three months from the date of entry into force of this resolution.

4. Payment organizations, operators of mail service who as of day of entry into force of this resolution have the right to provision of financial payment services on money transfer without opening of the account and implementation of acquiring of payment instruments, in case of intention to continue provision of these services taking into account signs of provision of financial payment service of implementation of acquiring of payment instruments submit to National Bank the updated information reference which is drawn up in the form given in appendix 5 to No. Provision 217, within three months from the date of entry into force of this resolution.

5. The organizations having the right to provision of financial payment service on money transfer without opening of the account and in which activities there are no signs of provision of financial payment service of implementation of acquiring of payment instruments give to National Bank within three months from the date of entry into force of this resolution of assurance that in activities of such organizations there are no signs of provision of financial payment service of implementation of acquiring of payment instruments, and the information reference / the updated information reference (in case of its submission to National Bank) which is drawn up in the form given in appendix 5 to the Provision No. 217.

6. Payment organizations, operators of mail service which as of day of entry into force of this resolution have the right to provision of financial payment services on money transfer without opening of the account and implementation of acquiring of payment instruments if they do not intend to continue provision of these services taking into account signs of provision of financial payment service of implementation of acquiring of payment instruments, shall within four months from the date of entry into force of this resolution address to National Bank for narrowing of amount of authorization of activities for provision of financial payment services according to the procedure, determined by the Provision No. 217.

7. The documents specified in Items 3-5 of this resolution move with observance of the requirements established by Regulations on procedure of administrative production, general requirements to the documents and procedure for their submission to the National Bank of Ukraine within separate procedures approved by the resolution of Board of the National Bank of Ukraine of December 29, 2023 No. 200 (with changes).

8. The National Bank considers the information references specified in Items 3-5 of this resolution, according to the procedure, No. determined by the Provision 199, by the Provision No. 217 for the relevant organizations.

9. The organizations having the right to provision of financial payment service on money transfer without opening of the account and in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments have the right to continue to perform activities in which there are signs of provision of financial payment service of implementation of acquiring of payment instruments, based on the available license for provision of financial payment services / licenses for activities of finance company within nine months from the date of entry into force of this resolution.

Requirements of paragraph one of Item 9 of this resolution are not applied to the organizations having the right to provision of financial payment service on money transfer without opening of the account and in which activities there are signs of provision of financial payment service of implementation of acquiring of the payment instruments which did not file the documents specified in Items 3-5 of this resolution, the Provision No. 217 (for expansion/narrowing of amount of authorization of activities for provision of financial payment services), the Provision No. 199 (to expansion of scope of license on activities of finance company).

10. The National Bank within nine months from the date of entry into force of this resolution does not constitute the document in which violation is fixed, and does not apply corrective action to organizations which have the right to provision of financial payment service on money transfer without opening of the account and in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments, for implementation of such activities if organization which has the right to provision of financial payment service on money transfer without opening of the account and in which activities there are signs of provision of financial payment service of implementation of acquiring of payment instruments in the terms determined in this resolution filed the documents specified in Items 3-5 of this resolution to National Bank Provision No. 217 (for expansion/narrowing of amount of authorization of activities for provision of financial payment services), the Provision No. 199 (for expansion of scope of license on activities of finance company).

11. Department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform the finance companies, operators of mail service and payment organizations having the right to provision of financial payment services on money transfer without opening of the account and/or implementation of acquiring of payment instruments, information on adoption of this resolution.

12. The resolution becomes effective from the date of, its official publication following behind day.
