About modification of the Order of the Government of the Russian Federation of November 28, 2013 No. 1084

1. Approve the enclosed changes which are made to Rules of maintaining the register of contracts containing the data which are the state secret, approved by the order of the Government of the Russian Federation of November 28, 2013 No. 1084 "About procedure for maintaining the register of contracts containing the data which are the state secret" (The Russian Federation Code, 2013, No. 49, Art. 6427; 2014, No. 32, Art. 4522; 2016, No. 50, Art. 7103; 2019, No. 31, Art. 4641; No. 45, Art. 6357; 2020, No. 8, Art. 1040; No. 17, Art. 2765; No. 46, Art. 7299; 2021, No. 25, Art. 4830; 2022, No. 6, Art. 872; 2024, No. 28, Art. 4019).

2. Determine that the Ministry of Defence of the Russian Federation no later than 3 months from the date of entry into force of this Item sends according to Item 11 of Rules of maintaining the register of the contracts containing the data which are the state secret, approved by the order of the Government of the Russian Federation of November 28, 2013 No. 1084 "About procedure for maintaining the register of contracts containing the data which are the state secret" to the Federal Treasury in the form established by the Federal Treasury concerning public contracts according to the state defense order which were signed about day of entry into force of this Item and data on execution or termination of which in the Federal Treasury did not go, additional data, the stipulated in Item 3(2) specified Rules, by each separate stage of execution of the public contract (if the public contract provides separate stages of its execution), each delivery of products according to the state defense order provided by the corresponding separate stage of execution of the public contract (if the public contract provides separate stages of its execution and the corresponding stage of its execution several deliveries of products according to the state defense order are provided).

3. To the Federal Treasury till March 1, 2026 to establish form of provision of data, the stipulated in Item 2 presents of the resolution.

4. Items 1 and 2 of this resolution become effective since March 1, 2026.

Changes which are made to Rules of maintaining the register of contracts containing the data which are the state secret

1. In Item 3:

a) state the subitem "b" in the following edition:

"b) contract price information, about financing source:

the contract price, the maximum price value of the contract and the price of commodity unit, work, service (in the case provided by part 24 of article 22 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - the Federal Law), the amount of the payment which is subject to introduction according to the Federal Law by the procurement participant with whom the contract is signed (in case, stipulated in Item 7 parts 4 of article 74 of the Federal Law), approximate price value of the contract or formula of the price and the maximum price value of the contract (in the cases established by the order of the Government of the Russian Federation of January 13, 2014 No. 19 "About establishment of cases in which in case of the conclusion of the contract the formula of the price and the maximum price value of the contract are specified");

the size of advance payment in terms of money and in the form of contract price percent (if the contract provides advance payment);

information on the budget and level of the budget of budget system of the Russian Federation and (or) specifying on financing by extrabudgetary funds;

the payment schedule under the contract by each calendar year of execution of the contract, the payment schedule of the current financial year by each calendar month of execution of the contract, the accounting number of the budget obligation assigned according to the budget legislation of the Russian Federation;";

b) add the subitem "d" with words ", and also contract date";

c) state the subitem "e" in the following edition:

"e) information on subject to purchase:

the name of subject to purchase with indication of the purchased goods (including delivered in case of performance of works, rendering services), works, services;

code and the name of line item of the All-Russian Product Classifier by types of economic activity according to the name of subject to purchase;

information on quantity (except for the case provided by part 24 of article 22 of the Federal Law), goods unit of measure (when implementing purchase of the goods including delivered to the customer in case of accomplishment of the purchased works, rendering the purchased services);

information on amount (except for the case provided by part 24 of article 22 of the Federal Law), about unit of measure of work, service;

the name of the country of goods' origin according to the all-Russian qualifier used for identification of the countries of the world (in case of implementation of purchase of the goods including delivered to the customer in case of accomplishment of the purchased works, rendering the purchased services). If subject to purchase are works on construction, reconstruction, to capital repairs, asset demolition of capital construction, information on the country of goods' origin joins in the register of contracts concerning goods which in accordance with the legislation of the Russian Federation about financial accounting are subject to acceptance by the customer to financial accounting as separate fixed asset object;";

d) the subitem "i" after words" (separate stage of execution of the contract), including" to add with the words "the name, quantity, unit of measure of the delivered goods, amount of the performed work, the rendered service".

2. In Item 3 (1):

a) in the subitem "v" of the word" (in the cases provided by the Federal Law "About the State Defense Order")" shall be replaced with words "(it is specified in necessary case)";

b) add with the subitem "z" of the following content:

3. Add with Item 3 (2) the following content:

"3(2). Concerning the public contract according to the state defense order signed by the Ministry of Defence of the Russian Federation in addition to the data provided by Items 3 and 3 (1) these rules, the register of contracts joins the following data by each separate stage of execution of the public contract (if the public contract provides separate stages of its execution), each delivery of products according to the state defense order provided by the corresponding separate stage of execution of the public contract (if the public contract provides separate stages of its execution and the corresponding stage of its execution several deliveries of products according to the state defense order are provided):

a) the name, code on the Single codifier of objects of supply for federal state needs (EC 001-2023), unit of output according to the state defense order;

b) completion dates of each separate stage of execution of the public contract providing delivery of products according to the state defense order (if the public contract provides separate stages of its execution), the deliveries of products according to the state defense order provided by the corresponding separate stages of execution of the public contract (if the public contract provides separate stages of its execution and the corresponding stages of its execution several deliveries of products according to the state defense order are provided);

c) the delivery date of products planned in accordance with the terms of the public contract according to the state defense order;

d) actual date of delivery of products according to the state defense order;

e) the product quantity provided by the public contract according to the state defense order;

j) the name, code on the Single codifier of objects of supply for federal state needs (EC 001-2023), quantity, unit of measure of actually provided material resources to be provided (raw materials, materials, semifinished products and purchased components);

k) the data provided by subitems "v" - "д" Item 3 (1) these rules;

l) method of determination of price for products according to the state defense order (it is specified in necessary case);

m) the date of establishment of estimated price for products planned in accordance with the terms of the public contract according to the state defense order;

o) actual date of establishment of estimated price for products according to the state defense order;

o) the size of the expenses provided by the public contract on production development (including taking into account means which are necessary for development (building-up) of the production capacities providing accomplishment of the state defense order) products according to the state defense order (in case of availability of such expenses);

p) limiting loan amount, involved as the supplier (the contractor, the contractor) to execution of the public contract (in case of inclusion of the specified size in the public contract).".

4. In Item 11:

a) the paragraph one after the word of "contracts" to add with words "(except for the data on the contract signed for ensuring federal needs which are not the state secret)";

b) after paragraph two to add with the paragraph of the following content:

"The data on the contract signed for ensuring federal needs which are subject to inclusion in the register of contracts and not being the state secret are created by customers in electronic form, signed by the strengthened qualified digital signature of person having the right to act on behalf of the customer and go to the Federal Treasury with use of information systems of the Federal Treasury.".

5. In Item 12:

a) in the paragraph the second:

"and shall be replaced with words words", and "з";

6. Add with Item 13 (1) the following content:

"13(1). The check provided by the subitem "g" of Item 13 of these rules is not carried out in the relation:

a) the procurements conducted by the federal state unitary enterprises;

b) the procurements conducted by legal entities, not being the public or local government offices state or municipal unitary enterprises;

c) purchases regarding rendering services in loan granting;

d) purchases in the territory of foreign state (including in the territory of Baikonur) for ensuring activities of the customers performing activities in the territory of foreign state;

e) purchases of other receivers of the means of the federal budget performing transactions with budgetary funds on the accounts opened in divisions of settlement network of the Central bank of the Russian Federation or credit institution;

e) the procurements conducted through budget funds of the Union State.".

7. State Item 19 in the following edition:

"19. In case of negative result of check, stipulated in Item 13 these rules, the data provided by the customer do not join in the register of contracts. At the same time the authorized body within 3 working days from the date of obtaining from the customer of the data which are subject to inclusion in the register of contracts sends to the customer the protocol containing list of the revealed discrepancies and (or) the bases on which data do not join in the register of contracts.".

8. In appendix to the specified Rules:

a) in Section 3 to state the name of the column "Price of the Contract <5>" in the following edition:

"Price of the contract <8>";

b) add with footnote 8 following contents:

"<8> Is specified according to the data provided by the subitem "b" of Item 3 of Rules and included in the register of contracts.".
